NOW,WJIEREFORE,it is stated that the original Declaration of Covenants and
Restrictions for Bella Terra is amended and modified and that the following terms an
conditions are hereby made a part of this Declaration:
1. Private Streets. Declarant hereby covenants that it shall convey and transfer the
Private Streets included in and constituting apart of the Real Estate to the Association
upon the completion of such Private Street. The Private Street so conveyed by Declarant
to the Association shall, at the time of such conveyance, be subject to all easements,
covenants, conditions, limitations and restrictions then of record, but shall be free and
clear of all1iens and financial encmnbrances, other than the lien of the then-current non-
delinquent installment of real estate taxes and assessments and subsequent installments
thereof, which shall thereafter be paid when due by the Associatio~ and shall be further
subject to the terms and provisions of this Declaration. Declarant reserves unto itself, its
successors and assigns, and hereby establishes for each Owners of Lots, their guests and
invitees, and all public and quasi-public vehicles, an easement for ingress and egress on
and over the Private Street. The terms " public vehicles" and " quasi-public vehicles"
shall include, but shall not be limited to, vehicles operated for police and fire protection,
ambulances, and other emergency vehicles, for trash and garbage collectio~ and for mail
and other delivery services operated in the performance of their duties.
2. Notice of Private Street. Each Owner. by the acceptance of a deed to a Lot,
acknowledges that all streets in Bella Terra are Private Streets and the maintenance,
repair and replacement of such Private Streets is the sole responsibility of the Association
as described herein: each' Owner further agrees that by the acceptance of a deed to a Lot
he waives the right to request the dedication of the Private Street to the City of Carmel,
Indiana, or to the Board of Hamilton County Commissioners.

This 1etter serveS to acknowledge receipt of a transmittal received 9/17/04 containing the
plans for .the above-mentioned project. After reviewing the plans the' Highway
Department has the following comments:
1. The entrances must be located a minimum of 200' from Towne Road and Augusta
Drive. .
2. The minimum curb radius for the entrances is 35~.
3. In aocordance w~'th the Hamilton County Thoroughfare Plan,' additional right of way is
-required at the intersec1ion of 106th Street and Towne Road. On Towne Road, the
.right of way from the Intersection to a point 500. to the' north is an 80' half. From that
.point -to the northem property line the right Qf way Is 70'. On 1 oath Street, the right of
way from the -Intersection to a point 500' to the east 1s a 65' ha1f. From that point to
the eastern property line the right of way is a 50' half. A 50' trlanguJar cut is also
needed at the In~ersection, connecting the right of way for the perimeter streets.
4. A street and pavement section must be provided for the access road. Please note
that the street must be built to the minimum county standards.
5. The pavement located within tl1e Towne, Road. right of way must match the existing
pavement of Towne Road. I have attached a copy of the pavement section for your
'use.
S. The storm water from the access roadwlH not be ,perml~ed to enter the right of way
of Towne Road. 'Adjustments .to the access. road must be made 10 contaIn all of the
-storm water. .
7. -Please show the sse under the curb.
8. A private stree~ agreement wilt need to -be executed before any permits for this
proJect are approved. The agreement win need to jnclude language similar to the
fonowing statements:

to have the easement considered a pubHc road necessitating
maintenance by any unit of government.
. The following also needs to be inoluded on the plat: Where common
drives are shown on this p1at, those lot owners abutting such drives shall
own equal and undivided Interest in such drives as tenants In common.
and it shall be the obligation of each owner in common with the other lot
owners abutting such a drive to contribute an equal share of the cost of
the maintenance of such drives. Where a majority of lot owners served
by a private drive elect to repair the private drive and one or more lot
owners fails to pay their allocable share of such repair, then the owners
paying such cost may file a lien for the reasonable va1ue of labor
performed and materia1s furnished as prescribed by the lien laws of the
State of Indiana against any such lot and the owner thereof and recover
the ful1 assessment owed together w'th Interest from due date and
reasonable a1torney's fees~ The private drive may contain utiUties to serve
said lots in whtch event the several propertY owners shall maintain the
utiUties not otherwise maintained by the respective utility in the same
manner as set out for drives. AU private drives shal1 also, be a utility

My name is Cesare TurriBL I reside at 5436 Woodfield Drive in Cannel. I am the President of the Woodfield
Homeowners Association and I represent the 185 home Woodfield sub-division that borders the northern edge of
Carmel with entrances on both 146th St and on Gray Road.
I would like to thank the Sub-Division Committee for.pennitting me to speak on behalf of our bomeowners.
The Woodfield HOA beli~es that development oflhelands North and Northwest ofWoodfiekIare inevitable and
we do not stand in opposition to development. However, that development must be congruous in nature,
complement existing devetc>.pment and set the precedent for future projects.
Unfortunately, I regret to report that neither the developer of Villas @ Morgan Creek, the Covemmt Group, nor any
other representative have made any attempt to conta!:1! the Woodfield HO^, even though the HOA bad asked a
representative of Covenant to attend the HOA's regular Nove.mber meeting held on 11/22/2004. The data that I will
refer to was gathered by the Woodfield HOA and Woodfield residents ftom public records and attendance at the
November 16, 2004 Plannfug Commission meeting.
First, I would like to state that the Woodfield HOA beJieves that the Covenant Group and Corbier Traditions to be
reputable organizations. I believe that whatever differences in opinion that may exist benveen the Woodfield HOA
and Covenant can be resolved if negotiated in good faith.
Notwithstanding the good intentions of the Covenant Group; the Woodfield HOA believes that the Villas @ Morgan
Creek project is flawed fol' the following reasons:
1. This project is not congruous with existing. sub-divisions to the South and East (Woodfield) ~d to the West
(Oakbrook). (Refer to chart attacbed below)
a. Villas' lot sizes are between 68% and 15% smaller than the adjacent lots in Woodfield and
approximately' 83 % smaller than the lois' in Oakbrook;
b. Building square footage minimums are significantly less than both Woodfield and Oakbrook.
2. The architectural control guidelines drafted 10127/2004 are lax, incomplete, and provide the developer
maximum flexibility w! deviate from the original' concept home presented to the Planning Commission. The
architectural control guidelines were prepared with no input from SWTounding commUnities nor with any regard
to the existing architecture in nearby sub-divisioDS.
3. The proposed sanitary sewer for the Villas will connect to the existing drnin from Oakbrook that flows to a
sewage lift station located adjacent to Lot 40 in Woodfield. In the recent past, this lift station has experienced
repeated problems. To our knowledge, neither the developer nor his engineering consultants have confirmed
that the current sanitary drnin infrastructure can handle additional waste from the Villas.
The Woodfield HOA recommends that the Cannel Planning Commission reject the Design Standards Waiver and
reject the Open Space Priority Waiver.
In summary, the Woodfield HOA believes that the Villas, as currently proposed, are not in the best interest of the
surrounding sub-divisions nor do they contribute to the upscale and progressive image of the Carmel community.
They only serve to benefit the developer who, most likely, will never reside there. The Woodfield HOA believes
that the approximately 6 acre parcel ofland under consideration offers the developer a unique opportunity to build
larger upscale homes in a unique wooded setting. Large upscale homes have been successfully built and sold in the
adjacent Oakbrook sub-dhision. Finally, the architectural guidelines, as drafted, are poorly defined and amenable to
significant deviation and changes by the developer and home builders.
The Woodfield HOA offers, the folIo~ing recommendations to arrive at a ~in-~in solution for the developer and the
surrounding Cannel communities:
I. Set minimum home sizes to DO less than 3,000 square feet for a one story home and 4,000 square feet
for a 2 'story home.
2. Specify a 3 car garage minimum.
3. Specify that all homes be on a crawl space or basement structure. Concrete slab homes should not be
pennitted.
4. All homes must have brick exteriors on all sides of the first floor and, at minimum, cedar siding above
the first floor.
5.
Invite represen& from both the Woodfield HOA and the Oakb_ HOA to review architectural
concepts and the plat layout in advance of the Planning Commission meeting(s).
Cease clearing land on the parcel until the plat is approved.

This letter is in response' to your primary plat application for Bella Terra Subdivision. The
following issues must be resolved:
Thefollo~ing required supporting data must be submitted:
I. A legible area location map of i "=500' showing the following:
a. Existing adjacent uses.
b. Watershed boundaries.
c. Thoroughfares directly related to proposed subdivision.
d. Existing adjoining zoning classifications and proposed uses.
e. Title on area location map, its scale, north arrow and date.
2. A landscaping plan.
3. A signage plan designating location, size, and materials of signage.
Concerns 'and Comments are as follow:
1. Please indicate. the present zoning classification on the plat (as per SC 5.02.01).
2. Please indicate contour slopes in a'legible manner (as per SC 5.02.0S).
3. Please indicate rear building setback lines on the plat (as per SC 5.02.11).
4. Please update legend to identify' all plat symbols, and remove those symbols not
shown in the plat.
5. As per the Alternative Transportation Plan, a 10-foot separated pedestrian path
must be provided along 106th Street and Towne Road for the extent of this
primary plat. Please provide and indicate on plat
6. As ,per SC 6.03.24 (2), a minimum 20-foot planting strip is required between the
Towne Road right-of-way and your proposed frontage place. This planting strip
must extend for the length of 1 lot past thoroughfare access points. Please provide

As per SC 6.03.24 (4), frontage places may not exceed 600 feet between
thoroughfare access points. You will need to redesign the proposed frontage place
to comply or request a Subdivi~ion Waiver from this requirement.
As per SC 6.03.24 (5), thoroughfare access points must ~e a minimum of 250-feet
from the intersection of parkways. The distance between the southern access
point on Towne Road, and the 106th Street/Towne Road intersection does not
comply. You may need to utilize a '~hammerhead" design to access 10t'l. Please

We have reviewed the primary plat submitted to the Hamilton County Surveyor's Office on
September 17t 2004 for this project and have the following comments:
