FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE
The approval of this variance will be injurious to the public health, safety, morals and general welfare of the
community because:
The lot size reduction may aflow for the owner to build a duplex, which may adversely affect the established
neighborhood of single-family homes. The owner cannot guarantee what type of dwelling unit will be built and
that it will be owner occupied.

The use and value of the area adjacent to the property included in the variance will be affected in a
substantially adverse manner because:
The lot size reduction may aflow for the owner to build a duplex, which may adversely affect the established
neighborhood of single-family homes. Future development of the lot, without design review, could be
detrimental to the property values in the immediate area.

The strict application of the terms of the Zoning Ordinance to the property will not result in practical
difficulties in the use of the property because:
No practical difficulty results by not granting the variance. A house already exists on the lot.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. 05080038 V is denied, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
