Dear Kent:
Pursuant our recent meeting and discussions,please find enclosed the mitigation plan for the above
referenced site.The proposed plan details mitigation for proposed impacts that will take place within
the floodway of Carmel Creek. The impacts will include the clearing of trees and recontouring the
existing elevations. The impacts are necessary to allow suitable play for Fairways 11 through 15 of
the Woodland Country Club Golf Course.
As discussed, the construction activities will be conducted in two phases. Phase I construction
activities will commence once the Indiana Department of Natural Resources (IDNR)has issued a
Construction in a Floodway Permit. Phase II activities aze projected to take place within the next
five years. Phase I mitigation activities will include the planting of 390 shrubs(approximately 3 to 4
feet in height) within 1.30 acres that will be cleared for Fairways 11 through 14 and portions of
Fairway 15; the planting of 900 trees (approximately 3 to 4 feet in height) in 3.0 acres that will be
adjacent to the creek corridor;and the installation of various native herbaceous species within a 0.1
acre littoral shelf of an existing shallow pond.
Phase II mitigation activities will include the planting of 33 shrubs (approximately 3 to 4 feet in
height) within 0.11 acres that will be cleared for Fairway 15. Total proposed impact acreage for
Phase I and II within the floodway af the project site is 3.Q acres. Tatal proposed mitigation acreage
for Phase I and II includes 3.0 acres of extended corridor tree/shrub plantings, 1.41 acres of shrub
planting within the corridor and 0.1 acres of herbaceous wetland planting.

( 11) all replacement habitat areas must be protected in perpetuity by a conservation
easement; within 90 days of project initiation the applicant must grant a legal
conservation easement which protects all habitat replacement areas in perpetuity from
disturbance; the development of the easement must be coordinated with the
environmental biologist and a DNR attorney
( 12) a report must be submitted to the Environmental Biologist at the Division of Fish and
Wildlife, 3900 Soldiers Home Road, West Lafayette, IN 47906 by December 31 of each
year to monitor the initiation, progress, and success of the mitigation site; the report will
include appropriate photographs of all replacement habitat areas; a narrative will
describe the activity accomplished to date, acres seeded, number of trees and shrubs
planted, and the progress of other requirements of the mitigation plan; reports will be
submitted each year, even if work has not been initiated on the site, and continue to be
submitted for a maximum of three years after work initiation, or until the mitigation site is
complete and determined to be successful; if three years after work initiation the site is
not determined to be successful, the permit will be considered to be in violation and
another plan will be submitted for approval
( 13) except for the material used as fill as shown on the above referenced project plans on
file at the Division of Water, place all excavated material landward of the floodway *
( 14) do not leave felled trees, brush, or other debris in the floodway �
( 15) the outfall structures and riprap placed for bank stabilization must conform to the bank
( 16) anchor the bridge decks to prevent dislodging and/or flotation during high water events
( 17) remove all construction debris, including the temporary construction crossing from the
floodway * upon completion of the project
( 18) keep the bridge waterway openings free of debris and sediment at all times
( 19) ' NOTE: for regulatory purposes, the floodway is defined as that shown on Panel 13 of

PERMIT VALIDITY : This permit is valid for 24 months from the"Approved On"date shown on the first page.
If work has not been initiated by December 13, 2002 the permit will become void and a
new permit will be required in order to continue work on the project.
This permit becomes effective 18 days after the"MAILED" date shown on the first page.
If both a petition for review and a petition for a stay of effectiveness are filed before this
permit becomes effective, any part of the permit that is within the scope of the petition for
stay is stayed for an additional 15 days.
CONFORMANCE : Other than those measures necessary to satisfy the"General Conditions" and "Special
Conditions", the project must conform to the information received by the Department of
Natural Resources on: February 22, 2000, March 23, 2000, October 27, 2000, November
30, 2000 and December 7, 2000. Any deviation from the information must receive the
prior vvritten approval of the�e�artment.
Number Special Condition
( 1) revegetate all bare and disturbed areas with a mixture of grasses (excluding all varieties
of tall fescue), legumes, and native shrub and hardwood tree species as soon as
possible upon completion
(2) minimize and contain within the project limits inchannel disturbance and the clearing of
trees and brush
( 3) do not work in the waterway from April 1 through June 30 without the prior written
approval of the Division of Fish and Wldlife
(4) do not cut any trees suitable for Indiana bat roosting (greater than 14 inches in diameter,
living or dead, with loose hanging bark)from April 15 through September 15
( 5) appropriately designed measures for controfling erosion and sediment must,be
implemented to prevent sediment from entering the stream or leaving the construction
site: maintain these measures until construction is complete and all disturbed areas are
stabilized
(6) seed and protect all disturbed streambanks and slopes that are 3:1 or steeper with
erosion control blankets (follow manufacturer's recommendations for selection and
installation} ar use an appropriate structural armament: seed and apply mulch on all
other disturbed areas
( 7) implement the mitigation plan described in and submitted with the agent's October 17,
2000 letter and October 24, 2000 MEMO to Kent Hanauer(see attachments)
( 8) all trees and shrubs must be 1 to 3 gallon container stock(not bare root stock) unless
otherwise approved in writing by the Environmental Biologist
( 9) the habitat replacement areas must have a minimum 70% survival of planted trees and
shrubs after 3 growing seasons
( 10) replacement habitat must be installed no later than the winter dormancy period following
the impact to the existing habitat

DESCRIPTION : An existing 18-hole golf course is to be redesigned to include new holes on both
sides of Carmel Creek. Activities within the floodway include: 1)the construction
of two cart path crossings and one footbridge; the cart path crossings will span
the stream between the top of the banks; the footbridge will be perched, 2) the
regrading of the natural contours for the construction of greens, tees, traps, and
fairways, 3) the placement of two stormwater outfall structures at separate
locations along the streambank, 4) the construction of a temporary stream
crossing for equipment access, and 5) miscellaneous construction activities
including the removal of trees for the construction of fairways and the placement
of geotextile mats and sod for sediment control and stabilization. Details of the
project are contained in plans and infomation received at the Division of Water on
February 22, 2000, March 23, 2000, October 27, 2000, November 30, 2000, and
December 7, 2000.

Dear Brian:
I have reviewed the proposed plans and have the following comments:
1. I believe we need to meet and discuss the proposed erosion control plan. Knowing how
much of the area is going to be disturbed and the volume of sediment trap you have designed
will answer some of my questions. I will expect 1800 cu ft/acre of sediment storage. Is your
specification about temporary seeding realistic? I have been involved with several golf
courses and no one wants to temporary seed.
2. The 12" discharge pipe from pond #2 is below the current grade of the land. What are the
current and proposed conditions of the drainageway south of this discharge point? I believe
improvements will need to be made across the private property because of the significant
changes to the watershed.
3. Drainage Concept, point #3, in the submitted material discusses the offsite drainage facilities
through Woodland Country Club subdivision. A grass waterway exists north of 110°i street
and the last time I was there a single pipe crossing. I think we need to look closely at how the
drainage improvements will impact downstream landowners. The increased hard surface, soil
compaction and improved drainage system is going to significantly change the runoff
quantities and duration.
4. Existing wetlands should be noted on the plans.

and are being reviewed by the DistricYs engineering consultant.
SADDLE CREEK SECTIONS 7-10
Plans have been reviewed by the District's engineering consultant and revisions will be required before they can be
submitted for IDEM construction permits.
WOODLAND COUNTRY CLUB
Pending acceptance by Carmel Utilities, the District has transferred sanitary sewer jursidiction to Carmel for portions of
the Club property. However, no plans for the golf course expansion have been submitted for District review. These
should be submitted as soon as possible.
UNIVERSITY HIGH SCHOOL
Plans need to be submitted to the District's engineering consultants, Samuel L. Moore &Associates, in order to
determine how this site can be served by sanitary sewers.

DESCRIPTION : An existing 18-hole golf course is to be redesigned to include new holes on both
sides of Carmel Creek. Activities within the floodway include: 1)the construction
of two cart path crossings and one footbridge; the cart path crossings will span
the stream between the top of the banks; the footbridge will be perched, 2) the
regrading of the natural contours for the construction of greens, tees, traps, and
fairways, 3) the placement of two stormwater outfall structures at separate
locations along the streambank, 4) the construction of a temporary stream
crossing for equipment access, and 5) miscellaneous construction activities
including the removal of trees for the construction of fairways and the placement
of geotextile mats and sod for sediment control and stabilization. Details of the
project are contained in plans and infomation received at the Division of Water on
February 22, 2000, March 23, 2000, October 27, 2000, November 30, 2000, and
December 7, 2000.

PERMIT VALIDITY : This permit is valid for 24 months from the"Approved On"date shown on the first page.
If work has not been initiated by December 13, 2002 the permit will become void and a
new permit will be required in order to continue work on the project.
This permit becomes effective 18 days after the"MAILED"date shown on the first page.
If both a petition for review and a petition for a stay of effectiveness are filed before this
permit becomes effective, any part of the permit that is within the scope of the petition for
stay is stayed for an additional 15 days.
CONFORMANCE : Other than those measures necessary to satisfy the"General Conditions" and "Speciai
Conditions", the project must conform to the information received by the Department of
Natural Resources on: February 22, 2000, March 23, 2000, October 27, 2000, November
30, 2000 and December 7, 2000. Any deviation from the information must receive the
prior written appraval of the Department.

of tall fescue), legumes, and native shrub and hardwood tree species as soon as

( 3) do not work in the waterway from April 1 through June 30 without the prior written
approval of the Division of Fish and Wldlife
(4) do not cut any trees suitable for Indiana bat roosting (greater than 14 inches in diameter,
living or dead, with loose hanging bark)from April 15 through September 15
(5) appropriately designed measures for controlling erosion and sediment must,be
implemented to prevent sediment from entering the stream or leaving the construction
site: maintain these measures until construction is complete and all disturbed areas are
stabilized
(6) seed and protect all disturbed streambanks and slopes that are 3:1 or steeper with
erosion control blankets(follow manufacturer's recommendations for selection and
installation) or use an appropriate structural armament: s2ed and apply mulch on a!I
other disturbed areas
(7) implement the mitigation plan described in and submitted with the agent's October 17,
2000 letter and October 24, 2000 MEMO to Kent Hanauer(see attachments)
(8) all trees and shrubs must be 1 to 3 gallon container stock(not bare root stock) unless
othe►wise approved in writing by the Environmental Biologist
(9) the habitat replacement areas must have a minimum 70% survival of planted trees and
shrubs after 3 growing seasons
( 10) replacement habitat must be installed no later than the winter dormancy period following
the impact to the existing habitat

( 11) all replacement habitat areas must be protected in perpetuity by a conservation
easement; within 90 days of project initiation the applicant must grant a legal
conservation easement which protects all habitat replacement areas in perpetuity from
disturbance; the development of the easement must be coordinated with the
environmental biologist and a DNR attorney
( 12) a report must be submitted to the Environmental Biologist at the Division of Fish and
Wildlife, 3900 Soldiers Home Road, West Lafayette, IN 47906 by December 31 of each
year to monitor the initiation, progress, and success of the mitigation site; the report will
include appropriate photographs of all replacement habitat areas; a narrative will
describe the activity accomplished to date, acres seeded, number of trees and shrubs
planted, and the progress of other requirements of the mitigation plan; reports will be
submitted each year, even if work has not been initiated on the site, and continue to be
submitted for a maximum of three years after work initiation, or until the mitigation site is
complete and determined to be successful; if three years after work initiation the site is
not determined to be successful, the permit will be considered to be in violation and
another plan will be submitted for approval
( 13) except for the material used as fill as shown on the above referenced project plans on
file at the Division of Water, place all excavated material landward of the floodway *
( 14) do not leave felled trees, brush, or other debris in the floodway `
( 15) the outfall structures and riprap placed for bank stabilization must conform to the bank
( 16) anchor the bridge decks to prevent dislodging and/or flotation during high water events
( 17) remove all construction debris, including the temporary construction crossing from the
floodway * upon completion of the project
( 18) keep the bridge waterway openings free of debris and sediment at all times
( 19) * NOTE: for regulatory purposes, the floodway is defined as that shown on Panel 13 of
the Ciry of Carmel Floodway Map dated May 19, 1981

Dear Kent:
Pursuant our recent meeting and discussions,please find enclosed the mitigation plan for the above
referenced site.The proposed plan details mitigation for proposed impacts that will take place within
the floodway of Carmel Creek. The impacts will include the clearing of trees and recontouring the
existing elevations. The impacts are necessary to allow suitable play for Fairways 11 through 15 of
the Woodland Country Club Golf Course.
As discussed, the construction activities will be conducted in two phases. Phase I construction
activities will commence once the Indiana Department of Natural Resources (IDNR)has issued a
Construction in a Floodway Permit. Phase II activities aze projected to take place within the next
five years. Phase I mitigation activities will include the planting of 390 shrubs(approximately 3 to 4
feet in height) within 1.30 acres that will be cleared for Fairways 11 through 14 and portions of
Fairway 15; the planting of 900 trees(approximately 3 to 4 feet in height) in 3.0 acres that will be
adjacent to the creek corridor;and the installation of various native herbaceous species within a 0.1
acre littoral shelf of an existing shallow pond.
Phase II mitigation activities will include the planting of 33 shrubs (approximately 3 to 4 feet in
height) within 0.11 acres that will be cleared for Fairway 15. Total proposed impact acreage for
Phase I and II within the floodway af the project site is 3.Q acres. Total propased mitig�tion acreage
for Phase I and II includes 3.0 acres of extended corridor tree/shrub plantings, 1.41 acres of shrub
planting within the corridor and 0.1 acres of herbaceous wetland planting.

On August 28, 2000, Woodland County Club will present to the Carmel Board of Zoning
Appeals,(hereafter"Board"),its Special Use/Amend Application requesting approval to redesign and
expand its existing golf course in the southwest quadrant of E. 116`h Street and Keystone Ave.
Enclosed for filing with the Board, is an aerial photograph of Woodland Country Club and
surrounding properties and a routing plan of the new golf course as designed by Tim Liddy and Pete
Dye. The aerial photograph depicts the entirety of the 175 acre parcel of real estate known as
Woodland Country Club. The plan provides for the redesign of the existing golf course, and the
expansion of the golf course onto the 50 acre parcel of real estate known as the Holland Property and
labeled on the photograph as Expansion Area. No changes are to be made to the existing facilities
including the club house, swimming pool, pro shop, and maintenance facility.

Pursuant to our conversation, I enclose for your review the following documents:
1. A copy of the floodway construction permit issued by the Department of Natural Resources

2. A copy of a habitat replacemeot plan prepared by JF New and Associates approved by DNR.
Subsec�uent to the BZA hearing approving the Woodland special use permit for the golf course, WoQdland .
did retain JF New and Associates to assist in addres'sing the impact of Woodland's construction activities,
and to file a mitigation plan for habitat replacement with the Lafayette Fish and Wildlife Division of the
DNR. '
You will notice the mitigation plan has created planting areas(DNR refers to these as habitat replacement �
areas)that increase the wooded areas on a mitigation ratio of 5.58/acres to 3.0/acres of wooded areas
� distwbed by the golf course construction. Woodland will plant 444 shrubs,as well as 1200 trees in the `
habitat replacement areas-as shown in the mitigation aones on the plan enclosed. By extending the habitat
corridors into the habitat replacement areas, Woodland will create wooded acreage for the habitat greater
than existed prior toconstruction. These areas are to be designated as"legal conservation easements."
In addition to the above,as part of Woodland's mitigation plan,a wetland area is being planted with
. - vegetation that will create additional wildlife habitat areas that had not existed previously,as reflected on "
page 2 of the drawings. This area of wetland is not calculated into the mitigation acreage identified above.
It is Woodland's belief that by satisfying the concerns of the Department of Fish and Wildlife of the DNR
with a plan that mitigates the impact of our construetion in the floodway,that Woodland would be meeting
the intent of the concerns raised by you at the BZA hearing.
However,we now recognize there was a different interpretation of what was requested of Woodland
regarding the relocation of wildlife. Therefore,we sincerely apologize for any misunderstanding that has
resulted,as it is typical to view mitigation as theappropriate method of addressing such concerns.
. We do believe our mitigation plan will create a favorable wildlife habitat that will be monitored by the
DNR for three(3)years to assure it is successfully implemented,and theareas aze preserved by the state as
legal conservation easements.
