Hahn & Associates Petitioner seeks the following development standards variance approval: Docket No. 05030027 V Chapter 27.03.02 curbed parking The site is located at the 2850 E 96th 8t and is zoned 8-2/Residence. Filed by Mark Monroe of Wooden & McLaughlin. General Info: In 1993, the BZA Board granted approval for this residential property to be used as an engineering consulting and surveying facility. Now, the business would like to add a paved parking lot located in the rear of the property, but is seeking a variance to forego curbing of that parking area. Analysis: The granting of non-curbing parking for this property will allow it to maintain its residential character. The Urban Forester has written that no curbing will be a better choice for drainage in this area. However, since this parking area will be asphalt and not gravel, there is an issue of impervious surface increase on the site, and whether adding additional landscaping can help deter the negative impact of this. The petitioner should work with the Urban Forester in providing a landscape plan. Findings of Fact: uncurbed parking 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: uncurbed parking will maintain the residential character of the property and will aid in drainage/infiltration better than a curbed parking area. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: uncurbed parking will maintain the residential character of the property and will aid in drainage/infiltration better than a curbed parking area. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The petitioner will have to provide curbed parking and subsurface drainage, which is not the optimum option for this residential-zoned property. Recommendation: The Department recommends positive consideration of Docket No. 05030027 V with the installation of landscaping suggested by the Urban Forester.
