DEPARTMENT REPORT June 29, 2005 Docket No. 05060036 SW: Cherry Creek Estates SC 7.00.01 Waiver to allow dwellings to have less than 6 foot in separation. The site is located on Colville Circle (south of Cherry Creek Blvd) and is zoned S 1/Residential. Filed by Larry Kemper of Nelson and Frankenberger for Pulte Homes of Indiana, LLC. The petitioner seeks relief from the Subdivision Control standard that requires structures to be separated by at least 6 feet. Due to construction error, the distance between the dwellings on lots 132 and 133 is only 5' 7" at their rear comer. The Department recommends that the Plan Commission approve the Subdivision Waiver request. Additional Note' Written findings are required for action on the waiver request. The applicant shall present these to the Commission at the meeting prior to approval.
