The applicant seeks the following development standards variances on 29 lots:
Docket No. 05080044 V ZO Chapter 26.02.07(B) setback for side-load garages
The site is located south of Laura Visa Drive stub, east of SR 431.
The site is zoned RI/Residence, partly within the US 431 Overlay.

General Info:
The petitioner is seeking variance
approval for 29 residential lots to have a
15-ft garage setback, rather than a 25-fi
garage setback for attached side load
garages.
Analysis:
The driveway will allow for the parking
of 2 vehicles to not encroach into the
sidewalk area. The garage setback
reduction goes along with creating
character for this neighborhood, the tree
reservation areas, with homes closer to
the street and with side-load garages,
rather than fi'ont-load garages. The
proposed garage setback will be reduced
by 10 feet, to go from a 25-ft garage
setback to a 15-fi setback.
Findings of Fact:
1.) The approval of this variance will not be injurious to the public health, safety, morals,
and general welfare of the community because: the lots will have a garage setback line
reduction of 1 O-ft. Even if vehicles are parking in the driveway, they will not impede on the
sidewalk area.

The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because'

The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because:
the homes, as designed, will not be able to be situated on the lots, possibly causing a hardship
with building footprint redesign, and possibly imposing front load garages on the site, which
may affect the character of the neighborhood.
Recommendation:
The department recommends positive consideration of Docket Nos. 05080044 V.
