It reads as follows: Section 3.7: Definitions; SUBDIVISION, Subsection 3: Any division (recorded after December 31, 1999) of a lot or other parcel of land where: (a) the division results in two (2) or more smaller lots or parcels, at least two (2) of which are less than five (5) acres in area; (b)the division results in two (2) or more smaller lots or parcels, any of which front on or utilize an easement of access; or (c) the division is for the purpose of building development (excluding cemeteries) and a street is to be dedicated,reserved, or otherwise platted. Subsection (a) of the definition is what causes the Marriott parcel to have to be platted if divided as you suggest. As for Section 23B.7: Minimum Tract Size; Subsection (d), which allows the division of tracts within the US 31 Overlay Zone into parcels smaller than five acres following Development Plan approval, the stipulation that, "...the development of the parcel must still conform...to all other v, ! 0 applicable requirements contained in the Zoning Ordinance," makes it clear that the ground is i. not excused from other required approvals by virtue of the Development Plan approval. Date: 05/30/00 Re: Residence Inn/Landscape Plan Review The following are comments/suggestions related to the landscape plan for the proposed Residence Inn on Pennsylvania Ave. in Carmel: 1. U.S. 31 Overlay Ordinance 23B.10.5 states:"Sites with existing trees or stands of trees should make reasonable efforts to protect and incorporate them into overall site design, including within greenbelt areas, plantings adjacent to buildings, and project buffering." There do not appear to be any plans to preserve any trees on this site. It seems as if at least the trees along Pennsylvania Street could be preserved. The developer should address any reasons that make tree preservation"unreasonable"at this site. 2. The PLANTING NOTES#4 states,"ALL PLANTS SHALL BEAR THE SAME RELATIONSHIP TO FINISHED GRADE AFTER INSTALLED AS THEY DID PRIOR TO BEING DUG." This statement should be changed to reflect that the root crowns of installed plant materials should be installed at or slightly above finish grade. Hopefully, this will eliminate the planting of materials that have arrived from the plant supplier with root crowns buried 4"to 6"deep in the ball. All plant materials should be checked on delivery to make sure that is not the case. 3. There appears to be a sewer line running from north to south parallel to Penn. Street beneath the proposed tree line. One manhole appears to be directly under a tree. These utility/tree conflicts should be resolved before approval. Trees should be located no closer than 10 feet to any manhole, hydrant,valve,or other utility structure. 4. It will be the responsibility of the owners to provide for maintenance of this landscaping project. A plan for such maintenance should be submitted and will be attached to this file. This plan should include but not be limited to irrigation/watering, removing any stakes or wiring, pruning, replacing dead plants, mulching,and scheduled date of final warranty inspection. 5. One of the tenets of a manageable and sustainable urban forest is biodiversity. Any one species should not make up any more than 15% of the total trees at a given location. While Sugar Maples are excellent trees, for diversity purposes substitutes should be made for about half of that species. We are continuing to experience a very active real estate market in our area. US 31 and areas nearby are getting much of the activity, including, but not limited to the Duke-weeks proposal at 1 465 and 31. We are doing our best to address local issues related to building projects along 31. John Myers and Steve Holder(of Parsons Brinkerhoff) have been working on a land use/transportation study for the 31 Corridor, as you already know. One particular area of concern to us is the interchange at 136th Street, in the area of St. Vincent's Carmel Hospital, and, particularly the recommendation for on-off ramping which utilizes a termination point of Oak Ridge Road which was part of the 1997 INDOT MIS. Because this recommendation severely impacts our local plans for an Illinois Street extension in this same area, we have asked PB to study this area and provide us with an alternative to the current recommendation that would result in a "win/win", which we would then present to you as our preference for implementation. A couple of weeks ago we met with Frank Regan, his attorney, Doug Church, and Mark Fialkowski to show them a preliminary sketch for one possible solution, which we feel has merit. I believe a copy of this sketch was given to Mark Fialkowski for discussion with you and your staff. If that has occurrred this is old information. I heard, second hand, that Mark saw merit with the ideas provided in the sketch. Hopefully you have seen them too and conclude the same. At the same time we are working on our transportation planning, a development proposal has been submitted for a new Hotel located in the northeast quadrant of 131st Street (Main St.) and U.S. 31. As our U.S. 31 Overlay Ordinance requires,requires,pe-petitioner)mtistreserve for acquisition by the State of Indiana all land that the State expects to need for to US Highway 31....an applicant must notify in writing the Commissioner of INDOT of any propo ed Development Plan that includes land within the projected right-of-way for those pending improvements."
