HomeMy WebLinkAboutCC-08-05-13-08 CFD/MOU Between, Carmel, fishers, Noblesville and Westfield - Hiring ListSPONSORS: Councilors Finkam, Rider, Sharp, Snyder RESOLUTION CC- 08- 05 -13 -08 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, APPROVING AND ADOPTING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CARMEL FIRE DEPARTMENT, THE NOBLESVILLE FIRE DEPARTMENT, THE WESTFIELD FIRE DEPARTMENT AND THE FISHERS FIRE DEPARTMENT REGARDING THE PURCHASE OF CANDIDATES FROM THE CURRENT HIRING LIST IN ACCORDANCE WITH INDIANA MERIT STATUTE, I.C. 36- 8- 3.5 -1, ET SEO. WHEREAS, Indiana Code 36 -1 -7 authorizes cooperative endeavors between governmental entities so as to better and more economically and efficiently serve the public health, safety and welfare; and WHEREAS, Indiana Code 36 -1 -7 -2 authorizes the Common Council to approve such "Interlocal Agreements "; and WHEREAS, a certain interlocal cooperation agreement memorandum of understanding between the City of Carmel, Indiana ( "City "), the City of Noblesville, Indiana ( "Noblesville" ), the City of Westfield, Indiana ( "Westfield ") and the City of Fishers, Indiana ( "Fishers "), a copy of which is attached hereto and incorporated herein as Exhibit A ( "Interlocal Memorandum of Understanding "), would allow Noblesville, Westfield, and Fishers to purchase candidate names from the City's current hiriiik list. WHEREAS, it is in the public interest to approve the Interlocal Memorandum of Understanding. NOW THEREFORE, BE IT RESOLVED by the Common Council of the Ciry of Carmel, Indiana, that: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. The Interlocal Memorandum of Understanding should be hereby approved and adopted by the Common Council of the City of Carmel, Indiana. Section 3. This resolution shall become effective on and after the date and time it is properly approved and signed by a majority of the members of the Carmel Common Council. Z:IE Bass\My Documents \Resolutions- CCC120131FIRE DEPARTMENT- Interlocal Memorandum of Understanding.docx7 /26/2013 10:04 AM MEMORANDUM OF UNDERSTANDING BETWEEN THE CARMEL FIRE DEPARTMENT OF THE CITY OF CARMEL INDIANA, THE NOBLESVILLE FIRE DEPARTMENT OF THE CITY OF NOBLESVILLE INDIANA, THE WESTFIELD FIRE DEPARTMENT OF THE CITY OF WESTFIELD INDIANA AND THE FISHERS FIRE DEPARTMENT OF THE CITY OF FISHERS INDIANA The Carmel Fire Department (CFD), Noblesville Fire Department (NFD), and Westfield Fire Department (WFD), hereinafter, referred to as "the Partner Departments" and the Fishers Fire Department, hereinafter referred to as FFD. The FFD desires to purchase candidates from the current hiring list collaboratively created, in accordance with Indiana Merit Statute, I.C. § 36- 8 -3.5 -1 et seq. as amended and supplemented by the Commission from time -to -time, by the Partner Departments. ARTICLE I- Period of Agreement Section 1- Duration This agreement shall take effect upon approval of each party's approving authority. This agreement shall remain in full force and effect indefinitely. Section 2 — Modification of Agreement. This agreement may be amended by the parties but only if the amended agreement is in writing and approved by all parties to the agreement in the same manner that the original was approved, Section 3- Termination This agreement may be terminated by any party at any time by providing written notice of the intent to terminate to each party's Fire Chief. Y: \aulbricht \Fire \MOU for FFD.docx8 /5/2013 11:23 AM ARTICLE II- Recognition Section 1- Recognition This agreement recognizes that each party has particular rules, policies, and other governing articles that may dictate their response to a situation. In those instances, all parties will strive to resolve those differences to the best of their ability. It is recognized that the FFD is striving to reduce the duplication of effort and generally reduce the fiscal and administrative impact of conducting this process independently. Section 2 — Problem Resolution In the event a problem or disagreement arises between the parties to this agreement, the problem shall be submitted for resolution to a joint board of the parties consisting of the Fire Chiefs of each party or the Fire Chief's designee. ARTICLE III- Terms and Conditions Section 1- Application FFD will be allowed to use candidates from the Carmel /Noblesville /Westfield Fire Department 2013 Applicant Final Results list as distributed by the Institute for Public Safety Personnel, Inc. (IPSP) (hereinafter referred to as the hiring list) starting with candidate number 40 as shown on the list. FFD will pay each of the partner departments a fee of one - hundred dollars ($100) for each candidate to whom they extend a conditional offer. FFD shall notify the partner departments how many names that they want from the list. Those candidates will be notified via email through Neogov of the FFD interest in them. Those candidates must submit via email through Neogov that he /she authorizes the release of their hiring information to the FFD prior to any information release. This should be coordinated through the CFD. As with the partner departments, all candidates are available to all participating departments until such time as a conditional offer is made and accepted and an acknowledgement of further ineligibility on the list statement is signed by the candidate. Notification should be made to the partner departments anytime a change is made to a candidate's status so that the hiring list can be updated to reflect the change. Section 2- Joint hiring list maintenance All parties recognize that communication between parties is paramount to the efficient and effective processing of potential new hires from the list. Therefore, at any time any party starts to move forward into new hire processing (i.e. background checks, polygraph, etc.) they should make notification, by name, of those applicants who are being considered, to the other parties. This notification does not mean that another party cannot start their own new hire processing on that applicant, but it should be done with full disclosure to the other parties. Procedurally it may be impractical and against Merit Commission Rules for one party to skip or go past a candidate Y: \aulbricht \Fire \MOU for FFD.docx8 /5/2013 11:23 AM on the list simply because another party has started new hire processing on that applicant. It should, therefore, be understood that until a candidate has accepted a position with one party to this MOU, the candidate is still an eligible candidate for all parties. Section 3- Authority This Memorandum of Understanding (MOU) shall enter in force upon signature by all three of the partner department Fire Chiefs and the Fire Chief of the FFD and shall remain in duration indefinitely. IN WITNESS WHEREOF, the undersigned being duly authorized by the respective Governments, have signed this MOU.
