CONCERNING NON-APPLICABILITY OF
INDIANA RESPONSIBLE PROPERTY TRANSFER LAW

Marshall E.Andich and Sandra Lee Andich(jointly and severally,the"Transferor"),state that:
(a)Transferor is the owner of certain real estate in Hamilton County, Indiana, more particularly described in
Exhibit A, attached hereto and incorporated herein by reference (the"Real Estate"); and (b)the Real Estate:
(i) contains no facilities that are subject to reporting under Section 312 of the federal
Emergency Planning and Community Right-to-Know Act of 1986 (42 U.S.C. §11022);
(ii) is not the site of any underground storage tanks for which notification is required
under42 U.S.C. §6991a and Ind. Code §13-23-1-2 (c)(8);
(iii) is not listed on the Comprehensive Environmental Response, Compensation, and
Liability Information System in accordance with Section 116 of the Comprehensive
Environmental Response, Compensation, and Liability Act (42 U.S.C. §9616); and
(iv) consequently is not "property" under, and is not subject to, the provisions of the
Indiana Responsible Property Transfer Law (Ind. Code §13-25-3-1, et seq.).
Transferor shall indemnify and hold harmless The City of Carmel Redevelopment
Commission from and against any and all claims, damages, losses, and expenses (including, without
limitation, attorneys'fees) arising from or connected with any misrepresentation contained herein.
Transferor is authorized to execute and deliver this Affidavit.

Marshall E. Andich and Sandra Lee Andich, who acknowledged the execution of the foregoing Affidavit

Begin thirty-eight feet (38) west of the northeast corner of said lot and run south sixty-six feet
(66) to the south line thereof, thence west with said line twenty-five (25), thence north sixty-six
feet (66) to the north line of said lot, thence east with said line twenty-five (25) feet to the place
of beginning.
And, begin at the northeast corner of said lot Five (5) and run thence west thirty-eight feet, thence
south sixty-six feet, thence east thirty-eight feet, thence north sixty-six feet to the place of
beginning.
Also, a strip two (2) feet wide off a part of the north side of Lot Six (6) in the original town of
Bethlehem, now Cannel, described as follows: Begin thirty-eight (38) feet west of the northeast
corner of said lot six (6) and run thence west twenty-five (25) feet, south two (2) feet, east
twenty-five(25) feet,north two (2) feet to the place of beginning.
