General Info:
The petitioner is seeking
variance approval to have a 5-
ft (60-inch) tall fence in the
front yard. The ordinance
defines a comer lot as having
2 front yards. The maximum
height for a fence in the front
yard is 3.5 feet (42 inches).
Analysis:
The petitioner is seeking a
variance of 18 inches, in
order to have a 5-ft fence in
the front yard. This property
is a comer lot. The petitioner
should address visibility

Findings of Fact: Se back
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welf re of the community because: the fence height will be 18 inches taller than
what is required.
2.) The use and valu of the area adjacent to the property included in the variance will not be
affected in a subs antially adverse manner because:
the fence height w.ll be 18 inches taller than what is required.
3.) The strict applic tion of the terms of the Zoning Ordinance to the property will result in
practical difficult. es in the use of the property because:
the owner may h ve to tear down the existing 5-ft tall fence and erect a 3.5-ft tall fence,
possibly causing a hardship.
Recommendation:
The departme t recommends positive consideration of Docket No. 05070008 V.
