Below is the previous correspondence regarding requirements of the two properties on 2nd Avenue NE, both previously
owned by Brenda Chamness. We received none of the information requested back in January from either you or Ms.
Chamness.
In addition to the below email, if the property owner is proposing to pave the alley (which it sounds like they have already
started without any permits or approvals), then the Engineering Department needs to understand if the pavement will be a
public improvement (since it is within public right-of-way) or remain a private improvement within the public right-of-
way.
If the pavement will be public:
All improvements within the alley right-of-way shall be bonded.
If the pavement will remain private:
A variance of City Code, allowing a private improvement within public right-of-way, needs to be sought from the
Board of Public Works and Safety (through the Engineering Department).
A Consent to Encroach agreement is required for the private improvement.
It will be the owner’s responsibility to maintain the pavement.
The improvement will be available for public use.
In both cases, the City needs to review the proposed pavement cross section to ensure it meets the City’s requirements and
a grading plan for the alley. Also, a Right-of-way Permit is required for work within the right-of-way. It was my
previous understanding that the contractor had only obtained a Right-of-way Permit for the demolition of the existing
(now previous) home. This Right-of-way Permit did not include the construction of a new home or any improvements
within the right-of-way. Improvements within the alley will require inspections by Engineering Department staff. The
City’s Right-of-Way Manager, Fred Glaser, has indicated to Delello that no further work within the alley progress until
approvals have been issued from our department.
Please keep in mind, a property owner cannot alter the grading of their property to result in negative impact to an adjacent
property. Grading on these lots (or within the alley) cannot cause a drainage problem on another property. This is a
concern given the amount of impervious surface proposed for these two lots compared to the previous use of these two
lots.
The conditions on site presently represent numerous violations of City Code. We need this project brought back into
compliance immediately or we will consider appropriate enforcement action.

I have reviewed the information you submitted, and have the following comments related to Engineering Department
standards:
1. Please submit an existing conditions survey and a grading and drainage plan in order for the Department to ensure
drainage is being maintained in this area and that no negative impacts to other properties will occur as a result of
the planned improvements on this lot(s).
2. Is grading planned for Lot 26 as a part of this project? The Department has concerns regarding the grading along
the south property line on Lot 26.
3. Please include the limits of the existing easements and utilities on the property.
4. Please submit details for the alley improvements, including, but not limited to: extent of the pavement (will it tie
into the paved portion of the alley to the north?), dimensions (width), grade, and pavement specifications. There
are additional drainage concerns regarding grading in the alley.
5. Board of Public Works and Safety approval is required for the new curb cut request for the proposed driveway
from the alley.
6. Will the existing driveway on Lot 26 be abandoned? If so, Board of Public Works and Safety approval is required
for the removal of the existing driveway.
7. Procedures for the removal of the existing driveway shall follow the City of Carmel Property Maintenance Code
Section 6-227 (h) (10), including, but not limited to:
a. The existing driveway shall be completely removed within the limits of the right-of-way.
b. The roadside drainage shall be restored.
c. Within the City’s right-of-way, backfill and topdress with 6” of topsoil to level the disturbed area with the
adjacent undisturbed areas and right-of-way.
d. Install sod within the right-of-way limits.
8. City standard curb and sidewalk shall be constructed along the property frontage where the existing driveway is
removed. Please include all applicable City standard details and the City’s Curbing Policy in the plans.
9. A Right-of-Way Permit is required for all work within the City’s right-of-way, contact Fred Glaser, Right-of-Way
Inspector, 571-2677.
10. All improvements within the right-of-way are required to be bonded. Please contact Dave Barnes,
dbarnes@carmel.in.gov or 571-2441, regarding performance bond requirements.
11. Before any work within the right-of-way commences, please schedule a preconstruction meeting with the
Engineering Department.
12. Please work with John Thomas, Stormwater Administrator jthomas@carmel.in.gov, regarding the erosion and
sediment control requirements.
