TECHNICAL ADVISORY COMMITTEE
APRIL 19, 2000

Emerald Crest at Hazel Dell Summit, Section 2 (56-00 SP/SU)
Petitioner seeks approval (Secondary Plat; Special Use) to plat 39 lots on 12.679 acres
and establish an amenity area within the project. The site is located northwest of East
st
131 Street and Hazel Dell Parkway. The site is zoned S-1/Residential (Low Intensity.)
Filed by Li Ching Wu of Davis Homes.
In attendance: LiChigWu and Stu Huckelberry of Davis Homes. Petitioner requesting
Secondary Plat and Special Use for Amenity area within Emerald Crest at Hazeldell
Summit; will include clubhouse, bathhouse, pool, and concrete decking on site formerly
common area on Section 1 & 2 plats. Project will incorporate parking, storm drainage
and sanitary sewer availability to bathhouse. Changes made to Construction Plans for
Sections 1 & 2 to accommodate amenity area

Laurence to review plat. Signs on site are without permits and currently in
violation--situation needs to be addressed.
Hazel Dell Corner Subdivsion (80-00 PP)
Petitioner seeks approval (Primary Plat) to plat 6 commercial lots on 14.738 acres. The

site is located on the northwest corner of East 131 Street and Hazel Dell Parkway. The
site is zoned B-3/Business.

Comments:
- Indiana Gas, Chuck Shupperd states no problem, gas on south side and can
serve. Curb cut on Hazel Dell--no problem with service.
- City Engineering, Dick Hill sent comment letter, Cort Crosby to respond.
Suggest petitioner meet with Kate because of curb cuts and path in area. Craig
Parks requests northern curb cut align with opposite side of parkway. Petitioner
reports no tenants at this time.
- Carmel Parks & Rec., John Lester requests confirmation that trail/greenway
continues to west of lot 2--does not show on drawings.
- County Surveyor, Steve Cash sent comment letter. Cort Crosby will respond.
Petitioner must apply for non-enforcement--lake is also in the easement; require
30 foot separation from top of bank of ditch to top of bank of pond to install a
walkway.
- County Soil & Water, John South sent comment letter. No major concerns--a lot
of topography on property--retaining walls would maximize use--suggest unified
plan for retaining wall usage. Erosion control--mass grading--preferable.
- DOCS, Laurence Lillig Sanitary line location--apparently shifted out of
easement because of alterations in ditch. Petitioner to remedy. As lots develop,
would like to see sidewalk with subdivision back to path due to increased
pedestrian activity from surrounding neighborhoods. When lot 6 is platted, lot 5
is to have same access point. Lot 4 may require Subdivision Waiver since it has
no roadway access--would be heard with Primary Plat.
Plum Creek Farms, Section 5 (66-00 SP)

located northeast of the intersection of East 126 Street and Hazel Dell Boulevard. The
site is zoned S-1/Residential (Low Intensity) and received Primary Plat approval under
the Cluster Ordinance.

- City Engineering, Dick Hill sent comment letter. Petitioner prefers sub-surface
drain; Craig Parks says underdrains would alleviate some future problems. Dick
Hill will consider peitioner's position. Temporary swale behind lots 197 through
200. Lots 189 & 188 should sheet drain to golf course and & 187 through 185

utilize swale. Request letter from John Duffy on sanitary sewer. Secondary plat is
now approved administratively rather than committee.
- County Surveyor's Office, Steve Cash says outlet request permit already being

Subdivider Agreement form needs to cite City standards rather than County. Visit
to site reveals problems with signage; temporary construction and model home
signs do not have permits--needs to be addressed.
- Carmel Engineering, Craig Park questions drainage calcs--utilizes detention
area? Cort says run both ways, makes very little difference.
North American Park, Lot 3 (PP Amend, DP/ADLS Amend)
Petitioner seeks approval (Primary Plat Amendment, Development Plan and Architectural
Design, Landscaping, Lighting & Signage) to establish an automobile dealership. The
site is located at 4102 West 96h Street. The site is zoned B-2/Business within the U.S.
421/Michigan Road Corridor Overlay Zone.

- County Surveyor's Office, Steve Cash did not send comment letter, site is
currently all impervious surface. Drains south to Marion County and by-passes
any regulated drain. No permit required. No additional detention required.
Currently detention area in North American Park on west side of site. No
additional comments regarding site.
- County Soil & Water, John South has only minor comments. Show inlet

protection around existing inlet on 96 Street prior to construction. Due to size of
project, NOI not required.

Overlay in mind. Key issue is landscaping on site. Signage on corner is in
violation and needs to be addressed. Petitioner says signage submitted with
ADLS. Plan Commission frowns on red signs and amount of illumination is a
concern. Big question is where right-of-way lines will be.
Carmel Oaks 79-00 Z
Petitioner seeks approval (Rezone) to establish a 72 unit independent living retirement

center on 5.00 acres. The site is located northeast of the intersection of East 116 Street
and South Guilford Road. The site is zoned R-1/Residential.

In attendance: Charlie Frankenberger, attorney, and Craig Witz on behalf of Essex Corp.
Petitioner is requesting rezone from R-1 to B-6 for independent retirement center. Real

estate is north of 116 Street and east of Guilford, opposite Lenox Trace. Land is not
currently annexed, petitioner has no objection to annexation. Sewer availability is a
concern. Property currently served by Clay Regional Waste. Petitioner will appear
before Plan Commission on 5-16.

City Utilities, Paul Pace states Clay Waste is more expensive than Carmel
Utilities--Carmel can service.
- Indiana Gas, Chuck Shupperd, gas main in front of Lenox Trace, can run
service--requests loads for sizing.
- County Highway, Steve Broermann--comments depend on annexation.
Petitioner says will annex--will confirm. If not annexed, will still need
construction drawings. Will talk to Dick Hill--cannot take one half of the road.
Typically, would like to see purchase of right-of-way on south side to provide for
deceleration lane at entrance.
- County Surveyor's Office, Steve Cash has no comment regarding re-zone.
Needs plans--at construction level, Plan Commission approval will need two
permits, one for Fertig drain and banks--top of banks to top of banks flow lines to
be better defined. Require non-enforcement that allows encroachment on
drainage easement. Not a problem as long as 30 foot separation from top of bank
to top of open drain. Will send comment letter.
- County Soil & Water, John South sent comment letter. No objections, sewer &
water availability are main items of concern. Petitioner says will have public
utilities. No problems. Existing plan protects flood plain and existing trees--looks
like a good layout.
- Ameritech, Greg Cammack requests set of construction plans. Will service from
west side of Guilford. One building, one mechanical room.
- Carmel Fire Dept., Jace Platt -- building to be sprinklered, each unit has own
door with common area. Requests knocksbox to common area. Parking? Sub-
surface garage, two elevators.
- Communications, Bill Akers states one address for each building, each unit will
have separate number.

- DOCS, Laurence Lillig states site plan shows sidewalk extending into driveway.
Sidewalk extends to south property line along Guilford Road. Building extends
into drain. Steve Cash says need 'Consent to Encroach" in Drainage Easement.
Question on center of right of way--looks like a 45 foot half; typo in letter, legal
description recites North Guilford rather than South Guilford. Total population
maximum 100 persons.
Maebeck Commons Subdivision (12-00 PP)
The petitioner seeks approval to plat 109 lots on 61.468 acres. The site is located on the

northeast corner of West 141 Street and Towne Road. The site is zoned S-1 /Residential
(Very Low Intensity) and is being developed as a Qualifying Subdivision under ROSO.
The petitioner also seeks approval of the following Subdivision Waivers:
13-00 SW SCO 6.5.1 to plat lots with less than 50 feet of road frontage
12-00bSW SCO 6.4.1 to plat a residential block in excess of 5900 feet in length

- Indiana Gas, Chuck Shupperd says will connect gas into Maebeck at time of
Saddlebrook installation.
- County Highway, Steve Broermann says has been working with Steve Pittman
extensively on this and will continue. Towne Road second entrance?--left at the
sole discretion of the Department Director per L.Lillig.
- County Surveyor, Steve Cash, sent comment letter, phases expected to be
addressed at construction level.
- County Soil & Water, John South says elimination of pond at south end is an
improvement. Not crazy about site plan at north end to existing drainage way--
would need to be re-located. Construction plans to identify?
- Ameritech, Greg Cammack says out of his area
- Carmel Fire, Jace Platt no comment
- Communications, Bill Akers suggest one street name for north close to north
entrance; one street name for second entrance. At the "T" suggest name Mustang
Chase east/west from Saddlebrook.
- DOCS, Laurence Lillig, lots number 105. Requests landscape plan & internal
pathway and easements. Will submit complete comments at later date. Will
probably construct in two sections.
Springwood Subdivision (72-00 SP)
The petitioner seeks approval (Secondary Plat) to plat 6 residential lots on 13.13 acres.

Road. The site is zoned S-2/esidential and is being developed as a Non-Qualifying
Subdivision under ROSO.

In attendance: Duke Haley of SCM Development, Greg Rasmussen of Weihe Engineers,
Inc. Petitioner in the process of finalizing construction plans and plats--will resubmit to
County Highway. Will resubmit final erosion control plan--letter will be submitted for
NOI tomorrow. Road has been shifted to avoid 36 inch Red Oak Tree on site, Lots 4 & 5
will be modified accordingly. Drainage patterns remain the same.
Comments:
- Indiana Gas, Chuck Shupperd has not seen plans; 8 inch main at entrance.
Chuck requests plans or CAD drawings.
- County Highway, Steve Broermann, street to be curbed (roll on perimeter--
interior chair-back), street width 18 feet; lots platted to one foot behind curb.
Steve Broermann has not received construction plans. Proposed 50 foot right-of-
way. "Maintenance of Private Street" contract to be submitted to County
Highway with Secondary Plat.
- County Surveyor's Office, Steve Cash has meeting with petitioner on Monday,
requests construction plans--will comment after meeting.
- County Soil & Water, John South needs construction plans in order to comment.
- Ameritech, Greg Cammack needs construction plans
- Carmel Fire, Jace Platt confirms gated entrance and exit; requests knocksbox for
emergency access. Request width adequate for fire truck (18 feet in width.)

Will be addressed off of Spring Mill Road.
- DOCS, Laurence Lillig requests plans for Secondary Plat and Construction
Plans. Requests Subdivider agreement, water, sanitary and storm report, etc.
Will send letter summarizing missing material. Need details of construction of
wall--materials, etc. Any wall taller than 42 inches requires variance from BZA.

Homes on lots 1 and 6--Ordinance requires front yards to be oriented toward 106
Street--waiver of that requirement would require Plan Commission approval.
Laurence will prepare letter regarding Secondary Plat and filing requirements.
Private Drive entrance permit--petitioner to contact Dave Lucas at County
Highway--will need to see plans.
West Carmel Center, Block D (Target Inc.) (73-00 DP/ADLS, 96-99 SP)
The petitioner seeks approval to construct three retail buildings on 26.060 acres. The site

is located southeast of 106 Street and U.S. 421. The site is zoned B-3/Business and is
located within the U.S. 421/ Michigan Road Overlay Zone.

Developer of project is Glendale Partners, Kevin McKasson contact. Site was previously
considered for a Meijer store.
Comments:
- Indiana Gas, Chuck Shupperd states gas already available and can serve.
- County Highway, Steve Broermann sent comment letters. Big issue is street
width at entrance off 421. County is requesting two, 12 foot lanes with 16 foot,

paved median. Also, entrance at southern end of project is off-set--County
Engineer will not allow--needs to be moved 200 feet. Request decel lane at
entrance to north; variance would be needed for entrance, but County Highway
would support. Petitioner would need to contact County Commissioners for
formal request. Letter of request to be sent to Highway Dept. by petitioner
explaining intent.
- County Surveyor, Steve Cash has reviewed plan, did not send comment letter--
will follow tomorrow. Similar comments to Block A. Storm sewer serving roads
to be petitioned. Pipe under curb to be moved. Landscape plan shows some
conflict with storm sewers--double check with plan--drain is arm to Crooked
Creek drain.
- County Soil & Water, John South sent comment letter. New road will infringe
on existing pond -- need to reconfigure pond and show on plans. Entrance on 421
blocks drainage. Silt fencing not adequate on west and south sides—consider
different measure. Show construction entrance.
- Ameritech, Greg Cammack states design engineer will work with petitioner.
- Carmel Fire, Jace Platt states if buildings to be sprinklered, petitioner to meet to
discuss connection. Request knocksbox, petitioner to comply.
- Communications, Bill Akers states Blocks A & D addressed, not block C.
- Panhandle Eastern Pipeline, Mark Wood states concern regarding easement--
error in survey. Panhandle under impression site would be re-surveyed.
Petitioner to contact---lines to be located. Petitioner to re-write description and
send to Panhandle. Would be best to describe entire development.
- DOCS, Laurence Lillig questions exit on 421--accel/decel? Curb cuts already
approved. Project to go next spring and will integrate into INDOT's plans.
Intersection to be squared. Commerce Drive not aligned with what is showing to
the north. Petitioner will look at. Carmel Thoroughfare Plan calls for Commerce
Drive to be secondary arterial with 90 feet of right-of-way. Alternative
Transportation Plan requires 8 foot asphalt paths on either side of secondary
thoroughfares in lieu of sidewalk. Laurence
Lillig will send review letter on 421 Overlay Requirements.
English Oaks Subdivision (74-00 SP)
The petitioner seeks approval for 27 residential lots on 21.39+ acres. The site is located

northeast of West 106 Street and Shelborne Road. The site is zoned S-1/residential
(Very Low Intensity) and is being developed as a Non-qualifying Subdivision under
ROSO. Filed by Joseph Sharp of Paul I. Cripe, Inc. for Deylen Development.
Joe Sharp of Paul I. Cripe and Craig Van Deylen and Phil Thrasher of Deylen
Development attended the meeting. Mr. Sharp has received letters from the Carmel
Police Fire District, the County Highway Department, and the Clay Township Regional
Waste District. There are no comments to which the petitions are unwilling or unable to
respond. Mr. Broermann, Highway Department, wants more entrance detail. Regional
Waste has only minor corrections to be noted on the plans. Police and Fire Departments
have no problems. The School District wants a larger turn radius on the streets. Mr.

Sharp has no dispute with this. Laurence Lillig stated the school has never pushed that
issue. Joe Sharp said better entrance detail will be provided and the heavier pavement on
Shelborne Road will be indicated on the plans.
Chuck Supperd, Indiana Gas, stated gas lines have been established in the area. He will
deliver the conduit and Joe Sharp will mark where the crossings will be located. Service
is needed by June 1.
Steve Broermann, Hamilton County Highway Department, inquired about the turn around
at the end of the street. Joe Sharp stated it is intended to be a thru street. Initially it will
serve as parking space for the pond area and allows turning on the long street. This is not
a right of way; it is the common area. Joe Sharp stated a roll curve will be constructed.
This is Mr. Broermann’s preference. Construction is schedule for a week or two prior to
June 1. Steve Broermann will send a construction inspection agreement to Paul I. Cripe.
John Lester, Parks & Recreation, had no problem with the plans. A 10-foot wide
walkway will be provided.
Steve Cash, Hamilton County Highway Department, stated the storm sewers are county
regulated drains. He will have a letter prepared after tomorrow’s review. The project will
not be permitted to outlet into the right of way. There is 150 feet of street without
subsurface drain. There are no inlets at the radius; there is a culvert that runs north to
detention at another location. Joe Sharp stated the storm sewers cannot be made deeper.
Phil Thraser said there is a storm drain that ends at a bee hive at Bridleborne Road. It is
in an easement. Since only a subsurface drain extends for a short distance, there is not a
great amount of water. The gutter outlets into the surface swale. Steve Broermann
stated this has not been allowed. Steve Cash thinks there is capacity in Bridleborne
Subdivision. It was designed for a greater amount of water. The problem is farther down
on the John Osborne drain. Joe Sharps believes the biggest problem is storm water at the
end of the project. Steve Broermann wants to eliminate turn outs and will speak with Les
Locke about the matter.
John South, Hamilton County Soil & Water Conservation, questioned the drainage on lot
25 that buts up against the drainage easement. He believes a swale is needed there. The
plan is to sheet drain the area. The area is quite flat and the same situation exists for lots
1 and 2. A swale could be used to take water to the lake. There is an error in the grade
indication between lots 6 and 7. Also the southwest corner of lot 13 is rather flat. Joe
Sharp will adjust these. There will be a swale between lots 9 and 10 to take water down
to the pond. Mr. South is concerned that when construction starts there will not much to
stop storm water flow. Some heavy-duty inlet protection is needed. A sediment trap or
basin is preferable. Joe Sharp stated the area near the pond will be swaled. They do not
intend to dump water off.
Greg Commack, Ameritech, asked if any development is planned directly south of the
Greek Orthodox Church. The area is low and will only be a stub street.

Laurence Lillig inquired about permanent signage. Temporary signage will be requested
in the near future. The final landscape plan for this section has been received. It is the
same as the primary plan. Some plantings were taken out of the Shell pipeline.
Laurence Lillig asked for a set of corrected construction plans that addresses the
comments of any TAC members not in attendance. Building permits will be issued once
their final version of the secondary plat is signed and received. DOCS requires paper and
mylar copies. Steve Cash will list any bonding required in his letter to Paul I. Cripe.
Letters of credit are needed for the Highway and Surveyor’s offices.
Cheswick Place, Section 2, Lot 85 (V-20-00)
The petitioner seeks approval (Developmental Standards Variance) to construct a pool
encroaching into a platted easement. The site is located at 13678 Frenchman’s Creek.
The site is zoned S-1/residental (Very Low Intensity). Filed by Majorie A. Mikels of
Pools of Fun for Robert W. & Barbara A. Mackay.
Bruce Holmes attended the TAC meeting for the petitioner. Laurence Lillig explained
his presence at this meeting was requested as the petitioner wants to encroach upon a
drainage easement. This residence is on Lot 85 in Cheswick Subdivision. Mr. Holmes
distributed copies of the plot plan. Considering where the house is situated and the
elevations, the proposed pool location is the most reasonable and most safe for the
owners’ children. The pool concrete is eight feet from the property line. It is not
possible to move the pool to the right or left. Hamilton County Surveyor, Steve Cash,
has received a non-enforcement form for the County. He stated his main requirement is a
15 foot separation from the top bank of the pond to the edge of the proposed structure.
Mr. Holmes agreed this is a reasonable request. The case will be heard at the May 22,
2000 BZA meeting.
Remco Facilty (Site Plan)
The petitioner seeks approval (Site Plan) to construct a new 26,821 square-foot

warehouse on 6.7+ acres. The site is located at 4735 West 106 Street. The site is zoned
I-l/industrial. Filed by Kenneth Turner of Mid-States Engineering for Garrison
Enterprises, LLC.
Ken Turner and Chad Karam, Mid States Engineering, and Sean Boyle, Peterson

Architecture, attended the meeting. The project is near 106 Street. The proposed
warehouse will be 26,000 square feet in size and used for storing plastics. An office area
will be on the second floor. This class A commodity will have a sprinkler system as
required by code. Handicap accessibility will be met. The exterior has a Georgian
architecture look. Garrison Enterprises wants to be a good corporate neighbor.

Chuck Shupperd, Indiana Gas, indicated there is a gas line at 106 Street. He directed
the petitioner to the appropriate Gas Company representative.

Steve Broermann, Highway Department, had no comments.
Steve Cash, Surveyor’s Office, mailed a letter regarding this case on April 6, 2000. He
needs an outlet request permit and drainage calculations need to be addressed. Chad
Karam has those now. Mr. Cash inquired whether there is an easement on the property
line granted by Golf Insurance. It is believed that Garrison leases land to Golf Insurance.
The site next to this one has a large ditch. It may have been there before. There is a 5-

foot easement that might not be shown but is on site near the south end of 103 Street.
Steve Cash stated this might not affect what they are proposing at this time but should
checked.
John South, Soil and Water, stated his comments are being addressed. There is a new
erosion control plan, riprap has been extended, and there is seeding on the west side of
the building. Chad Karam will leave one set of plans with John South.
Greg Commack, Ameritech, requested another set of plans. Sean Boyle will provide

Bill Akers, Carmel Communications, questioned the address being used. The number
4735 is in Boone County. The cut off for Clay Township is 4600. Ken Turner will check

Oldsmobile Inc. The petitioner hopes to operate their automobile business at the site of
Dellen Lincoln Olds. The property consists of two parcels totaling 14 acres located north

of 96 Street and east of Lakeshore Drive. The addresses used by the dealership are 4100

and 4140 East 96 Street. This case involves two requests. An amendment to alter the
front exterior of the buildings is needed. An open drain will be covered with a parking
area. And, a sign variance is requested. The petitioner wishes to replace signage. This

matter will again be heard at the May 17 TAC meeting. Laurence Lillig suggested Jim
Shinaver prepare plans to show the drain proposal.

Laurence Lillig believes there may be outstanding sign violations that may include

banners attached to pillars and red/white/blue used car flags. Signage on 96 Street may
not have permits. The Harley Davidson Division on the property recently had a banner.
Currently, there is a trailer in violation of the ordinance. It is too close to property lines.
Mr. Shinaver said his firm intends to take care of these violations. Fee payment will be
made.
