The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because building a smaller pool than what is required will have no impact on the public health~ safety~ lllorals and general welfare of the community~ Further, the amenity area and pool -wrill serve to benefit the Murphy I-Iall subdi vision. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because the granting of this variance will have no impact on the use and va]ue of any area \vhich is adjacent to the property that is the subject of this requesL Further, the amenity area and pool will serve to benefit the Murphy Hall subdivision. 3. The strict application of the telTI1S of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because \~lithout the variance a pool may not be feasible for the subdi vision. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that the Development Standards Variance Request under Docket No. 050600 19V is granted~ subj ect to any conditions stated in the minutes of this Board, \vhich are incorporated herein by reference and made a part hereof.
