TION TIle Applicant, Estridge Developme11t Company ("Estridge"), is seekin.g special use approval to permit a swimming pool in an amenity area to SCf\le residents of the MU11'hy Hall Subdivision (~'Special Use Approval") and a variance regarding the required size of a swim.ming pool ("Pool Size Variance'~). In this regard, Estridge recently obtained on May 17, 2005 from the Plan Comlnission primary plat approval for a residential subdivision to be known as Murphy Hall. The Nlurphy Hall subdi~vision consists of approximately 55.327 acres and is located at the northwest con1er of west 141 st Street and Towne Road in Carmel. As part of the primary plat approval process, the Plan Commission reviewed al1d unallin10usly approved the site design of the amenity area which includes a swimming pool, pool house, playground, basketball court, and parking area. However, pursuant to Chapter 5.02 of the Carn1el Zoning Ordinance, Estridge is required to obtain Special Use Approval for tl1e swimming pool in this amenity area. Further, Chapter 25.17.01 of Cannel's Zoning Ordinance requires that swim.l11ing pools that are designed to serve the residents of a residential subdivision be a nlinilTIUlll of 2,000 square feet. However, the sVlin1lTIing pool that Estridge proposes to construct in the Murphy Hall subdiv~ision an1enjty area is 1,500 square feet in size~ Consequendy, Estridge is seeking a Pool Size Variance form Chapter 25.1 7.01 to allow the swimming pool to be 1,500 square feet in SIze. In conjunction with Chapter 5.02 of the Zoning Ordinance, Chapter 25 ~02.1 0 of the Calmel Z.oning Ordinance requires that a lifeguard be present alld ~~on dllty" during the hours that the pool is open for use by the residents of the subdivision. In this regard, Estridge comn1its and stipulates t11at it will comply with the requirements pertaining to a lifeguard and that the pool will be adequately fenced pursuant to the requirements of Cannel's Zoning Ordinance. \Ve look fOlvlard to presenting the Special Use Approval request and Pool Size Variance request to the Board of Zoning Appeals at its July 25,2005 meeting. Exterior Finish For AIl Honles: All homes constructed ~'ithin the Subdivision shall have a front elevation of 100% brick or cultured stone with the exception of the 729, 735 A and C Series homes. The 729, 735 }\ and C Series hon1es shall have a front elevation of greater than 75~/o brick or cultured stone. AI! homes constructed within the Subdivision shall be prohibited from having exteriors with vinyl siding. r\1I homes constructed within the Subdivision shall have exterior siding containing a wood composite of a Hardi-Plank material or the equivalent. 3. Neiehborhood S\vimmin2: Pool and Lifc2:uard The Subdivision shall contain an amenity area that shall include a swimming pool. The Developer and its successors and assigns, including the Homeowner's Association for Murphy Hall, agrees that a lifeguard sha1l be on duty during all hours that the pool is open for use to the residents of the S ubdiv isionA Section 6. Bindinf! on Successors These Commitments are binding on the Developer, the owners of the Real Estate, each subsequent owner of the Real Estate~ and each other person acquiring an interest in the Real Estate, unless modified or tenninated by the Plan Commission. These Commitments may be modified or tenninated only by a decision of the Plan Commission after a public hearing wherein notice as provided by the rules of the Plan Commission has been made. The provisions of this Section 5 notwithstanding, these Commitments shall temlinate as to any part or parts of the Real Estate hereafter reclassified (rezoned) on the City of Cannel's Official Zone Map to another zoning classification.
