Attached is a PDF depicting a proposed addition to an existing residential style parking
garage located in Woodland Springs Manor Apartments at 3008 Warren Way Carmel Indiana 46033.
Our client hopes to replace a two stall garage which was recently demolished with an addition
to the existing adjacent garage as depicted in the attached preliminary drawing. This garage
addition is proposed as a replacement to an existing two stall garage which was demolished as
a part of the Keystone Avenue reconstruction project. Construction and design is intended to
match existing.
Any preliminary thoughts on the attached would be welcome. What type of permitting
requirements will be required for an addition of this scope? We understand that at minimum
an application for an Improvement location permit will be required. Please do not hesitate
to call or e-mail with questions, thoughts or concerns.
Also,
We are looking for a recent copy of a survey or construction plans with new ROW and easement
information for Keystone Avenue and 116th street. Would planning and zoning or the
engineering department have drawings they could share?

I went to the site yesterday to look around. As you can see -From the pictures Woodland
Springs is going through active construction in several places, most prominently along
Keystone Ave. While I have no objections to the building of the garage, I think it is time
to sit down and discuss Woodland Springs landscape plan and what can be added as a need to
buffer for the residents and the continued value/benefits that maintaining and replacing
trees and plant material can provide for the complex. Can you arrange such a meeting with
owners of their representatives?
There are several areas where trees could be planted that would enhance this building
project, buffer Keystone, and add value to the complex, if we can agree to them.

We are in the process of submitting for a construction permit @ Woodland Springs Manor
Apartment in which we are adding a (2) car resident garage to an existing (3) car unit. Trudy
emailed me list of items that needed to be completed including (3) sets of landscape drawings
that need to go to you. I spoke with the architect today and we are not doing any landscape
work other than maybe some grass seed. I have attached a set of drawings for you to look at,
but the permit group on the first floor said we needed to touch base with you on this issue
before we can proceed.

I've attached a draft of the Answers to the First Requests for Admission (the "Answers"). Please
take a look at the Answers and let me know if you're in agreement with how I've responded.
I've also attached the definition for illegal, nonconforming use. I've read the definition many times
now, and it doesn't seem to fit with how Bush Development is trying to use it in the Requests
numbered 6, 7, and 8. An illegal nonconforming use seems to be a use that does not comply with
the ordinance in effect now or the ordinance that was in effect when the use was established. It
doesn't really address a situation where a road is widened such that an improvement violates a
setback requirement. In any event, let me know if you feel differently.

CITY OF CARMEL ZONING ORDINANCE
TRUCK STOP. A facility intended to provide services to the trucking industry, including but not limited to the following
activities: dispensing of fuel,repair shops,automated washes,restaurants,and motels;all as part of the facility.
TURNAROUND. A space on private property that permits the turning around of any passenger vehicle without the
necessity of using any public Right-of-way to turn around.
