Foster's Addition, Lot 6pt: Payless Liquors Petitioner seeks the following development standards variance approval: Docket No. 05050026 V ZO Chapter 25.07.02-08.b number of signs The site is located 445 S Rangeline Rd and is zoned B-2/Business within the Carmel Dr - Rangeline Rd Overlay. Filed by Charles Key of Payless Liquors, Inc. General Info: The petitioner seeks approval to have three wall signs when the site only has two frontages. The total square footage of the three signs will not exceed the total square footage allowed for the entire site. The Plan Commission Special Studies Committee approved the design and location of the signs at the April 19, 2005 meeting. Analysis: The ordinance states that only one sign is allowed per frontage. This site has two frontages, and the petitioner would like to have three signs. Findings of Fact: 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the site has two frontages, allowing 2 signs. The third sign states the categories of items the owner has for sale and is a much smaller sign. The total sign area does not exceed the total allowed square footage for the site. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the site has two frontages, allowing 2 signs. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The business will not be able to adequately inform potential patrons of the items they have for sale in the store. Only allowing the two "Payless" signs may create questioning as to what exactly is sold in the store. Recommendation: The Department recommends positive consideration of Docket No. 05050026 V.
