EXECUTIVE SUMMARY
Ricker Realty & Development, LLC respectfully requests approval of a Development Plan, ADLS
and ModiÀ cations of Development Requirements for the development of a gasoline service sta-
tion, convenience store and restaurant on the southeast corner of 146th Street and River Road.
The proposed project is a part of the Legacy Planned Unit Development adopted by the City of
Carmel City Council on January 22, 2007 (“Legacy PUD”). The Legacy PUD expressly provides
that Gas Station, General Retail Sales and Restaurant with work up and drive thru food sales
are permitted uses for the subject property.
The Applicant is seeking the modiÀ cation of two development requirements of the Legacy PUD.
The Applicant seeks to modify the maximum front yard setback requirement due to site con-
straints and the proposed development being primarily vehicular (not pedestrian) oriented. The
Applicant also seeks to modify the required foundation planting requirements for aesthetic
reasons and to avoid trash collection areas.
The Applicant’s site and architectural plans were developed based on the requirements of the
Legacy PUD, meetings with the Department of Community Sources, and comments received
during the TAC review process (See Tab 6). The Applicant believes the proposed development is
consistent with the property site’s surrounding character and the goals and intent of the Legacy
PUD and City’s Comprehensive Plan.
The proposed development is not located within the City of Carmel wellhead protection area.
The proposed development is located within the one (1) year time-of-travel wellhead protec-
tion area of Citizens Energy Group due to several wellheads being located to the north of the
proposed project after the effective date of the Legacy PUD. The City of Carmel Code and
Indiana Administrative Code set forth the legal requirements for locating underground storage
tanks in a one (1) year time-of-travel wellhead protection area (See Tab 10). The proposed
development meets or exceeds all local and State requirements for locating underground stor-
age tanks in a one (1) year time-of-travel wellhead protection area (See Tab 8).
In summary, the Applicant believes the requested modiÀ cations are consistent with the intent
and purpose of the Legacy PUD and the proposed development meets all other legal require-
ments for Development Plan and ADLS approval (See Tab 11).
