The owner cannot guarantee what type of dwelling unit will be built and that it will be owner occupied. . The use and value of the area adjacent to the property included in the variance will be affected in a substantially adverse manner because: The lot size reduction may aflow for the owner to build a duplex, which may adversely affect the established neighborhood of single-family homes. Future development of the lot, without design review, could be detrimental to the property values in the immediate area. , The strict application of the terms of the Zoning Ordinance to the property will not result in practical difficulties in the use of the property because: No practical difficulty results by not granting the variance. A house already exists on the lot. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. 05080038 V is denied, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
