STAFF COMMENTS/RECOMMENDATION:
This project appeared before the Board and received approval in April of 1988. Since
that time, the subject property has changed ownership and has never fulfilled the
commitments and conditions of the initial approval. Mr. Rich is requesting to make
some changes from what was originally approved and allow as it presently exist.
Attached is a summary of the outstanding items and issues, put together by David
Cunningham of DOCD.

CARMEL SQUARE CENTER OUTSTANDING ITEMS AND COMMITMENTS

Pursuant to the previously approved plans dated April 18, 1988, the following
items have not been installed at the above referenced site;

MECHANICAL EQUIPMENT SCREENING
- Pursuant to the Technical Advisory Committee Minutes, Commitments made at the
BZA meeting (see attached Minutes), and Detail sheet in the information packet supplied
by the developer - the mechanical equipment on the roof of the building was to be painted
to match the roofing materials and to be completely screened from public view.
SIDEWALK BETWEEN PROPOSED BUILDING AND CARMEL CIVIC SQUARE
- Pursuant to the site plans filed with this project two sidewalks were to be installed
connecting the facility to the Carmel Civic Square - these sidewalks were to be located
on the west and northwest corner of the subject parcel - since the completion of the
Carmel Civic Square - the sidewalk to the northwest would not be able to be constructed
due to elevation changes between the two properties, but the sidewalk directly to the west
of property should be installed at this time.
SIGNAGE
- Currently previous tenant signage still exists on the building - this signage needs to be
removed - additionally the sign located on the east side of the building will require Board
of Public Works approval to be located within the Right-of-way of Rangeline Road -
permits need to be obtained for signage

bound) form the entrance onto Rangeline Road

Mr. Brandau
In response to your phone conversation of April 8, 1988 with Greg
Gammons and a subsequent phone conversation with me on April 11 ,
1988 the following is- a status of the items in question.
1 . Right of way of 50 feet (one-half) on Range Line Road and ZO
feet (one half ) on Gradle Drive verified with Tom Welch , City
Engineer.
2. One handicapped parking space added in northeast parking lot
next to sidewalk entrance to balcony.
Z. Drive way widths of 24 feet , 26 feet , 29 feet and _,1 feet
coupled with parking space depths of a true 20 feet will allow
for the largest of delivery trucks to maneuver in and out of the
site.
4. North entrance to parking lot off of Range Line Road has
been made right turn only for exiting vehicles. A high
percentage of North bound traffic will enter either by the South
Range Line Road entrance or the Gradle Drive entrance. It is
estimated that South Bound Range Line Road traffic will use the
three entrances equally. Traffic exiting to go North will mainly
use the Gradle Drive exit , depending upon the time of day.
5. Due to the design used in trash trucks and dumpsters a
covered trash enclosure would be difficult and costly to
construct. I will though investigate the veasibility of such a
design.
6. Surrounding zoning and uses is snown on the Site plan.
7. Back of the project for each HZA member and 2 for your Dept.
will be provided. Any changes made in the project will be
updated in the book.
8. Variance will be applied for on location of Range Line Road
sign by Dave Coots.

9. Mechanical units on roof will be screened by 42" high
railing and placed so as to be screened from view. The units are
7 foot square and .3 ' 9" high and will be painted slate grey to
blend with the roofing material .
10. The average height of the building to the mid-point of the
roof is less than G5 feet. The maximum height to the mid-point
of the main roof is 33 feet 6 inches. I will have Dave Coots
address this issue with your dept.
11 . Additional and taller evergreens have been added to
perimeter at parking lot. Spreading yews have been added and the
firebushes eliminated.
12. Light fixtures will be compatible with the City fixtures.
Catalog cuts are included in the book.
13. Ground spot lights are landscaped on new plan.
14. Conversed with Randy Powell today and he had not reviewed
project as of 4/ 11/88. I ' am waiting on his review before making
any suggested changes to the drainage and grading plan.
15. Signage will be of Roman type lettering of cast aluminum
with a gold finish. Maximum letter height will be 18" and
maximum sign area per tenant sign will be 30 square feet as per
sign ordinance. Tenant signage will be submitted for approval as
each tenant space is leased. A catalog cut is included in the
book.

Mr. Kett questioned fire hydrant coverage. TAC recommended addition.l
fire hydrant. Hoses from other fire hydrants have to cross the road in case
of
fir=.
Height of building was determined by highest point of roof line.
Mrs. Badger questioned since there was double stairway going to
balcony level on North elevation . how much sidewalk is there between curbs
and stairways.
Mr. Coots said there is 5 ' clear pathway on North side of stairway
( 14 ' on other side) .
There was further discussion regarding signage by the board members.
Public hearing was closed at 8: 50 P. M.
Mr. Thompson moved to approved Docket No. S 76-88 subject to staff
recommendations.
Mr. Davis seconded.
Findings of fact were completed by board members.
Approved 4-0.

Standards Variance Application for Carmel Square Center located at
1070 S. Rangeline Road , Carmel . Petitioner is requesting three
variances from the Carmel /Clay Zoning Ordinance. 1 ) Section 14. 7. 1 of
the B-- zone maximum height allowed is 75 feet , petitioner request 77
feet 2 inches , 2) Section 25. 7. 02 of the sign ordinance that does not
allow tenant sic;ns for horizontal building types , 7) Section 25. 704- t
of the sign ordinance that requires a 10 ' setback from right-of-way
for center identification signs , petitioner request to locate sign
within the city ri -"- * -of-way. Parcel is zoned B-'.

12a. 7: 00 P. M. , Public Hearing on Docket No. V 42-88 Developmental
Standards Variance Application for George Gratovich located at 4972
Limberlost Trace , Carmel . Petitioner is requesting a variance from
Sections 5. 3. 2 and 25. 2. 2 of the Carmel /Clay Zoning Ordinance.
Petitioner request to allow an existing encroachment of a deck within
the required 10 ' setback line , and to allow an existing 8 ' fence in
lieu of the maximum 6 ' by ordinance. Petitioner did appear before
this board to request this same encroachment and was denied , with the
condition that the pool not be finished but only secured for safety
purposes. (See previous minutes of BZA meeting. ) Parcel is zoned S-1 .

Petitioner requested to be tabled for one month.
Mrs. Badger recommend the staff direct the attorney to file an
immediate injunction against this property owner to clear uo a zoning
violation which has gone on for a 2 year period of time.
Mr. Davis seconded.
Mr. Kiphart stated they had been to court and now is brought back
before the new BZA board.
Drainage improvements have not been done.
Pool has been opened , Spa has been opened and a large and substantial
fence has been built.
Mr . Byers stated petitioner contacted the Department this afternoon
and does have a right to a one month continuance. If there is a second
continuance board can dismiss . based on dismissal petitioner could not come
back before the board for a period of time.
Mr. Byers discussed legal situation on this petitioner.
Suggestion was for Mrs. Badger to restate her motion .
Mrs. Badger withdrew her motion , Mr. Davis withdrew his second.
Mr. Davis moved to table Docket No. V 42-BS.
Mr. Thompson seconded .
Motion carried.
6a. 7: 00 P. M. . Public Hearing on Docket No. V 76-88 Special Use
Application for Carmel Square Corporation to construct the Carmel
Square Centre located at 1030 S. Rangeline Road , Carmel . Petitioner
is requesting special use approval to allow an addition to an existing
structure. The proposed structure will be 28. 713 square feet
consisting of 3 levels, on a 1 . 74 acre parcel . Parcel is zoned 3-3.

Mrs. Badger moved that Docket V 44- 8 be approved with the following
commitments being noted by the petitioner , sianage on North and West
elevation to be determined from Gradle Drive and signage on East and South
elevation to be determined from Rance Line Road . also the petitioner has
committed no signaae on 7rd floor level and the identification sign does not
exceed 5 ' in height maximum and also that if the enclosed screen fencing for
the roof unit does not entirely screen the mechanical equipment on the roof
that they will redo it so it is totally screened.

8g. 7:00 P. M. Public Hearing on Docket NO. V 77-88 Developmental
Standards Variance Application for Indiana National Bank . The
proposed structure requires Plan Commission ADLS approval and is
requesting a variance from this board this evening. The - variance
is from Section 27. 2 of the Carmel /Clay Zoning Ordinance that
requires a 120 " front yard setback from Keystone (471 ) . Project
has been tabled at petitioners request . Parcel is zoned 8-8.

9g. 7: 00 P. M. ., Public Hearing an Docket No. S 38-88 Special Use
Application and V 79-89 Developmental Standards Application for
Carmel Baptist Church located at 2240 E. 106th St. . Carmel .
Petitioner is requesting special use approval to add 7760 square
feet to an existing special use that was approved May of 1981 .
The east portion of the parcel is covered by the Keystone (471 )
overlay :one , therefore Plan Commission approval will be required
before the proposed future parking area may be established.
Petitioner is also requesting a 2 year variance from Section 30. 4
requiring paved and curbed parking areas. The petitioner will
install a 2" binder immediately , but would like two years to
install the final surface and curbs.

This project appeared before the Board and received approval in April of 1988. Since
that time, the subject property has changed ownership and has never fulfilled the
commitments and conditions of the initial approval. Mr. Rich is requesting to make
some changes from what was originally approved and allow as it presently exist.
Attached is a summary of the outstanding items and issues, put together by David

MECHANICAL EQUIPMENT SCREENING
- Pursuant to the Technical Advisory Committee Minutes, Commitments made at the
BZA meeting (see attached Minutes), and Detail sheet in the information packet supplied
by the developer - the mechanical equipment on the roof of the building was to be painted
to match the roofing materials and to be completely screened from public view.
SIDEWALK BETWEEN PROPOSED BUILDING AND CARMEL CIVIC SQUARE
- Pursuant to the site plans filed with this project two sidewalks were to be installed
connecting the facility to the Carmel Civic Square - these sidewalks were to be located
on the west and northwest corner of the subject parcel - since the completion of the
Carmel Civic Square - the sidewalk to the northwest would not be able to be constructed
due to elevation changes between the two properties, but the sidewalk directly to the west
of property should be installed at this time.
SIGNAGE
- Currently previous tenant signage still exists on the building - this signage needs to be
removed - additionally the sign located on the east side of the building will require Board
of Public Works approval to be located within the Right-of-way of Rangeline Road -
permits need to be obtained for signage

- A right turn only sign was committed to by the developer to eliminate left turns (north-
bound) form the entrance onto Rangeline Road

Docket No. 40-88 ADLS (Amend) , an Amended Architectural, Design,
Lighting, and Signage for the Fidelity 3 Building located on the S.W.
corner of 116th and U.S.31. Site is zoned 3-6 and is located in the
U.S.3I Overlay Zone. Petitioner requests for approval of additional
landscaping around the Fidelity 3 building.

In response to your phone conversation of April 8 , 1988 with Greg
Gammons and a subsequent phone conversation with me on April il ,
1988 the following is- a status of the items in question.
1 . Right of way of 50 feet (cne-half) on Range Line Road and C0
feet -(one half ) on Gradle Drive verified with Tom Weich , City
Engineer.
2. One handicapped parking space added in northeast parking lot
next to sidewalk entrance to balcony.
Z. Drive way widths of 24 feet , 26 feet , 29 feet and :1 feet
coupled with parking space depths of a true 20 feet will allow
for the largest of delivery trucks to maneuver in and out of the
site.
4. North entrance to parking tot off of Range Line Road has
been mace rignt turn only for exiting vehicles. A high
percentage of North bound traffic will enter either oy the South
Range Line Road entrance or the Gradle Drive entrance. It is
estimated that South sound Range Line Road traffic will use the
three entrances equally. Traffic exiting to go Nar_h will mainly
use the Gradle Drive exit , depending upon the time of day.
S. Due to the design used in trasn trucks and dumosters a
covered trash enclosure would be difficult and costly to
construct. I will tncugh investigate the veasibility of such a
design .

10. The average height of the building to the mid-paint of the
roof is less than 35 feet. The maximum height to the mid-point
a+ the main roof is :13 feet a inches. I will have Dave Coats
address this issue with your dept.
11 . Additional and taller evergreens have been added to
perimeter of parking lot. Spreading yews have been added and the
firebushes eliminated.
12. Light fixtures will be compatible with the City fixtures.
Catalog cuts are included in the book.
13. Ground spot lights are landscaped on new plan.
14. Conversed with Randy Powell today and he had not reviewed
project as of 4/ 11/88. I ' am waiting on his review before making
any suggested changes to the drainage and grading plan.
15. Signage will be of Roman type lettering of cast aluminum
with a gold finish. Maximum letter height will be 18" and
maximum sign area per tenant sign will be 30 square feet as per
sign ordinance. Tenant signage will be submitted for approval as
each tenant space is leased. A catalog cut is included in the
bock.

Standards Variance Application for George Gratovich located at 4972
Limberlost Trace , Carmel . Petitioner is requesting a variance from
Sections 5. 3. 2 and 25. 2. 2 of the Carmel /Clay Zoning Ordinance.
Petitioner request to allow an existing encroachment of a deck within
the required 107 ' setback line , and to allow an existing 8 ' fence in
lieu of the maximum 6 ' by ordinance. Petitioner did aooear before
this board to request this same encroachment and was denied . with the
Condition that the pool not be finished but only secured for safety
purooses. (See previous minutes of BZA meeting. ) Parcel is zoned S-i .

Dear Mr. Rich:
After reviewing the above referenced applications I have the following comments:
-Question number six (6), for both applications, needs to be completed, a legal description
was not provided.
-Questions numbered seven (7), eight (8), nine (9), ten (10), and thirteen (13) on the special
use application need to be answered.
-Question number seven (7) on the sign variance application needs to identify the section(s) of
the Carmel/Clay ZoningiSign Ordinance from which variance(s) are being requested.
-Questions numbered nine (9), ten (10), eleven (11), and fourteen (14) on the sign variance
application need to be answered.
-Two (2) copies of both "Notice of Public Hearing" sheets need to be completed and
provided.
-Two (2) copies of both application's "Findings of Facts" (question sheet) need to be
completed and submitted.
-Two (2) copies of some type of plan or statement needs to be formulated explaining what
you want or changed from the previously approved special use and variances is needed for
each applicaiton.
-Filing fee needs to be paid, 5250.00 for the special use, and $50.00 per sign per section of
the code being varied.
-Need to submit to this office at least ten days prior to hearing (the mailing to the Board
members, including agenda, staff report, and below packets, will be mailed on the 15th,
therefore your packets need to be to us by that date) the following:

-proof of publication (certifications from both newspapers)
-the stamped white receipts from your adjacent property owners notification

findings of facts (question sheet), statement of requested special use (question # 7),
supporting statement (question # 8), location map, site plans, elevations, and any other
information to assist the Board in understanding the requested special use.
-For yours, the Board's and the public's conveniens, an overhead transparency projector and
laser pointer will be available the night of the hearing, and we would appreciate it if
arrangement are made to use these visual aids provided.

This project appeared before the Board and received approval in April of 1988. Since
that time, the subject property has changed ownership and has never fulfilled the
commitments and conditions of the initial approval. Mr. Rich is requesting to make
some changes from what was originally approved and allow as it presently exist.
Attached is a summary of the outstanding items and issues, put together by David
Cunningham of DOCD.
