The applicant seeks the following development standards variance:
Docket No. 05080030 V ZO Chapter 23E.07.A.l.a Parking Area Landscaping
The site is located at 10400 Block of N Delaware/Pennsylvania Streets and is zoned R-1 & R-3
Residence, partly within the West Home Place Commercial Corridor Overlay.

General Info:
The petitioner is seeking variance approval from the
Home Place Low Intensity Corridor bufferyard
standards. The rezone and site plan have been
approved by the Plan Commission and City
Council. The City's Urban Forester has also
reviewed the landscape plan.
Analysis'.
Landscaping will be installed, but due to the site
size, the requirements of' the Home Place Overlay
cannot be met. Thc approved a landscape plan meets
the perimeter buffer yard requirements of' the
Ordinance. The petitioner has worked with the
Urban Forester to produce an approved landscape
plan.
Findings of Fact:
The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because: the site will still be landscaped substantially.
The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because:
the site will still be landscaped substantially.
The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because'
the owner may not be able to achieve properly landscaped areas and will have to reconfigure
the site plan, possibly losing parking spaces or building area, possibly causing a hardship or
rendering the site undevelopable.
Recommendation.
The department recommends positive consideration of Docket Nos. 05080030 V.
