JANUARY 16, 1996
The meeting was called to order at approximately 7:00 PM by the President with the Pledge
of Allegiance in Council Chambers, One Civic Square, Carmel, Indiana.
New members were administered the Oath of Office by Mayor James Brainard, and John
Hensel, Township Trustee.
Members present were was follows: James Bolander; David Cremeans; Jay Dorman; Judy
Hagan; Jeff Kennelly; Richard J. Klar; Alan Klineman; Barry Krauss; Richard L. Sharp; Luci
Snyder; Paul Spranger; and H.K. "Tom" Thompson.
A quorum was declared.
Members of the Department of Community Services present were: Director David
Cunningham; Mike Hollibaugh; Terry Jones; and Mark Monroe.
F. Election of Officers
H.K. "Tom" Thompson was elected President by UNANIMOUS CONSENT.
Richard J. Klar was elected Vice President by UNANIMOUS CONSENT.
Richard J. Klar accepted the appointment as the Carmel/Clay Plan Commission's
representative to the Board of Zoning Appeals.
Barry Krauss accepted the appointment as the Carmel/Clay Plan Commission's representative
to the Hamilton County Plan Commission.
Jeff Kennelly moved that the City Attorney research carrying forward all Dockets to the
following meeting in the event of a cancellation, with a view towards amending the Rules of
Procedure, and that the City Attorney's findings be reviewed by the Special Studies
Committee and brought before the full Plan Commission; seconded by Dick Klar, all in favor,
MOTION APPROVED.
Paul Spranger moved for the approval of the minutes of the November, 1995 meeting,
seconded by Dick Klar, MOTION APPROVED.
I. Reports, Announcements, and Department Concerns
Dave Cunningham announced that there will be a training session scheduled for a
f. Saturday in February; members are asked to bring any questions and concerns to the

orientation meeting.

r/i In response to questions from David Cremeans, Mark Boyce stated that there are 11.8 acres
being developed for housing, the balance of the property is in open space and pond area.
Judy Hagan asked about the potential for a bike path along 126th Street which was discussed
at the rezone stage; Mark Boyce responded that C.P. Morgan is still open to the issue and
asked that the Park Board present some details/specifics at their February meeting.
Mark Monroe reported that a bikeway is not called for along 126th Street; therefore the
Department did not request it of this particular developer or Carmel Station development.
The County's Alternative Transportation Plan does not call for a bikeway in the area.
Judy Hagan spoke on behalf of the Park Board and stated that because of the size of the
parcel offered by C.P. Morgan, the Park Board would respectfully decline to include it in
their inventory.
In response to questions from Rick Sharp, Mark Boyce stated that if the common area were
not accepted by the Park Board, it would be maintained by the Community.
Mike McBride, 4398 Clifford Road, Brownsburg, with Schneider Engineering responded to
traffic questions at Third Avenue and Carmel Drive; after analyzing the area, even without the
proposed development, by the year 2005 the level of service would be "F" or the lowest level
of service, This particular area is one of concern and possible signalization of the intersection
is to be discussed. Currently, the worst case movement is "D". In the year 2005 at a 2 1/2%
growth rate, without the proposed development, level of service will be at "F".
Dick Klar asked about linking 126th Street as had been discussed in conjunction with the
Carmel Station development. Dave Cunningham reported that there are still segments that
would need to be either dedicated by property owners or condemned in order to provide the
connection.
Docket No. 1-96 P.P., a Primary Plat application for C.P. Morgan Co. was referred to
Subdivision Committee which will meet February 6th.

li. Commission to consider Docket No. 92-95 Z, a Rezone application for Leeper
Electric Service, Inc. Petitioner seeks to rezone 4.066 acres of land from S-
2/Residential to B-2/Business. the site is located at the northeast corner of U.S. 31 and
131st Street.

Jim Nelson, 3663 Brumley Way, Carmel appeared before the Commission representing the
applicant. The original presentation and request for rezone classification was made to the
Commission under date of November 28, 1995. The Special Study Committee subsequently

Jay Dorman asked about the possibility of doing away with the parking to the rear of the

building and increasing the greenbelt buffer between the business and the Church. Jim
Nelson responded that at this point, the application is for a rezone of the property; if the City
Council approves the rezone, the petitioner would be returning to the Plan Commission for
review of the definitive Development Plan; the issues of the Development Plan can be
addressed at that time.
/' Dave Cunningham spoke for the Department, that the application is indeed a request for a
rezone in classification from residential to business; what the petitioner has shown for
development proposal meets the standards of the proposed zoning classification, although the
layout, architectural design and development plan will return to the Commission at a future
date.
Jeff Kennelly moved for the approval of Docket No. 92-95 Z, a Rezone application for
Leeper Electric Service, Inc, seconded by Luci Snyder. The vote was five in favor, Paul
Spranger, Judy Hagan, Jay Dorman, Dick Klar, Alan Klineman opposed, Barry Krauss
abstaining, Tom Thompson no vote. NO DECISION VOTE. Docket No. 92-95 Z will be
forwarded to the City Council with no recommendation.
At this point, the Commission took a short recess.
2i. Commission to consider Docket No. 93-95 PV, a Plat Vacation application for
William Pace. Petitioner seeks approval to vacate a portion of the plat known as
College Hills, (lots 17, 18, and 19) that is the site of the proposed IU Health Care
Facility. The site is located on the east side of College Avenue,just south of the I-
465 Overpass. The site is zoned B-3/Business.

Ron Wright of Wright and Associates, 9000 Keystone Crossing, Suite 730, Indianapolis
46240, and David Schmitts, appeared before the Commission representing the petitioner.
Also in attendance were: Kurt Cupler of IU Health Care, and Ernie Condra and Jim Teske of
Commercial Investment Realty.
The petitioner appeared before the Board of Zoning Appeals for Special Use approval on
November 27, 1995, and before the Plan Commission on November 28th for the vacation of
covenants which were initially filed pursuant to a plat filed in 1928.
The site is located on College Avenue, just north of The Topics Newspaper office, (vacant at
this time) south of I-465 Overpass, and on the east side of the street on approximately 1.6
acres currently zoned B-3 and is consistent with the usage proposed by the applicant, pursuant
to the Special Use Permit.
Pursuant to the right-of-way originally proposed for College Avenue, the covenants and the
plat required a setback which was on lots 17, 18, and 19 of the plat. The right-of-way was
