EL BOARD OF ZONING APPEALS RING OFFICER: DEPARTMENT REPORT August 22, 2005 General Info: The petitioner is seeking variance approval for a larger than required wall sign facing US 31. The Sign Ordinance states that the sign can be 75 sq ft. The petitioner would like a sign that is 111 sq f1. The petitioner currently has received approval from the Plan Commission Special Studies Committee for the design and location of the wall sign. The existing ground sign along US 31 will be removed. Analysis: The property is located along US 31, which is a heavily traveled highway. The wall sign is set back further than what the original ground sign was. Findings of Fact: Sign size/type 1.) The approval 0 this variance will not be injurious to the public health, safety, morals, and general wel are of the community because: the sign will provide adequate visibility to drivers along US 31, possibly providing enough time for drivers to slow down and use their turn signal, possi ly reducing traffic slow-downs and/or accidents. 2.) The use and val e of the area adjacent to the property included in the variance will not be affected in a sub tantially adverse manner because: the sign will prov de adequate visibility to drivers along US 31, possibly providing enough time for drivers to slo down and use their turn signal, possibly reducing traffic slow-downs and/or accidents.. 3.) The strict applic tion of the terms of the Zoning Ordinance to the property will result in practical difticul ies in the use of the property because: the wall sign ma be too small, making it hard to read and hard for patrons to identify the site, while driving by.
