Guilford Road Condominiums (Townhomes) The applicant seeks the following development standards variance: Docket No. 05070026 V ZO Chapter 20G.05.02(C)(1) % buildings facing street The site is located southwest of Main St & Guilford Rd and is zoned OM/MF: Old Meridian-Multi- Family. Filed by Mark Monroe of Wooden & McLaughlin for Guilford Real Estate Partners, LLC. General Info: The petitioner is seeking variance approval for buildings facing a public street. The Ordinance states that at least 75% of buildings in multi-family projects must face a public street. There are 8 buildings proposed. Analysis: The project has approximately 50% of the buildings facing a public street. The site, itself, does not have much public street road frontage. The design of the development is to make the most of the land and to allow for easy traffic flow. Much of the multi- family building facades face a courtyard area, rather thana street. Findings of Fact: Setback 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: the developer has utilized the maximum road frontage for building facades facing the street. The rest of the site is designed for internal circulation and courtyard space. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the developer has utilized the maximum road frontage for building facades facing the street. The rest of the site is designed for internal circulation and courtyard space. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the developer will have much unused space on the site because multiple multi-family buildings will note able to be placed internally on the site. Recommendation: The department recommends positive consideration of Docket No. 05070026 V.
