MEETING MINUTES
Date: Wednesday, June 19, 2013

9:00 a.m. Docket No. 13050009 SP: The Sanctuary at 116th Street, Section 4B.
The applicant seeks administrative secondary plat approval for 30 residential lots on 11.835 acres, including one
Common Area. The site is located at 4455 W. 121st Street and is zoned S-1/Residence. Filed by David Oakes of
CESO, Inc.
Ed Fleming of Weihe Engineering, and David Oakes and Jon Bills of CESO, Inc. presented on behalf of the
petitioner. This project will be 30 lots on 12 acres. The plans that are filed are for section 4B, but this will most
likely be changing to section 6.

- Asked when project would be starting. Mr. Fleming said the developers would like to start tomorrow, but

- Review letter is ready and will be finalized soon. Improvements to 121st Street per the Thoroughfare Plan
were not shown on plans. Improvements include widening, resurfacing, and stone shouldering. Also, since
the existing Sanctuary pond is being used, but is not in a common area, it may be a platted easement. The
Engineering Department would like this to be verified that there are easement agreements with the owner,
Paul Shoopman.

- Met with Weihe Engineering recently, and submitted comments. Waiting for these comments to be
addressed and then comment letter will be sent.

- Asked developer to fill out a survey with generic information about type of construction, developer and
other project details. Ms. Hunter said Duke will need to know if homes will be heated with gas or electric.
This information will be critical for the infrastructure design. Also, Duke will provide a conduit layout, and
developer will be required to install conduit under future roads. Duke has the utilities stubbed in this area

and this should not be a major issue.

9:15 a.m. Docket No. 13050012 DP/ADLS: Ricker's Gas Station & Convenience Store at Legacy.
Docket No. 13060001 ZW: Legacy PUD ordinance Z-501-07, Section 9.02 - maximum 15-ft front yard
building setback. The applicant seeks zoning waiver and site plan/design approval for a gas station with fuel
canopy and convenience store. The site is located at 7729 E. 146 Street (at the SWC corner of 146th and River
Rd.). It is zoned PUD/Planned Unit Development. Filed by Joseph Scimia of Faegre Baker Daniels, LLP on
behalf of Ricker Realty & Development, LLC.
Jamie Shinneman with Weihe Engineering, Joe Scimia with Faegre Baker Daniels, John Havard with Citizen’s
Energy Group, Andrew Jackson and Mike Montgomery with KRM Architecture, and Terry Matthews and Quinn
Ricker with Ricker Oil presented on behalf of the petitioner. This project is a new fueling station and
convenience store at the Southwest corner of 146th and River Road.
David Lucas – Hamilton County Highway Department
- When the Legacy PUD went through, Legacy approached the Board of Commissioners regarding approval
for all accesses to 146th Street. Mr. Lucas suggested the petitioner contact the Board of Commissioners to
make sure this project is feasible for access to 146th Street. If this project is feasible, there will be a traffic
impact analysis required. There will be no comments on an access point until the Highway Department
knows there will be access.

- Project has not been fully reviewed. There is a fill in floodplain worksheet that will need to be submitted
for flood plain compensation. Mr. Shinneman said this project is not taking place in the flood plain. Mr.
Thomas said this area is a one year time of travel to wells, so any BMP will need to be lined. Mr.
Shinneman said this may be one year time of travel for Citizens Water, but not City of Carmel. Mr. Havard
said there was an approved storm water plan for the site recently, but it did not accommodate was the lined
pond that would provide the overflow detention for the site.

- Landscape plan will be required. There is a three-phase circuit that parallels 146th Street on the south side.
The trees on this plan appear to conflict with the line if the species are tall-growing. A service request will

need to be submitted. Petitioner will need to contact Tom Wardway, who will be the Duke Energy contact
on this project. Ms. Hunter said Duke is trying to work with the City of Carmel to incorporate Duke’s
requirements into the City’s requirements for these types of projects. Ms. Hunter said the pole shown on
plan C105 is not a useable pole, and if three-phase service is required, the pole to the west of this will need
to be used.
Bruce Knott – City of Carmel Fire Department
- Asked if this fueling station will be 24-hour. Mr. Shinneman said they will have the capability to be 24-
hour but the hours have not yet been established. Mr. Knott said if this station will not be 24-hour, a Knox
Box will need to be on the building.
Angie Conn – City of Carmel Planning & Zoning
- Review comments will most likely be sent by Friday. The two largest issues are regarding building
architecture, and also the wellhead protection area and underground storage tanks.
John Duffy – City of Carmel Utilities Department
- This is not within the one year time of travel as it stands today. In the future, there are two future wells
planned. In the most recent delineation that was done, which took into account Indianapolis wells,
Westfield wells, and the two future Carmel wells, the project was not in the one year time of travel.
However, this was within the Citizens Water one year time of travel. Carmel Utilities will provide a full
review, and will ask for a meeting with Ricker’s gas consultants to review comments.
Civilian John Hendrick from Citizens Water expressed opposition to the project. Mr. Hendrick said there
are wells located to the north, and the aquifer serves a number of different utilities. Mr. Hendrick said there
are also private wells which serve residences and mobile homes.
9:25 a.m. Docket No. 13050007 SP: The Meadows at Legacy, Section 2 (Legacy PUD).
The applicant seeks administrative secondary plat approval for 26 lots on 9.95 acres. The site is located
southwest of Community Dr. and Cherry Creek Blvd. It is zoned PUD/ Planned Unit Development. Filed by
Tim Walter of Platinum Properties, LLC.
Brett Huff with Stoeppelwerth & Associates presented on behalf of the petitioner. This project is 26 lots, and is
the second section of the overall Meadows area. Section one of the Meadows is currently being constructed, and
this is the second phase.

- This project is outside of HCHD jurisdiction. Mr. Lucas wanted to add that as Community Drive continues
to build out, eventually a traffic study would be required at the intersection of Community Drive and 146th
Street.

started as soon as the developer is through the approval process.

- There are a few small items such as signage that will be addressed in comments. The major issue is the
detention being proposed is supposed to wrap through other BMP’s prior to leaving the site. There is also a
temporary swale shown connected to another BMP. The department will need to look at whether the other
BMP’s need to be included in the master plan.

The applicant seeks administrative approval for construction plans for a brew pub on 0.21 acres. The site is
located at 12702 Meeting House Rd. It is zoned PUD/ Planned Unit Development. Filed by Dave Sexton of
Terra Site Development, Inc. on behalf of Abbey Tap House, LLC.
Dave Sexton with Terra Site Development presented on behalf of the petitioner. Mr. Sexton said this project is
a brew pub where beer will be brewed on site. The site is at the corner of Rhettsbury and Meeting House Rd.

- This project has not been reviewed. Mr. Sexton said he had a question regarding the drive on the west side
and which department would have jurisdiction. Mr. Sexton said he called Greg Hoyes with the Hamilton
County Surveyor’s Office and he said the pipe on the west side is not a regulated drain but the pipe on the
right-of-way is. Ms. Foley said she thought this was regulated and will need to look at this area again.

- Asked if there will be food served at this location. Mr. Sexton said food will be served.

Shirley Hunter – Duke Energy
- Ms. Hunter said this project may have an issue with space. This project will require three-phase service,
and there is not a three-phase transformer in the general area. With the transformer on the northwest corner,
there is not enough space. Duke will require six feet from a non-combustible wall and twelve feet from a

combustible wall. The pad is 8-by-8 feet and she measured the proposed space at about nine feet. Ms.
Hunter said there is no possible way to place a transformer in the northwest corner of the lot, and the only
solution may be to add this next to the road. There will also need to be an AutoCAD file submitted.
Bruce Knott – City of Carmel Fire Department
- There were several details noted by CFD which were missing from the plans. These include construction
type, seating square footage, total square footage, number of stories, hydrant location, fire alarm, sprinkler,
and fire department connection. Mr. Sexton said it seems this is going to fall under the seating capacity that
will require sprinklers but the owner has informed him the seating capacity may be larger. Mr. Sexton will
clarify this soon.

- Letter sent. The department is awaiting an official response. Regarding sidewalk widths, Mr. Sexton
wanted to clarify that the south side of the building is commercial use.
9:55 a.m. Docket No. 13050010 SP: Westmont, Section 2.
The applicant seeks administrative secondary plat approval for 102 lots on 65.6 acres. The site is located at
2000 W. 136th Street. It is zoned PUD/Planned Unit Development (in Westmont PUD). Filed by Cliff White of
M/I Homes.
Brett Huff with Stoeppelwerth and Associates, and Kenny Windler with Ryland Homes presented on behalf of
the petitioner. This developer has decided to build the north section of the Westmont subdivision as one area,
and complete the entrance. There will be 143 lots total in this project.

- Asked when the developer would like to start building infrastructure, such as roads. Mr. Windler said the
developer would like to start as soon as they gain approvals, but it would probably be November at the
earliest.

John Thomas – City of Carmel Engineering Department
- Project is still being reviewed. Mr. Thomas asked if there are any wetland delineation done for this project
due to some of the existing low spots and some of the waterways moving through the site. Mr. Huff said on
the survey, there are two delineated wetlands in section one, both located in a wooded area. Mr. Thomas
said he is aware of these wetlands. Mr. Thomas asked developer to consult with IDEM to see if a wetland
is justified, since there is an existing overflow from the north with a drainage path flowing into a pond.
There have been some issues in the past of this occurring in what IDEM considers a stream, with the
developers having to remove the pond and reopen the stream. Mr. Thomas said the department would like
to prevent this if possible.
Mr. Thomas said a storm water permit will be required, as well as two post-construction BMPs to treat the
water leaving the site. Mr. Thomas said the two wet ponds on site will need to be designed to the
department standards to qualify as BMPs. Mr. Huff said the developer would prefer to not use these ponds
as BMPs due to plantings around the ponds and other reasons.

- Letter is being finalized. Many of the comments are surrounding the improvements to 141st Street. Ms.
Foley asked if commitments to the thoroughfare plan were addressed with the construction of section one.
Mr. Huff said he believes the commitments were addressed for both 136th Street and 141st Street. Mr. Huff
said he is also aware of a 4-foot widening that was done across the frontage of 141st Street. Ms. Foley said
the developer would need to either construct what is required by the thoroughfare plan or provide a

monetary commitment that is equal to the value of design and construction of what is required by the plan.
Ms. Foley said the department will need to verify that this financial commitment was provided if the work
was not completed on section one.
Regarding the widening of 141st Street, the street would need to be widened to a total of width of 24-feet
and this would be measured from the northern pavement edge and this would be across the entire frontage.
In addition to the widening, a 3-foot stone shoulder is required across the entire frontage of the project, not
just the auxiliary lanes. Also, resurfacing the full width pavement across the entire frontage is required
along 141st Street. Ms. Foley said this work would be applied toward their commitment to the thoroughfare
plan.
Ms. Foley said there appear to be direct discharges to the east, from the back of Lots 94 through 112. There
also appear to be direct discharges to the legal drain from lots 48 through 51. Mr. Huff said the east side is
extremely low and is very difficult to bring water back into the site. Mr. Huff said some possible solutions
to this would be sub-surface drains, downspouts, or letting the yards fall off. Ms. Foley said there are also
some questions regarding the legal drain on the north side that is under 141st Street and whether this is
considered a swale.

Shirley Hunter – Duke Energy
- Wanted to clarify the number of lots in this project, since the agenda indicates this is 102 lots. Mr. Huff
said 143 is the total number of lots for the entire project, but this section is 102. Ms. Hunter said since this
project will be both Ryland and M/I Homes, the developer will need to indicate which lots belong to which
builder, since the energy requirements for each builder may be different, and so Duke can size their
transformers accordingly. Ms. Hunter also asked about common area 11, and whether this was dedicated as
a utility easement, as Duke will need to get cables through this area.
Bruce Knott – City of Carmel Fire Department
- Asked if there will be any construction prior to the roads being built in November. Mr. Windler said this
project would be starting in late August or early September. Mr. Knott asked if the roads will be packed
down so fire trucks can access the site prior to wood being brought on site. Mr. Knott reminded the
developers that this is a requirement.

9:45 a.m. Docket No. 13050008 SP: Village of WestClay, Section 10010-E (formerly called Trillium). The applicant
seeks administrative secondary plat approval for 21 residential lots on 17.63 acres, including four Common
Areas. The site is located 2555 W. 131st St. (Main St.) and is zoned S-2/Residence-ROSO. Filed by Matthew
Lohmeyer of Pulte Homes of Indiana, LLC.
Brett Huff with Stoeppelwerth and Associates presented on behalf of the petitioner. This will be the final phase
of Village of West Clay. The project is 21-lots. The project area is in two different locations but it is all
considered one section.

- This project is still being reviewed, but many of these details were covered in the master plan. Mr. Thomas
said there are some water quality issues planned for some sections, but no major issues.

- Letter will be sent soon. The main concerns were the thoroughfare plan commitments, and dedication of
right-of-way from Main Street. The thoroughfare plan requires a 70-foot right-of-way for this area. Ms.
Foley said auxiliary lanes are also required for all public road approaches, which may not be necessary for
126th Street. Ms. Foley said the comprehensive plan shows a pedestrian connection crossing over Main
Street.

Shirley Hunter – Duke Energy
- AutoCAD file will be required. Ms. Hunter said Ron Brewer is the designer for Village of West Clay, and
he will probably run service off of Main Street to serve the north end. Ms. Hunter said the only problem
she noticed was the entrance from 126th Street, where a power pole will need to be moved. Ms. Hunter said
this pole would cost about $30,000 to move, and the cost would be paid by the developer. If the entrance
can be moved, there is a chance the pole could stay at its current location.

- There will need to be a compacted roadway prior to wood being brought on site. This roadway will need to
accommodate the largest CFD vehicles. Mr. Knott said the department has had some problems with
roadways not being compacted on other projects, and in November when the ground is muddy, it could be a
problem if there is a fire on site.

10:05 a.m. Docket No. 13050005 DP/ADLS: Health & Wellness Suites of Carmel.
The applicant seeks site plan and design approval for a skilled nursing and assisted living facility. The site is
located at 12315 Pennsylvania St., north of City Center Dr. It is zoned B-3/Business and not located within an
overlay zone. Filed by Laurie Schultz of Mainstreet Property Group.
Ross Nixon and Rob Bray with American Structurepoint, and Laurie Schultz with Mainstreet presented on
behalf of the petitioner. This project is located just east of Pennsylvania Street and south of Old Meridian
Street. Mr. Nixon said the site is currently an undeveloped, grass parcel. The developer is proposing a new
assisted living and skilled nursing facility on the site, which is 7.8 acres. The existing drive cut off Pennsylvania
Street to the west, also currently serves the business office to the south. There is new utility infrastructure being
installed on the site, with a sanitary sewer extension going to this site, as well as the site to the north. There is a
new detention pond on the east side of the site, which currently outlets to the east, to a regulated drain.
Mr. Bray said the building will be two story, with skilled nursing as the main component on the main level. The
building will also contain many Mainstreet amenities such as dining vignettes, a salon, game and movie theaters,
and an outdoor rehab area. Mr. Bray said rehabilitation is a large component of this project, so there will be
people on site for both short and long stays. Mr. Bray said on the second floor is an assisted living component
which is more of a residential room and board for people staying there long-term. There will be dining facilities
and game rooms on this floor as well.
Ms. Schultz said Mainstreet moved their company offices to Clay Terrace from Cicero in April and the company
is very happy to be in Carmel. Ms. Schultz said this project will be a new flagship project for the company. She
added that this project will be down the street from the company offices, so potential clients can easily see this
project as an example of what Mainstreet can build.

- Stormwater permit will be required, as well as two post-construction BMPs. Mr. Thomas said the plans
show a water quality unit, and a pond for these two BMPs. Mr. Thomas said these would need to be
designed to department BMP standards, including wetland shelf and possibly native banks. Mr. Thomas
said the water quality unit will also need to be sized per Indianapolis treatment rate.

- Comment letter sent. Ms. Foley said one of the department comments was regarding the outlet pipe only
connecting to the swale to the east. This pipe will need to connect to the full drain instead, which is further
south.

- There will be grading changes so some facilities will need to be raised. The developer will also need to
provide load information. Ms. Hunter asked for the location of the Mainstreet project in Westfield. Ms.
Schultz said the entrance road is not completed yet by the Town of Westfield, but the project is across from
the high school. Mr. Bray said the project is just south of the Grand Park project. Ms. Hunter said Duke
would like to see landscaping out of the easements on all sides of the property. Ms. Hunter said there are
buried cables that serve the John Kirk Furniture Store on the north side of the property, and there are also
two buried lines on the west side of the property.
Bruce Knott – City of Carmel Fire Department
- Asked how many elevators will be inside the proposed building. Mr. Nixon said there will be one. Mr.
Knott said the elevator should be large enough to accommodate a cot during an emergency.

- Comments will be sent. The department’s main concern is the vehicular connection going to the east.
Specifically, who will be building it, and when it will be built. Ms. Schultz said Mainstreet is currently in
discussions with their attorneys regarding this issue.
10:15 a.m. Docket No. 13050013 DP/ADLS: West Carmel Commons, Lot 2 - First Merchants Bank. The applicant
seeks site plan and design approval for a new bank building. The site is located at 10210 N. Michigan Road. It is
zoned B-2/Business, and is located within the Michigan Road/US 421 Overlay Zone. Filed by Charlie
Frankenberger and Jon Dobosiewicz of Nelson & Frankenberger on behalf of the applicant, First Merchants
Bank
Jon Dobosiewicz with Nelson & Frankenberger presented on behalf of the petitioner. This project will be a
retail bank branch at the northwest corner of Retail Parkway and Michigan Road. This project will be in front of
the Plan Commission in mid-July, then in front of the Committee of Plan Commission the first week of August,
then back in front of the full Plan Commission in mid-August for the final approval of the plans.

into their plans. Mr. Dobosiewicz asked if this street design has been designed and submitted. Ms. Foley
said these plans are already finalized, but the plans for this specific project will need to be changed to match
these. Ms. Schultz said the day these plans were sent to the printer, the developer had received the Retail
