Dear Dr. Dhadialla:
At the meeting held Monday, June 27, 2005, Carmel Advisory Board of Zoning Appeals Hearing Officer took the following
action regarding the Special Use Amendment (SUA) and Developmental Standards Variance (V) filed by you for the property
located at 2150 W. 96th Street.
APPROVED: Docket No. 05050058 SUA, Special Use Amendment for expansion of Special Use.
APPROVED: Docket No. 05050059 V, Development Standards Variance for over 35% lot coverage, contingent upon:
1. The right-of-way being consistent with the Hamilton County Highway Department Thoroughfare Plan
and dedication of property if.necessary.
2. The landscaping plan meeting the Urban Forester's approval.
Please be advised that per Section 21.02.07: Time Limit of the Zoning Ordinance, any person to whom a Special Use or
Special Exception is granted by the Board, under the procedures set forth in this chapter, shall have commenced continuous
construction of said Special Use or. Special. Exception or implemented said Special Use or Special Exception within one
year of the date of the granting of the approval or said approval shall become null and void. The expiration date of the
approval is June 27, 2006.
Please be advised that per Section 30.05.05: Time Limit of the Zoning Ordinance, the aforementioned Development
Standards Variance approval is valid for one (1) year. By that time, either continuous construction of the improvements
must be underway, or a written request for a one-time, six-month extension of the approval must have been received and
approval granted by this Department. The expiration date of the approval is June 27, 2006.
When applying for applications for permits regarding the improvements contained within this approval, please
include a copy of this letter with your application materials in order to assist the Department's review.
