MEETING AGENDA
Date: Wednesday, July 17, 2013

9:00 a.m. Docket No. 13060023 DP/ADLS: River Road Shops at Legacy.
The applicant seeks site plan and design approval for 3 multitenant mixed use commercial buildings. The site is
located near 7621 E. 146th St., with frontage on River Rd. and 146th St. It is zoned PUD/ Planned Unit
Development, with a small portion in the Special Flood Hazard Area. Filed by Charlie Frankenberger of Nelson
& Frankenberger, P.C.
Jon Dobosiewicz with Nelson & Frankenberger and Charles Key with C&L Management presented on behalf of
the petitioner. This project involves the development of a six-acre site, which will include 3 buildings. The
building which will be constructed first will be the one closest to 146th St. The other two buildings will be
constructed at a future date. The developer has submitted for ADLS approval for the first building as well as
development approval for the entire six-acre site.
Greg Hoyes – Hamilton County Surveyor’s Office
- Project is still being reviewed. Surveyor’s office is working with Platinum regarding the flood plain
mitigation as well as the vacation or relocation of the tile that runs along the west side of the property line.
Joanie Clark – Vectren Energy
- If gas will be used on this site, the developer will need to submit an AutoCAD file.
Nick Redden – City of Carmel Engineering
- Letter will be sent as soon as possible.

- This is outside of IP&L service area.
Shirley Hunter – Duke Energy
- The transformer location on the prints will need to be negotiated and probably will not work where it is
shown. A service request will need to be submitted to Duke. Developer said this is a retail and multiple
tenant building, which will hopefully start construction this fall. Ms. Hunter said this will fall under the
jurisdiction of the Noblesville district office. The developer’s contact will be Christina Girod. The
developer would need to submit a service request along with an AutoCAD, load information, and an address
for the retail spaces.
Ms. Hunter said there is a potential issue with landscaping on this project. The Legacy project just west of
this has planted Honey Locust trees, which will eventually grow up into Duke’s lines. These trees will
eventually need to be butchered to clear them from the lines. This is a lot of maintenance work for Duke
Energy which is why they would like to get these issues settled in the planning stages. The issue with the
transformer was that it didn’t appear to be within 10-feet of a paved surface.
Chris Ellison – Carmel Fire Department
- Mr. Ellison said he did not see utilities or fire hydrants on the inside part of the project, and asked if these
would be planned for the future. Mr. Key said there will be internal routing of the water line, and he
assumes there will eventually be a hydrant on the southeast corner and another one due south of the
building. Mr. Key said there will eventually be two hydrants.

David Lucas – Hamilton County Highway Department
- Comments are not about the site, but about the proposed Ricker’s gas station shown on the plans, with
access on 146th Street. Mr. Lucas said this access has not been approved by the Board of Commissioners,
and it does not look like this will be approved. Mr. Lucas said it could be a long process for the Ricker’s to
get this access, so the developer of this project should not count on this access being there. Mr. Ellison
added that if this access goes away, it will affect CFD operations.

Angie Conn – City of Carmel Planning & Zoning

Teresa Lewis – City of Carmel Utilities Department
- Since this is a multi-use building, provisions should be in place for grease interceptors. This information
can be found on the Carmel Utilities website.
Ryan Hartman – Clay Township Regional Waste
- This project is outside CTRWD service area.
9:15 a.m. Docket No. 13060016 DP/ADLS: Point Blank Range & Gun Shop.
The applicant seeks site plan and design approval for an indoor shooting range and gun shop. The site is located
at 969 N. Range Line Rd. It is zoned B-3/Business and lies within the Carmel Dr. - Range Line Rd. Overlay
Zone and partially in the Special Flood Hazard Area. Filed by Charlie Frankenberger of Nelson &
Frankenberger, P.C.

received plans by now.

- This does not fall into Hamilton County watershed, so Carmel will be the contact for stormwater.

- This project is in Duke Energy service area. Ms. Hunter asked if this is an existing building.
Shirley Hunter – Duke Energy
- Plans have not been received. Ms. Hunter asked if this is an existing building. Mr. Dobosiewicz said the
current building will be demolished and then rebuilt. Ms. Hunter said she will need an AutoCAD and a
service request. Ms. Hunter asked if this will require single-phase or three-phase electric power. Ms.
Hunter said single-phase is available right now, or if three-phase is required, Duke would need to work on
this. Mr. Dobosiewicz said the plan is to start construction later this year.
Chris Ellison – Carmel Fire Department
- Mr. Ellison said he would like to meet with the owner/operator and the architect of record to get a better
understanding of the operations of the business.

9:25 a.m. Docket No. 13060015 SP: B & B Park Subdivision Final Plat (formerly called Lakeland).
The applicant seeks administrative secondary plat approval for 2 lots on 10 acres. The site is located at 12650
Clay Center Rd. It is zoned S-1/Residence. Filed by Michael DeBoy of DeBoy Land Development Services for
Christian Browning.
Jim Rinehart and David Malks with Williams Creek Consulting presented on behalf of the petitioner. Mr.
Rinehart said this is Christian Browning’s property, which is being subdivided so the back two acres can be sold.
This is the secondary plat for the property. The property was previously in front of the committee in 2008, but
there were issues with the project both with construction, and visually that made the client decide to wait to
make it more attractive and cost effective.

- Letter sent. Surveyor’s office supports petition for replat and is still considering the release rates of the
detention.

- Asked if client will want gas service on the property. Mr. Rinehart said he is sure the client will want gas,
and noted that this project is approximately ten acres with the back two acres being sold, with the remaining
7-acres staying the same.

- Ms. Hunter asked if this home will be constructed soon. Mr. Rinehart said the expectation is for a fall
construction at the earliest. Ms. Hunter asked if it would be possible to make the 20-foot drainage and
landscape easement a utility easement as well, as the utility easement on the back west side does not allow
for power to be run to this new home. Mr. Rinehart said on Lot #2 there is a 10-foot easement along the
front. Mr. Rinehart said if the easement cannot be used, there is no reason a new one couldn’t be created.

9:35 a.m. Docket No. 13060017 PP: Silvara Primary Plat (and PUD Amendment).
The applicant seeks primary plat approval for 360 lots on 266 acres, as well as a PUD Ordinance Amendment
request:
Docket No. 13060020 OA: PUD Chptr 14.3, Exhibit E, and Exhibit L (Section 13): Total number of
access points along Springmill Rd. The site is located at 11960 Springmill Rd., northwest of the intersection of
116th St. and Springmill Rd. It is zoned PUD/Planned Unit Development and is partially in the Special Flood
Hazard Area. Filed by Doug Wagner of Republic Development, LLC, for Silvara Development Company, LLC.
Jim Rinehart with Williams Creek Consulting, Doug Wagner and Lawrence Moon with Republic Development,
and Dennis Olmstead with Stoeppelwerth & Associates presented on behalf of the petitioner. This project
includes 360 lots on 266 acres. The primary plat follows the PUD mostly, although the developer will be
looking for some tweaks to the zoning. Mr. Rinehart said this project is a little unusual since it includes no
lakes, and the developer is working with Williams Creek on a more sustainable design which includes bio-
swales.

- Asked when the developers hoped to start phase one. Mr. Rinehart said the project will hopefully start by
the end of the year. As soon as the developers feel comfortable starting construction they will. Dirt moving
will be starting this year and the actual construction will most likely be in 2014. Ms. Clark requested an
AutoCAD file.

Dan Davenport – Indianapolis Power & Light
- This project has a boundary between IP&L and Duke Energy. Both companies will need an AutoCAD of
the project so the energy companies can overlay the plans on their maps to figure out the boundaries.
Shirley Hunter – Duke Energy
- This project will be a challenge but both companies will make it work. Ms. Hunter said the boundary
almost divides the project in half, north and south. Ms. Hunter said it is very difficult to change service
boundaries so they will have to comply with the lines that are already drawn. Ms. Hunter said she is almost
100-percent sure that block A will be IP&L, as well as everything going west from that location. Ms.
Hunter said Duke Energy would be everything to the north. Mr. Moon said phase one would be the main
drive which would be the second of four entrances along Spring Mill Rd. Ms. Hunter said the subdivision
across the street is Duke Energy and IP&L is south of that.
Chris Ellison – Carmel Fire Department
- Asked if the dead ends at lots 256 and 236 will allow for fire apparatus to turn around, as the dead ends
appear to have a square configuration. Mr. Moon said the plan would be to allow for enough room to
accommodate this. Mr. Ellison asked if the developer can provide an emergency circulation plan. Mr.
Ellison said between lots 4 and 11, it appears that the water main is in the rear of the properties, and asked if
this is accurate. Mr. Moon said this is on an alley, but the paving is 20-feet wide. Mr. Ellison said
southwest of lot 11 there is a water main that runs through, and said if the developers could install a fire
hydrant on the corner, it would help the fire department immensely. This would allow the fire department
to service the front of the homes if there is ever a fire.

- Preliminary comments have been sent, and will be finalized by the end of the week. Ms. Conn said the
forestry department is also reviewing the plans, and those comments will be sent later as well.

- Mr. Hartman said CTRWD would like a separate meeting outside of TAC to get an overview of what is
being proposed. Mr. Hartman asked if the lift station being proposed will be private or turned over to the
township. Mr. Olmstead said the developer is planning on this lift station being turned over.
9:45 a.m. Docket No. 13060022 Z: Horizon Bank Rezone.
The applicant seeks approval to rezone 0.317 acres from OM/O-Old Meridian Office Zone to OM/V-Old
Meridian Village Zone. The site is located at the northeast corner of Old Meridian St. and Carmel Dr., just west
of 1200 Carmel Dr. and south of Providence at Old Meridian. Filed by Steven Hardin of Faegre Baker Daniels
LLP on behalf of Horizon Bank.
Gene Valanzano with Faegre Baker Daniels and Jim Jaksa with Horizon Bank presented on behalf of the
petitioner. This project will be located at the corner of Old Meridian and Carmel Drive. The property on the
corner is split into two separate zoning classifications. This would be a rezone for the south triangle on that
parcel. Mr. Valanzano said the plan has changed slightly due to engineering requirements.
