acquiring,an inter;esf in the Real Estate from,'Owner. These commitments may be
mod'if ed o"r terminated only by a dec'is'ion of tli'e Councii made at a public hearing

6. Effeetive Date These commitments contairied herein shall be effecfive upon the
approval of a'Special Use Application filed with the:Carmel Board ofZoning Appeals
