The "St. Chrisopher's Episcopal Church Establishment of Columbarium and Rules of Use" Agreement has been developed and approved by the Columbarium Committee. A copy of the Agreement is attached. oC The Committee requests approval for use by the Vestry. — / 2. The north section of the concrete sidewalk has developed two cracks. This section will be replaced by Gibraltar. Two other sections were replaced twice. Rezoning Request for the Land West of the Church Property I was contacted on July 15, 1996, by Thomas Dixon, VP of Finance for Depauw University, and was informed that Leeper Electric has "executed the agreement" to purchase the 4+ acres to the west of the Church property. I was told July 17, 1996 by the realtor, that the closing will be in two weeks. Listing price was $65K, selling price was near that amount. As members of St. Christopher's Episcopal Church, we can assure you that efforts are being made to get the church members and Vestry to make a more concerted effort to purchase that property so that it can remain a "greenspace" for the Meridian Corridor area. As local citizens, we have found the process of Planning Commission meetings and City Council meetings very interesting but find it difficult to keep abreast of what is happening in the Carmel area. The one thing we have learned, however, is that the people serving as Commissioners and Councilors are making an effort to listen to all of those involved and trying to follow the guidelines set forth before them. Christopher 's Episcopal Church has been notified of the intention of DePauw University/Eariham University and Leeper Electric Company to seek a rezoning of a 4 .066 acre parcel of real estate located East of and adjacent to U.S. 31 and North of and adjacent Main Street ( 131st Street) . I oppose this petition to a change of the zoning ordinance from S. 2 Residencial to B-2 Business District Classification, since this property directly joins the property of my church, St . Christopher ' s Episcopal Church, 1440 W. Main St . The intended zoning change will , I believe, violate the intention of the Meridian Corrider Overlay; by introducing a "retail" center virtually 'on' the highway; bringing increased traffic, including heavy-duty trucks and ancillary noise and pollution to a residential area. Additionally, St . Christopher 's was recently given permission by the Zoning Commission, and is in process of completing a memorial garden-columbarium for prayer and interment of the mortal remains of beloved members, outside, immediately next to the proposed retail center. Within the St . Christopher ' s property a Montessori School is operated for pre-school children. The zoning change would give rise to additional traffic and would constitute an 'attractive nuisance' to the children, when playing outside, and place a burden on the teachers to keep the children from wandering onto the DePauw/Earlham/Leeper property to avoid possible injury. I know of no other business in Carmel operating this near a 'school ' facility. As a parishioner of St . Christopher 's, I believe this proposed development to be incompatible with our worship and with the present nature of the neighborhood. As both a resident of Carmel and a member of St. Christopher's Episcopal Church, I oppose the petition for a change of the zoning ordinate from Residence (S2) to Business (B2), since the property in question directly joins the property of my church. The proposed rezoning would result in a retail center located virtually on the highway, increased traffic, including heavy-duty trucks as well as other noise and pollution to a residential area. In addition, St. Christopher's was recently given permission by the Zoning Commission to build a memorial garden-columbarium for prayer and the interment of remains of members on a parcel of land immediately next to the proposed retail center. I am strongly opposed to the rezoning of the parcel of land. The proposed development is, I believe, incompatible with worship at St. Christopher's and the basic residential nature of the neighborhood. I urge you to dismiss the petition. Main Street in Cannel near the intersection of U.S. 31 and 131st Street. St. Christopher's Episcopal Church, as adjacent property owners,has been notified of the intention of Leeper Electric Company and Depauw University/Earlham University (Petitioners) to seek a rezoning of a 4.066 acre parcel of real estate located east of and adjacent to U.S. 31 and north of and adjacent to Main Street (131st Street). As the petition states, the Petitioners are seeking to change the zoning ordinance for this parcel from S-2 Residential District to B-2 Business District classification. I oppose this petition to change the zoning ordinance on this parcel adjacent to St. Christopher's Episcopal Church. I also believe that this petition also violates the intention of Section 23B-5 of the U.S. 31 Overlay Zone. The Petitioners seek a condition that would introduce a."retail" center: * virtually on the highway' and between the residential neighborhoods that are east and west of U.S. 31, along with the increase of light- and heavy-duty truck traffic, noise, and pollution on streets currently not constructed to handle the weights, sizes, and volume of traffic. In June of 1995, St. Christopher's Episcopal Church was given permission by the Cannel Board of Zoning Appeals to build a Memorial Garden Columbarium for the internment of the remains of deceased beloved members. This addition to the property of the Church provides a quiet and prayerful worship environment for the memorial of friends and relatives. I believe that the request of the Petitioners is incompatible with the present use of the Church property and the nature of the adjoining properties. It is our understanding that the intended use of this property, if rezoned, would be for a large retail center, to include a lighting store. The plan submitted shows a development which would (1) obscure the church and its property,(2) utilize virtually every available square foot of the property for parking and buildings, (3) increase traffic on Main Street since there is no Southbound access to this property and (4) introduce an active retail element into a presently residential and non- commercial area.
