Jim,
You will need a variance from the following:
23 E.07 (A)(1)(a): Parking Area Landscaping.
Staff feels that given the constraints of the site, providing these required bufferyards and plantings would limit the
development, contrary to the intent of the ordinance. Your client will still be required to meet the Home Place
Overlay Low Intensity Commercial Corridor Buffer Yard Standards - 23 E.09 (G)(1). Staff feels that these
standards (which require a greater degree of plantings than the parking area standards) will serve the site
adequately. As a point of note, the properties to the north and south will eventually be developed in similar ways
(at least that is the intent of the overlay zone). If this issue comes up in future redevelopment projects in this
overlay area, staff would consider amending the ordinance to help achieve the intent, without the need for
variance. Given that this is the first conversion of properties in this overlay area (the Home Place Low Intensity
Commercial Overlay), we feel that is it wise to have your client to seek variance, affording us the opportunity to
monitor future development in this area before considering an ordinance amendment.
I would advise seeking this variance after the rezone of the property is finalized. There is no need is spending
money for a variance if the rezone is not approved.
