please-be advised that the .Carmel-Clay Board of Zoning Appeals at
heit.August. 23, 1982. meeting d'i'd approve the Special Use application
for Carmel Datsun and Dan Young Honda to be located on. 96th Street.
The Board will need to approve ,specific signs for each of these two
automobile dealerships at a later date, but prior to the issuance
of a Building'Permit by the Department of Combuhity Development.

FINDINGS OF FACT - SPECIAL USE EXCEPTIONS /
1 . The Special Use in Flood Plain District , Ordinance 2160 ,
Section 21 . 6 as amended (x (does not) apply and all
- prerequisites have been met by Petitioner as verified by :
2 . The Special Use Exception will be consistent with the
Character and Permitted Land Use of the zoning district and
Carmel-Clay Comprehensive Plan because :
The proposed use (office ' buildings) is in accordance
with the property 's zoning, B-3 .
3 . The Special Use is physically suitable for the land in
question because :
There are no special land characteristics needed for the use •
and the existing land size and the proposed use are compatible .
4 . The Special Use will not injuriously or adversely affect the
adjacent land or property values because :
The use is (1) less .intense than or (2) similar to the uses
on the adjacent land.
5 . The Special Use will not adversely affect vehicular or
pedestrian traffic flow, nor the adequancy availability of
water sewage , or storm drain facilities , or police or fire
protection because :
The use is -not large enough to have an appreciable adverse
affect on any utilities . Sanitary sewer and drainage facilities
are available .
6 . The Board has reviewed the requirements of Ordinance 2160 ,
Section 21 . 3 (1-25) as they relate to this Special Use , and
does not find those criteria prevent the granting of the
Exception :
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning
Appeals that Variance Docket No. j' -22 -ka. is )
granted , subject to any conditions stated in the minutes of this
Board , which are incorporated herein by reference and made a part
hezeof .
