Allowing the placement of these columns, even if the are only aesthetic and not load bearing, on top of a storm sewer pipe is far from ideal, especially considering the size of this particular pipe. The cantilevered portion of the building which overhangs the pipe location is a significant issue in and of it self. The building cantilevered over the pipe would make any replacement operation extremely difficult. Adding the weight of the columns over the pipe is also not preferred and would mean complete removal and replacement of these decorative columns when it is necessary to replace or repair this pipe. Although the proposal is far from usual, customary, or preferred practice, it is not impossible. The factors that would need to be defined in order to protect the City, its infrastructure, and ensure the preservation of public safety are as follows: 1. Responsibility for cost associated with the repair and replacement of columns, sidewalk material, building fagade, or any other part of the building that might be damaged during repair, replacement, or due to failure of the City's pipe would need to be clearly assigned to the building owner. 2. The columns and their associated footings should be minimized in dimension and weight. Removable, light weight columns would be ideal. 3. Clearly defined alternate building access should be defined so that building emergency ingress and egress is not solely dependant to those located on the east side of the building adjacent to the pipe. Should pipe failure occur, these eastern access points would likely be inaccessible. 4. If the pipe is not currently in an easement, then a minimum 15' wide easement centered on the pipe needs to be created in favor of the City. 5. A formal variance from the BPW will need to be obtained and then a Consent To Encroach Agreement executed by the building owner stating their understanding of the risk to any improvement that they place within or over the easement. 6. DOCS — Would the encroachment need a variance from zoning to have a portion of the permanent structure inside the easement. 7. Building owner shall be responsible for any damage to the pipe resulting from the construction or mere presence of the columns. Even if the columns are engineered properly, long term, something might happen to the pipe that would not have happened otherwise. (Please see attached marked up pdf) - The columns could possibly get a bit narrower (a few inches), but as of right now, they are designed as square columns. The issue is that even though they are not actually load bearing, that they give the feeling that they could hold up the building. • (We are also seeking feedback from the City Engineering Dept on the location of the 42 inch RCP beneath the building.) - OK Brandon D. Park Impact Fee Credit: We will need to have a cost estimate for the planned public park improvements to which the impact fees will be credited. We will also need a site plan showing which improvement will be constructed using the impact fees. Unless Adrienne corrects me on this, the ordinance will allow the Monon improvements, the public path between 3`d and Monon, and the pocket park to all be constructed using the impact fee credit from this project. There probably won't be enough $$ generated from the number of apts. to cover all that, but those would be public improvements eligible for use of the credit. The Board of Works will need to approve the application of those fees. Either AB or CRC should present the request to the Board. As far as PC approvals go, I think DOCS is close to issuing a new PC Letter of Grant, but need updated plans of what CRC has approved, including: • An updated site plan updated architectural drawings (elevations with material call- outs), especially interested in seeing screening details for any mechan'cal equipment, meters, etc. especially rooftop HVAC • updated landscape plan, lighting plan and plans for project signage • a plan /statement for vehicle and bicycle parking For TAC, we basically need construction plans for DOCS and Engineering. Please get with Angie about who else should be included with TAC distribution. We need to get a meeting slated ASAP... so we can get this wrapped up.
