OF COMMUNITY SERVICES Mike Hollibaugh, Director Jon Dobosiewicz John Molitor, Legal Counsel Greg Sovas, Spectra Environmental Group Kingswood Homeowners Association represented by Bill McEvoy, HOA President Tom Yedlick, Kingswood Homeowner, individually Numerous Kingswood Homeowners Martin Marietta represented by Zeff Weiss, Attorney Dianna Knoll announced that the Committee would meet for two hours only. This special meeting is in addition to the regular Committee meeting for the month. The following items were considered: 1. Docket No. 177-02 OA, 178-02 CPA Amendment to the Carmel/Clay Zoning Ordinance & Comprehensive Plan - Mineral Extraction District The petitioner seeks to add a new zoning district to the Zoning Ordinance. The Ordinance is a “work in progress” and will take several meetings and a lot of “homework.” Zoning Ordinance The proposed will create a framework for the zoning of land area for prospective mining operations as well as establish a development plan process for areas zoned Mineral Extraction District (ME-1). Mining Ordinance The proposed is intended to regulate existing operations in addition to any new mining operations that will be sited in accordance with the proposed Zoning Ordinance. The proposed Mining Ordinance is based upon existing State laws and regulations. The Zoning Ordinance from Boone County, Kentucky was referred to and discussed as a reference and comparison. There are land use considerations as well as environmental considerations. The Boone County ordinance requires a 3,000-foot setback for stone mining. Kingswood would like to see a similar provision in the proposed ordinance for Carmel. Ideally, the homeowners would prefer that open pit stone extraction be excluded from the permitted uses in the proposed ordinance. The overwhelming issue with the Kingswood Homeowners is the adverse impact of blasting already being experienced in the Kingswood Subdivision. It is particularly important that those homeowners adjacent to the Martin-Marietta property be kept informed of meetings so that they will have input regarding the proposed Mineral Extraction District Ordinance. At this time, public input was permitted and the following persons appeared: Bill McEvoy, 5120 Williams Circle, president of Kingswood HOA acknowledged the City’s efforts in proposing the Mineral Extraction District and the Zoning Ordinance. Diane Cole, 4979 Williams Drive, Kingswood resident with a masters degree in Environmental Engineering, expressed concern with the mining operation and how it affects the environment and the environmental impact on existing aquifers, ground water, existing wells and water source, noise and air pollution. Larry Kane, Kingswood resident and Environmental Attorney offered some comments on mining policies. We appreciate the City’s efforts and comprehensive policies, and offered some suggestions on the proposed ordinance and expanded on environmental comments stated earlier by Diane Cole. Jennifer Rodriguez, 10575 Power Place, Williamson Run, was concerned about the buffer between the mining operation and residential and the impact that the mining and blasting has on adjacent residential. Please consider how it is today, before it is “set in stone” and the setback can be mutually agreeable and beneficial for the residents as well as the mining operation. The mining greatly impacts the quality of life and the ability to sell homes in the area. Setbacks are extremely important. Phil Kincaid, 5000 Huntington Drive, Kingswood, had three points. Resented remarks that persons buying in an area should make themselves aware of the zoning and current situations. Mr. Kincaid said he knew the mine was there when in moved, but also knew it was zoned residential and never dreamed the mine would be expanding into his back yard. Secondly, losses incurred by homeowners should be considered—there is no question that the property values in Kingswood have declined. Thirdly, it is not only Kingswood that is affected by the mining operation but other subdivisions as well. 2 S:\\PlanCommission\\Minutes\\SpecialStudiesCommittee\\2003\\SS\\2003feb25MineralExtraction ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 Kelly Helgo, 4990 Kingswood Drive, representing Jeff Anderson, HOA president of Sycamore Farm, agreed with remarks by Phil Kincaid—Sycamore Farm Subdivision is affected as well as Kingswood and Williamson Run. Mr. Anderson individually as well as the Sycamore Farm Board and homeowners fully endorse the Mining Ordinance and the changes that Kingswood has proposed on the mining ordinance as not only a positive for the neighboring subdivisions but all subdivisions in Carmel. At this time, Dianna Knoll encouraged all members of the public to put their comments in writing and submit them to the secretary of the Plan Commission prior to the next Committee meeting in March. 2. Docket No. 150-02b OA; Amendments to the Carmel/Clay Zoning Ordinance – Patch #4 The petitioner seeks to add new provisions to and make several corrective amendments to the Zoning Ordinance. Filed by the Department of Community Services.
