The applicant seeks the following development standards variance:
Docket No. 05060028 V ZO Chapter 23D.03.A.l.b(iii) 5-ft side yard setback
The site is located at 110 N Range Line Rd and is zoned B-l/Business within the Old Town- Range Line
Rd Sub-area. Filed by Dr. Poer.

Analysis:
The storage shed will
house lawn care
equipment and hide it
from view. The shed
will complement the
existing primary
structure. It is located
out of the way of the
Findings of Fact: side yard setback
1.) The approval of this variance will nf)t be injurious to the public health, safety, morals,
and general welfare of the community because: the shed is located behind the front building
line, within the side yard. The character of Old Town is derived partly from its density and
closeness of structures to create unique spaces.
2.) The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: the shed is located behind the front
building line, within the side yard. The character of Old Town is derived partly from its density
and closeness of structures to create unique spaces.
3.) The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
The petitioner will have to move the shed to an alternate location on the lot, which may not
complement the site and interfere with the parking area.
Recommendation:
The Department recommends positive consideration of Docket No. 05060028 V.
