Dear Mr. Hayes:
Enclosed please find one (1) set of Construction Plans which were revised in
accordance with your comment letter dated June 4, 2013. Those comments were
addressed as follows:
1. It is noted that the project falls in the incorporated are and MS4 jurisdiction of
the City of Carmel.
2. It is noted the the project does not fall in a Carmel Wellhead Protection Zone.
3. It is noted that the project falls in the Long Branch (J.W. Brendle) Regulated
Drain Watershed.
4. Enclosed please find a Petition for Regulated Drain Subdivision and a
Subdivision Non- enforcement Request, the additional requested items will be
sent upon their completion.
has been added to the Construction Plans Sheet C803.
6. All additional drainage review comments have been addressed from
CrossRoads Engineers and have been resubmitted for final review.

The Hamilton County Drainage
Board considered the extent of the drainage easement on the Long Branch (,f.W, Brendle) Drain in the
Village of WestClay, Section 10010 -E Subdivision. Upon the agreement in writing by the recorded
owners) of land involved that such owner(s) agree and covenants that neither the Hamilton County
Drainage Board nor any Contractor nor Workman operating under the authority ofsaid Board will be
held liable for any damages resulting from construction, reconstruction, or maintenance of the above
named drain at said location, whether to the real estate or improvements thereon the Board agreed:
1. That it will not enforce the easement beyond those shown on the Subdivision plat recorded in Plat
Cabinet Slide in the Hamilton County Recorders Office.
2 It will not object to the improvement of said real estate beyond such distance, and
3. Other Conditions:
