EXECUTIVE SUMMARY
Ricker Realty & Development, LLC respectfully requests approval of a Modifi cation of
Development Requirements for the relocation of Bulding Base Landscaping. The subject site is
on the southeast corner of 146th Street and River Road.
The proposed project is a part of the Legacy Planned Unit Development adopted by the City of
Carmel City Council on January 22, 2007 (“Legacy PUD”). The Legacy PUD expressly provides
that Gas Station, General Retail Sales and Restaurant with work up and drive thru food sales
are permitted uses for the subject property.
The Applicant presented its request for DP/ADLS approval and the Modifi cation of Develop-
ment Standards for the maximum front setback requirement at the July 18, 2013, Plan Com-
mission Hearing. The Applicant is requesting a second Modifi cation of Development Standards
to modify the required building base landscaping requirements for aesthetic reasons and to
avoid trash collection areas.
