The Carmel Plan Commission's recommendation on the petition of the applicant is "FAVORABLE." At its regularly scheduled meeting on November 16, 2004, the Carmel Plan Commission voted nine (9) in Favor, zero (0) Opposed, zero (0) Abstaining, to forward to the Common Council the proposed Ordinance No. Z-468-04 with a Favorable Recommendation. Please be advised that by virtue of the Plan Commission's Favorable Recommendation, pursuant to IC 36-7- 4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified by the Commission. The comments from the City review have been satisfactorily addressed. Please submit seven sets of plans for approval. The Department \vill approve up to two additional sets for a total of nine sets. We offer the following comments: GENERAL INFORMATION This general information is being repeated from Review #1 as there have been changes regarding some of the data originally presented. 1. The project site is currently within current City of Carmel Corporate Limits. The following jurisdictions will apply to this proj ect. 2. Jurisdictions: .~: . Street and Right of Way - INDOT (U.S. 31) / City of Carmel (Frontage Road) . Water - Indianapolis Water Company . Sanitary Sewer - Clay Township Regional Waste District . Storm Sewer - Hamilton County Surveyor (City of Carmel Review) 3. Board of Public Works and Safety Approval Requirements: . Commercial Curb Cut Approval (two proposed curb cuts on the frontage road). The request for Board approval should include. 8~" x 11" exhibits that will indicate the proposed (and existing if applicable) curb cuts and all appropriate data and dimensions including width (throat and at street/road edge of pavement), radii, distance between curb cuts (if applicable), etc. Please Indicate all existing and opposing driveways and their relationship to the proposed curb cuts for this development. I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board. Any submission to the Board requires prior filla/approval by the Carmel Clay Plan Commission and/or the Board of Zonillg Appeals and conlpletion of review by the Techllical Advisory Comnlittee. All written requests to be place Oil the Board's agenda must include the appropriate Docket Numbers and the date (or dates) of approval by the Plan Commission and/or BZA~ 4. TAC ReviewlDrawings submitted for approval: We request that all comments and comment letters generated by this office be answered in writing and be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for construction until all issues have been resolved. The design engineer n1ust certify all drawings submitted for final approval. This office will require a minimum of three-sets of approved drawings after all issues have been resolved. The drawings will be stamped approved and signed by the City Engineer. The Developer/Owner will receive one-set which is to be maintained on the construction site at all times. If more than the minimum three-sets are requested to be approved, the additional sets (maximum total of two additional) must be submitted with the three required sets. 5. Corrunercial Permitting Procedures. BONDING REQUIREMENTS 6. Upon initial review, it appears the following bonding requirements may apply to tills project: Performance/Maintenance Guarantees These are not applicable to this project unless a sidewalk or asphalt path is to be constructed in the dedicated right of wa y of the frontage road. If so, we would require a Certified Engineer's Estimate of 100% of the cost of labor and materials to construct the walk or path. We would then require a Perfonnance Guarantee in the amount of the Engineer's Estimate. Upon completion of the walk or path and release of the Performance Guarantee by our Board of Public Works and Safety, a 3-year, 10% Maintenance Guarantee would be required. Right of Way Permit and.Bonding Requirements Any work in the dedicated right of way of the U.S. 31 Frontage Road will require a Right of Way Permit from the City of Carmel with appropriate bonding. The bonding requirement is a License & Permit Type Bond, payable to the City of Carmel, with an expiration date no earlier than one year from the date of issue of the bond. The bond amount is based upon the number of instances of work in the right of way at $2,000.00 per instance. It appears that the following construction will require permitting and bonding: . Demolition-fence in right of way. . 2-CurbCuts in right of way . Water Main construction in right of way . Sanitary Sewer construction in right of way Contact our Right of Way Manager/Inspector Fred Glaser for details and information regarding this Issue. PROJECT COl\tIMENTS 7. There was a comment at the June 16 Technical Advisory Committee meeting regarding a requirement for a sidewalk or asphalt path to be constructed in the dedicated right of way of the frontage road, yet the current submission does not include either. Please give us the current status of this issue. 8. Please show the straight curb to City standard for portions of drives in the right of way. 9. Please show milling and resurfacing of frontage road across the property frontage. 10. Right of Way pavement section shall be:' · 1.5" #11 Surface, 2" #8 Binder, 3" #5D Base, 7"#53 Stone and 4" #2 Stone. 11. Please indicate size and material' of the force main and more detail. for its installation. 12. Will the lift station location disturb too much of the tree protectio~ area with the construction of the station and the service lines? Why not put the lift station between,the two buildings? 13. What is the status of Indianapolis Water Company's review of the proposed water main extension? 14. We have engaged Crossroad Engineers to review all storm drainage plans and drainage calculations submitted to this office for revie\v. We will share these reviews with you as they are received.
