FINDINGS OF FACT - DEVELOP1\1ENTi\L ST ANDAH.DS VARIANCE
I. The approval of this Variance will not be injurious to the public health, safety, morals
and general \velfare of the community because: (i) the building fa.yade
projections/recessions wj]j still be a part of the building footprint and facade. but the
width will be closer to 4 feet, rather than 8 feet. and (ii) the building facade projections
will benefit the public as they will serve the purpose of the U.S. 421 Michigan Road
Corridor Overlay Zone requirement v.hich is to promote building facades which are
aestheticall y pleasing.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: (i) the building fa.yade
projections/recessions will still be a part of the building footprint and facade, but the
width v.'ill be closer to 4 feet. rather than 8 feet, and (ii) the building facade projections
will benefit the public as they will serve the purpose of the U.S. 421 Michigan Road
Corridor Overlay Zone requirement which is to promote building facades \vhich are
aestheticall y pleasing.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the buildings and their locations
on the site may have to be modified, which may cause the project to become infeasible.
DECISION
IT IS THEREFORE, the decision of the Cannel/Clay Board of Zoning Appeals that
Developmental Standards Variance Docket No. 050600 17V is granted, subject to any conditions
stated in the minutes of this Board, which are incorporated herein by reference and made a part
hereo f
