EXPLANATION
Dr. Lynn Burford is. an optometrist. and the managing member of Burford Properties,
LLC ("Burford Properties"). Dr. Burford currently has offices in Carmel that are located at
10293 N. Meridian Street. Dr. Burford's practice is growing and she desires to relocate her
offices to a larger facility, but remain in Carmel as part of Carmel's business community. To
this end, Burford Properties is the contract purchaser of four (4) parcels of real estate, which are
located east of and adjacent to Pennsylvania Avenue near the Meridian Street Corridor between
103rd Street and 106th Street ("Real Estate"). Depicted on Exhibit 2. and highlighted in yellow is
an aerial photograph that shows the four (4) parcels that comprise the Real Estate.
Burford Properties has previously appeared before the Plan Commission regarding
ADLS/DP approval for the site plan, landscape plan, building elevations and signage for the site.
The Plan Commission unanimously approved Burford Properties ADLS and DP application.
Burford Properties is also appearing before the Carmel Common Council for approval regarding
a rezone request to rezone the real estate from the current R1 and R3zoning designation to a B5
zoning classification to permit the development of two (2) office buildings on the site.
Due to site constraint issues associated with the Real Estate, Burford Properties is seeking
a variance from Section 23.E.07(A)(I)(a) parking area landscaping. The landscape plan
currently provides for a perimeter buffer yard and landscaping treatment adjacent to the parking
areas on the eastern portion of the site. If Burford Properties attempted to comply with the
requirements of 23.E.07(A)(1)(a), it would result in the loss of approximately 14 parking spaces
on the site which would necessitate the need for a parking .space variance. During the Plan
Commission and Council review of this project, adequate parking was an important issue
discussed by these bodies. Further, if Burford Properties attempted to comply with
23.E.07(A)(I)(a), in addition to the five (5) foot parking buffer, they would also be required to
plant additional trees and shrubs. Again, because of the site constraint issues associated with the
property, there is not enough area within the site to plant the additional. trees and shrubs.
The Department of Community Services has advised Burford Properties that they are in
support of this variance request and that the site is adequately landscaped and screened based on
the approved landscape plan submitted to the Plan Commission.
We look forward to presenting this variance request to the Board of Zoning Appeals at its
September 26, 2005 meeting. ,
