2. Docket No. 108-00 PP; Long Branch Estates
Petitioner requests approval to plat 150 lots on 119.6+-acres. The site is located on the northwest corner of
West 116th Street and Shelborne Road. The site is zoned S-1/residence and is being developed as a
Qualifying Subdivision under Chapter 7 of the Subdivision Control Ordinance(ROSO). The petitioner also
seeks approval of the following Subdivision Waivers:
108-00a SW SCO 6.3.3 to forego a stub street connection to adjoining property
108-00b SW SCO 6.3.7 to plat a cul-de-sac greater than 600 feet in length
108-OOc SW SCO 7.7(D)(6)to clear more than 30%of young woodlands on site
108-OOd SW SCO 7.7(D)(8)to clear more than 15%of steep slopes on site

Tim Ochs, attorney with Ice,Miller,Donadio&Ryan,Indianapolis,appeared before the Committee representing the
petitioner. Mr. Ochs reported that since the October Plan Commission meeting,the petitioner has met with staff.
Mr. Ochs referred to page 3 of a draft prepared subsequent to that meeting regarding section 4. Scott Brewer,Urban
Forester,has requested and the petitioner has made some minor changes involving the cutting or clearing of trees,
earth-moving/grading. In paragraph two there is a deletion of the word"dying."
By way of explanation,the petitioner said this project was previously passed back to the Plan Commission with a 7-0
vote. There have been discussions with staff following the Plan Commission hearing in October.
Mr. Houck and Marilyn Anderson both expressed concern about the traffic study, and the inconsistency with
county studies on 116th and 121'Streets.
Mr.Houck read from a handout presented this evening regarding traffic. The committee feels there are deficiencies.
The study does not include the intersection at Shelborne Road at 116th and 121St. The petitioner said he did not feel
the impact of this subdivision will be that great, and acknowledged he did not look at a lot of scenarios. There was
some discussion about exiting the subdivision on either 116th or 121"Streets heading toward either Michigan Road or
Shelborne Road. Ms. Anderson acknowledged that perhaps a level C will be achieved once 116th and Shelbome
Road is improved,but the question is when will that happen?
Steve Fehribach said there are options,and several scenarios were analyzed to see what was the best design.
Acceptable is Level of Service C in Carmel,however,the County is acceptable at Level of Service D. There are
options,and they ended up dedicating enough ground for a roundabout, in case the City annexes this area,or so the
county can improve the intersection. The petitioner is also willing to escrow funds for roadway improvements.
Ms.Anderson wants something in writing addressing 121"Street. Mr.Houck said his understanding was that 116th
and 121"Streets at Shelbome Road were to be addressed in the Traffic Analysis. Ron Houck suggested
incorporating the findings of the county study,thus giving the committee more detail on the anticipated levels of
service.
There are 150 lots proposed, and there is concern about persons exiting the subdivision onto 121St Street to head
toward Michigan Road.

Petitioner seeks approval to plat 110 lots on 36.7 acres. The site is located

southeast of the intersection of East 116 Street and South Guilford Road. The
site is zoned R-1/residence and is being developed as a Qualifying Subdivision
under Chapter 7 of the Subdivision Control Ordinance (ROSO).

Mr. Houck reviewed the outstanding items from the last meeting; namely, the covenants
and restrictions and a review by City Forester.
Mark Monroe, Land Use Planner with the Reis Law Firm spoke for the petitioner. He is
accompanied by Tadd Miller of Kosene and Kosene and Gary Weaver, Land Planner.
Since full Plan Commission review, the petitioner has made minor changes to the plans.
The petitioner believes all pertinent issues have been addressed, and revisions have been
