Special Meeting

The Special Meeting of the Carmel Plan Commission met at 5:30 PM in the Caucus Rooms of City
Hall, Cannel, Indiana.
Members present were: Jerry Chomanczuk; Leo Dierckman; Dan Dutcher; Dianna Knoll; Mark
Rattermann; Nicholas Rhoad; and Steve Stromquist, thereby establishing a quorum.

Docket No. 05060036 SW Cherry Creek Estates: SC 7.00.01 Waiver to allow
dwellings to have less than 6 foot in separation. The site is located on Colville Circle
(south of Cherry Creek Blvd) and is zoned S 1/Residential.
Filed by Larry Kemper of Nelson and Frankenberger for Pulte Homes of Indiana,
LLC.
Present for Petitioner: Larry Kemper, attorney, Nelson & Frankenberger; Dave Compton, Director
of Land Acquisition, Joe Hutchinson, Greg Starkey, and Tom Fitzpatrick, Pulte Homes.
The Residential Open Space Ordinance requires that dwellings be separated by a minimum of 6 feet.
Lots 132 and 133 are the affected lots. At the closest point of separation, there are 5.7 feet
separating the two homes--actually 5.8 1/3 feet. A waiver is requested to allow tess than 6 feet in
separation.
During the building/inspection process, the violation was revealed when Pulte was applying for a
Certificate of Occupancy for the homes. While Platinum Properties was going through the primary
platting process, Pulte was finalizing the plans for the empty-nester/active adult product. This
product offers larger homes with sunrooms, decks, larger basements, and bay windows. This
information was not available to Platinum at the primary platting stage. Due to its larger size, the
home is a tight fit on the lot and Pulte must be very exact in terms of laying the foundation for each
home on those lots where the larger, empty-nester homes are constructed. In this particular case, a
small portion of the foundation and exterior wall of the home on Lot 132 encroaches into the 6-foot
minimum dwelling separation requirement by about 3 2/3 inches.
The error was an honest mistake rather than a calculated one. In order to correct this mistake, Pulte

would incur a significant expense and hardship. The granting of this Waiver would not injure
public health, safety and welfare.
Members of the public were invited to speak in favor or opposition to the petition; no one appeared
and the public hearing was closed.
Department Comments, Matt Griffin noted that the petitioner met the State requirement of 10 days
publication notice, but not the 25-days required under the Plan Commission Rules of Procedure.
Mark Rattermann made formal motion to suspend the Rules of Procedure in order to vote on this
Docket this evening, seconded by Dianna Knoll, Approved 6-0.
