MINUTES
The regularly scheduled meeting of the Carmel/Clay Special Study Committee met February 4,
2003 in the Caucus Rooms of City Hall.
Members in attendance: Jerry Chomanczuk; Dan Dutcher; Ron Houck; Nick Kestner; Dianna Knoll;
and Wayne Wilson.
Laurence Lillig attended the meeting on behalf of the Department of Community Services.
Dianna Knoll was elected chairperson of the Committee by Unanimous Consent.
Docket No. 140-02 DP Amend/ADLS Amend; Motorcycles of Indianapolis (ADLS

The applicant seeks Amended Development Plan and ALDS approval o construct building
th
additions. The site is located at 4146 East 96 Street. The site is zoned B-3/Business.

Bill Keller of KES Consultants, Inc. appeared before the Committee representing the applicant. Russ
Dellen, owner of Motorcycles of Indianapolis was also present.
The plan was originally presented in November to the full Commission and was subsequently reviewed
by the Special Study Committee in December and January. The Development Plan was approved by the
full Commission in January and the ADLS portion was returned to the Committee for additional review
and consideration.
The front of the building has three curvilinear canopies on the south side and one on the west side. The
detailed landscape plan along the front portion of the building was reviewed by the Committee in
December and remains intact.
An alternative plan for the arched canopies was discussed. Everything currently in existence on the front
of the building will be removed and replaced with new construction. The proposal was for columns 9 or
10 feet high, with a steel column in the center supporting the curvilinear canopy at the top. The top of the
column is capped with masonry.

The number of curved canopies has been reduced to two: one on the west side and one main center. The
canopies currently in existence are squared off and in order to give the building a little feature, the new
ones will be curved to soften the look. The posts will be eliminated and the blocks will be taken all the
way to the top of the columns. The steel posts are approximately 8 inches in diameter, but could even
be 12 inches in diameter.

Laurence Lillig reported that at the January 27 meeting of the Board of Zoning Appeals, the setback
variance was approved for the addition on the east side of this building. The landscape plan is currently
being recommended for approval, subject to the Urban Forester’s approval. The petitioner still needs to
deal with the sign permit for the ground sign. Otherwise, the Department has no comment on the design
of the canopy other than to say whichever version is approved, copies of the revised elevation must be
submitted to the Department for its records.
Pat Rice suggested the front façade materials match the ground sign materials.
Ron Houck said he favored the columns that are continuous.

Amendment to the Carmel/Clay Zoning Ordinance & Comprehensive Plan -
Mineral Extraction District
The petitioner seeks to add a new zoning district to the Zoning Ordinance.
Filed by the Department of Community Services.
Mike Hollibaugh appeared before the Committee on behalf of the Department of Community
Services. Also in attendance: Greg Sovas, Consultant with Spectra Environmental and John
Molitor, Counsel for the Carmel Plan Commission.
Mike distributed a handout that summarizes the key provisions of the Mineral Extraction Zone
District. The second page contains a similar overview, but also contains the summary of the
provisions of the Mining Ordinance that was reviewed by City Council yesterday evening.
These two ordinances complement one another.
Currently, the Comprehensive Plan has absolutely nothing that directly discusses mining in the City
of Carmel. For example, where Martin-Marietta is located today, part of it is designated under
regional community employment/less density. Part of it is also classified as single-family residential.
The Comprehensive Plan amendment provides general policy framework that lays out the general
intent of the City of Carmel as it relates to mining and how the regulation is established. The “ME”

District establishes the framework for potential rezoning to allow mining. The key provisions of the
Ordinance establish mineral extraction as a special use, and some commercial areas where mining is
an established use. These will be eliminated and mineral extraction consolidated only into the “ME”
Zone. Within the zone are permitted uses, special uses, special exceptions, and excluded uses.
There are minimum yard requirements in the district, specific criteria for approval of the rezone,
specific criteria for plan approval of any sort of proposed mining activity, standards for reclamation,
and transitional provisions to allow special use applications.
Mike introduced John Molitor and Greg Sovas as two key members who were involved in the
development of these ordinances.
Dianna Knoll suggested that because this Agenda item could be rather lengthy, the Committee could
hear presentations from both sides of the issue this evening and then, an additional meeting would
be scheduled to hear this as a Single Item Agenda.

Bill McEvoy,
5120 Williams Circle, President of Kingswood HOA, asked for direction in how to
proceed with formal comments. The Kingwood HOA is not asking that the existing mining
operation be shut down—they are simply saying they agree with the City that there does need to be
an Ordinance, especially since the property is being annexed into the City. The proposed Ordinance
is an excellent starting point and supported by the Kingswood HOA.

Kingswood Resident, asked about procedures and process.
Marcus Freihofer,
Kingswood Resident, wanted to clarfiy the types of mining procedures
currently being done by Martin Marietta. One is a sand and gravel dredging operation on the east
side of Hazel Dell. The second type is underground mining with blasting and then retrieving
materials. The third is the actual open pit mining where they actually set charges, detonate to loosen
the materials from the face of the pit, then collect the materials and process them. In order for the
Committee to have a true understanding of the impact of the blasting, Mr. Freihofer suggested they
schedule a tour when they can witness an open pit blast.
Tom Yedlick
, Kingswood Resident, agreed to furnish to the Committee the Settlement Agreement
between the City, Martin Marietta, and Kingswood.
Public Hearing Remains Open on this Docket
NOTE:
February 25, 2003 was set aside to hear additional input on this item, either the Caucus
Rooms or Council Chambers, depending upon availability, at 7:00 PM. All Informational Materials
are to be submitted to the Department of Community Services for distribution to the Committee on
February 17, 2003.
Laurence Lillig clarified the procedure. Additional comments and materials could be submitted the

evening of February 25, 2003, but the Committee would not have had an opportunity to review
them prior to the meeting.
The Committee requested the following items for review and discussion: a) Written
comments/photos/informational materials from Kingswood Residents; b) Settlement Agreement
between Martin-Marietta and Kingswood; (Tom Yedlick to provide) c) Model Ordinance on
Mining from Boone County, Kentucky; and d) Information regarding Environmental Stewardship
Council—how substantial is the membership, who are the principals, what is the objective, etc.
Jerry Chomanczuk asked if Martin Marietta carried any liability insurance for damages against the
surrounding properties, the environment, etc. Zeff Weiss will research and respond.
The Committee was receptive to scheduling a tour of the mining operation, especially during a
blasting period.

Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage approval
to install a new ground sign, landscaping islands and lighting standards. The site is located
at 500 East Carmel Drive. The site is zoned B-8/Busiess.

4.Docket No. 156-02 ADLS Amend; Marsh Village Pantry #496
Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage approval
to modify building and canopy exteriors. The site is located at 9601 North College Avenue.
The site is zoned B-3/Business.
Filed by David Olson of Village Pantry, LLC.
David Olson, 3 Danbridge Drive, Danville of Village Pantry appeared before the Committee
representing the petitioner. Logos had been included on the canopies at this location and permission
requested to paint the building. A color scheme was put together and submitted to the Department,
at which time it became known that the Dept was concerned with painting the brick.
The applicant has now removed the logos from the canopies; however, they would like to paint the
masonry—not the brick. They would also like to install the awnings originally shown in the
drawings.
Laurence Lillig reported that this item was discussed at the November committee meeting. At that
time, the Committee expressed concern with the painting of the brick. This property is located at

the northeast corner of 96 Street and College Avenue, directly across the street from Parkwood

Crossing and adjacent to the Parkwood Crossing East project. The Department is recommending
that if a revised design is to be implemented, that it be done in such a manner that the existing brick
not be painted. Apparently there were signs erected on the canopy, and the applicant reported these
have all been removed.
Laurence Lillig further reported that there are several unresolved issues on this property. The
existing lighting was never approved; the signage was not approved; the trash dumpster should be
sufficiently screened; the original plan called for awnings; and the cigarette ads need to be removed
from the poles.
Nick Kestner was not in favor of the stripe on the canopy that shows really ugly during the day.
Wayne Wilson commented that there are a lot of national corporations that come to Carmel. There
are programs that work in the rest of the country that do not work in Carmel. This project is on

Carmel’s southern doorway and millions of dollars have just been invested in 96 Street. We have
fought countless wars on office buildings, etc. There are a number of items wrong with this
building, architecturally speaking. The building was probably built in the ‘60’s or ‘70’s and it is now
trying to be retrofit into 2003. There is a price for doing business, and this will be one of the busiest
corners around and you probably will not be able to pump enough gas for people in the adjacent
office building. The least we can do is make this building fit in with the millions and millions of
dollars in investment that have gone into this area.
Ron Houck asked about lumens measurement—Laurence Lillig responded that across from
residential, the requirement is 0.1 at the edge of right-of-way on the applicant’s property, not on the

opposite side of the street; the College right-of-way would be 0.3 foot candles—0.1 at 96 Street
right-of-way.
The Committee suggested the applicant look at the canopies at the Shell Station locations, Range
th
Line and Carmel Drive, and 96 & Keystone for comparison purposes and a general idea of
acceptability—also the new Meijer Gas Station.

5. Docket No. 185-02 DP Amend/ADLS;
West Carmel Center, Block D, Lot 3 - Applebee's Neighborhood Bar & Grill
The applicant seeks amended development plan and ADLS approval to construct a
restaurant.The site is generally located at the northeast corner of Michigan Road and
Commerce Drive. The site is zoned B-3 and is located within the US 421/Michigan Road
Overlay Zone.

Troy Terew of Lewis Engineering appeared before the Committee representing the applicant. Paul
Reisop, Project Architect, Chicago, and Vaughn Martin, Director of Operations also attended the
meeting.

The petitioner will be appearing before the Board of Zoning Appeals for some sign issues.
Vaughn Martin asked that consideration be given regarding the striped awnings rather than a single
color that would take away from the proto-typical look of an Applebee’s. The mechanical
equipment will be located on the roof of the building and screened with a Mansard roof, 5 feet tall.
The tallest unit is 50 inches tall on a 10-inch curve. The actual height of the unit will be a total of
60 inches or 5 feet.
The signage for the building was originally proposed as one on the right, the front, the left, and the
rear. This was reconsidered and reduced to “Applebee’s” on the front, eliminating the signage on
the east elevation, and eliminating the signage at the rear of the building. The request is now for
signage on the left (west) elevation, the front (south) elevation, and a ground monument sign. The
“Applebee’s” will be back-lit with red, lexon plastic lens, no exposed neon. The “Neighborhood
Grill and Bar” will be back-lit with green lens. The ground monument sign will have red lens; no
exposed neon.
The dumpster enclosure is masonry walls that are approximately 10 feet high. The only portion not
enclosed in masonry would be the gates—solid redwood boards with rigid, steel frames, stained to
match the brick. The front elevation faces (421) Michigan Road.
Department Comments, Laurence Lillig. The Department is recommending a single color for the
awnings. There are a number of other businesses along 421 that have proto-typical designs, but they
do not have them on 421, example being Ritter’s Frozen Custard.
An illustration of the screening for the rooftop equipment should be filed with the Department.
Revised elevations showing the proposed signs versus the total signs need to be filed. The
Department is not in favor of a total of 3 signs on this site.
The ground sign has been altered to have a red base that is internally illuminated rather than a clear
base. The area calculations are being based on 4.11 X 8.10, but there is text on the brick base that
contributes to the sign area. The petitioner is willing to eliminate the text on the brick base. The
Department and Communications (9-1-1) recommend that the street address be located on the
ground sign. This is the easiest place for the numbers to be found. The street number should be
placed on the base of the ground sign.
Revised elevations for the wall signs should be submitted. The wall signs on the left (west) elevation
and the front elevation (south) exceed the 60 square feet permitted by the size table. It is the box
around the sign on the west elevation that is the problem. The area as the ordinance requires the
sign to be calculated is in excess of the allowed.
Jerry Chomanczuk commented that the lettering on “Neighborhood Bar & Grill” looks spatially
correct, but when you look at the back versions, the spacing looks off and could be tightened up.
The petitioner stated a willingness to work within the Ordinance to comply with the square footage
requirements. If not, the petitioner will apply for a Variance.
In regard to the lighting, Laurence Lillig referred to the cut sheets submitted that showed a flat lens

and curved lens—the revised shows a curved lens; the Department prefers the flat lens because of
glare. The petitioner did not see that as a problem and will change to a flat lens. The photo-metric
plan on the southwest side of the site appears that the illumination exceeds 0.3 foot candles at the
right-of-way for US 421, almost three times what is permitted. The lighting contractor will be
consulted. The dumpster enclosure is visible from the north side of this site.
The Department does not have written comments on file from Scott Brewer, Urban Forester,
regarding the landscape plan. The Department is recommending the plan be approved subject to the
approval of the Urban Forester.
The awnings were again discussed. The petitioner felt that the stripe awnings were more lively and
interesting than the solid colors. The Committee felt that the stripe awnings were too busy for the
area.
The petitioner then asked if consideration could be given on building signs and the monument sign,
they would be willing to go with a solid color awning.
Nick Kestner asked about access to the multi-use path. The petitioner agreed to extend the
sidewalk off of the southwest corner of the building (6 feet in width) to connect with the 8-foot
multi-use asphalt path. The petitioner also stated a willingness to install a bike rack.

Ron Houck moved to recommend approval to the full Commission of
Amend/ADLS, West Carmel Center, Block D, Lot 3 -Applebee’s Neighborhood Bar & Grill
,
conditioned upon the following
. a) Extending the sidewalk to provide for a 6 foot wide walking
path on the southwest corner of the building to connect with the multi-use path; b) Change in
window treatment, either larger mullions or double-hung; c) Revised photo-metric plan—recessed
flat lens to be utilized; d) Landscape plan to be approved by Scott Brewer; and e) A total of three
signs—two wall and one ground sign. The sign area on the west wall will be reduced to
accommodate “Neighborhood Bar & Grill,” the base of the ground sign will eliminate
“Neighborhood Bar & Grill” and include the street address, and the awnings will be a sold color.
The motion was seconded by Jerry Chomanczuk and approved 6-0.
6. Docket No. 187-02 DP Amend/ADLS; Carmel Science & Technology Park, Block 12,
Lot 5 - Linc Systems
The applicant seeks Development Plan and ADLS Amendment approval to construct a building
addition. The site is located at 1402 Chase Court. The site is zoned M-3/Manufacturing.

Adam DeHart, Keeler-Webb Associates, 486 Gradle Drive, Carmel appeared before the Committee
representing the applicant. Also present was Bill Dennis of Linc Systems.
The applicant appeared before the Plan Commission in January and was referred to this committee
for further review of buffering within the 60-foot bufferyard. As the facility is expanded, all of the
industrial uses will be internalized towards the industrial park and the bufferyard will be maintained
as much as possible between the subject site and the property zoned B-6 located directly behind the
subject site.

The woods is fully grown and mature, there are scrubs, bush, and weeds that have been there for
many years, undisturbed, and is a portion of the property that was never farmed. In between the
subject site property line and the west is a legal drain with a 75-foot easement on either side. There
is a natural woodland barrier between the subject site and the property to the west that sufficiently
screens the proposed development.
The existing facility to the west was built as expandable and is full metal from grade to the eave and
gable portion of the roof. As the facility is being built-out, the applicant is proposing to wrap the
8-foot, split-face masonry and solid scored masonry all the way around the west end so that the west
elevation will have a break in the architectural façade.
Laurence Lillig reported the Department is recommending favorable consideration of this petition
as filed.

DP Amend/ADLS, Carmel Science & Technology Park, Block 12, Lot 5, Linc Systems

presented. The motion was seconded by Ron Houck and approved 6-0.
7. Docket No. 188-02 DP/ADLS; Dixie Hi-Way Addition, Lot 8 –
Glenwood LLC
The petitioner seeks to convert an existing residence into an office building. The site is
located at 10820 North College Avenue. The site is zoned B-1/Business within the Home
Place District Overlay Zone.

Leonard Voight, 14928 Pacer Court, Carmel appeared before the Committee representing the
applicant. Approval is requested to convert an existing residence located at 10820 North College
Avenue into an office building.
The Plan Commission allows 5 years in which to develop this property under the terms of the
Rezone. A variance is being sought for curbing on the parking lot, brick facia on the building, and
a landscape plan.
This property runs from College Avenue to Broadway to the west. The existing house fronts on
College Avenue; to the west are vacant lots. To the north is another lot that is vacant and has
forestation with a house to the rear. On the south side is a building contractor with building
materials in the yard and is a real eyesore. Any landscaping that would go into the area would be
wasted.
If any development were to take place on the south side, Mr. Voight would be happy to comply with
the Home Place Overlay. This would also apply to the lot directly to the north. If any landscaping
were done between now and five years, and no development takes place on either side, north or
south, no harm has been done. Under the Overlay requirements, if the landscaping were done and
early development were to take place, landscaping would be plowed under in 5 years and it would
be an economic waste.

The front of the house would comply with the landscaping requirements. There are a number of
large, Black Walnut trees on the property and a lot of shade. If a lot of landscaping were installed,
shade would not allow for growth and again, the landscaping would be wasted.
Laurence Lillig reported for the Department and confirmed that this site is operating under a 5-year
horizon as a condition of approval from the Plan Commission and the City Council. Three items
have been identified for the Committee to address. First is the minimal level of improvements being
proposed for this site that includes demolition of the stucco garage and installation of minimal
landscaping along the sides and front of the building. There must either be installation or a
commitment to install a segment of multi-use path along the front of the property. Secondly, this is
a transitional use. Third, variances will be requested through the BZA, one of which is landscaping.

Wayne Wilson moved to recommend approval of
Addition, Lot 8—Glenwood LLC conditioned upon
to the full Plan Commission, receipt of a
letter of commitment from the petitioner committing to a specific landscaping plan and the
installation of a multi-use path. The motion was seconded by Dan Ducher and approved 6-0.
8. Docket No. 13-03 ADLS Amend; Hamilton Crossing West, Building #5 -
ITT Educational Services, Inc.
Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage approval
for wall signs. The site is located at 12900 North Meridian Street. The site is zoned B-5
Business and is within the US 31 Corridor Overlay Zone.

Committee representing ITT Educational Services.
The petitioner is requesting approval for two wall signs, one on the east and one on the west
elevation—only the east sign would be illuminated. A stainless steel sign with a brushed finish,
illuminated, backlit by blue LED’s.
Laurence Lillig reported that the proposed sign meets the Ordinance size requirements.

9. Docket No. 14-03 ADLS Amend; MacAllister Machinery Company, Inc.
Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage approval
for a wall sign. The site is located at 9901 North Michigan Road. The site is zoned B-2
Business and is within the Michigan Road Corridor Overlay Zone.

Jim Shinaver, attorney with Nelson & Frankenberger appeared before the Committee representing
the applicant. Bob Harris, owner of the real estate; Tom Barrett, and Todd Conner of MacAllister
Machinery Company were also in attendance.
The applicant is seeking ADLS Amendment for a proposed wall sign on the western elevation of the
building. MacAllister is entering into a short-term lease, approximately 18 months, with Mr. Harris.
MacAllister will be utilizing the existing sign infrastructure on the western elevation of the building
for its new sign.
This property is directly across the street from the RCI building. A photograph of the western end
of the building and the proposed sign were also shown. The applicant is proposing that the
MacAllister’s sign face be inserted into the existing sign infrastructure. The sign is 12’X3’ and
within the size requirements of the zoning ordinance. The sign will be constructed of a
poly-carbonate sheeting, illuminated at night with the color scheme appearing the same as during the
day, yellow background and black MacAllister logo and name.
Wayne Wilson moved for approval of Docket No. 14-03 ADLS Amend, MacAllister Machinery
Company, Inc. as presented. The motion was seconded by Ron Houck and APPROVED 6-0.
10. Docket No. 15-03 ADLS Amend; Sign for Deborah Wood & Associates
Petitioner seeks amended Architectural Design, Lighting, Landscaping & Signage approval
for a wall sign. The site is located at 630 West Carmel Drive. The site is zoned M-3
Manufacturing.

Paul Reis, attorney, 5013 Buckeye Court, Carmel appeared before the Committee representing the
applicant. Deborah Wood was also in attendance.
Approval is being requested for a sign on the ATAPCO building located at the corner of Carmel
Drive and Guilford. This is the first part in a two-part process; the second part is to appear before
the Board of Zoning Appeals for approval to place a second sign on the west façade of this building.
There is an existing sign on the building for 5-Meta Com, previously approved.
The colors of the sign are indicated to be black or dark during the day, and in the evening they are
internally illuminated to appear white. The size of the sign is within the allowable and faces Guilford
Avenue.
The applicant will also be seeking a variance through the Board of Zoning Appeals for the number
of signs – 2 identification signs on the west façade.

Jon Dobosiewicz reported for the Department. The proposed sign would be considered one sign if
it were at less angle at the corner. A variance is being requested to qualify this as a single sign with
the wider separation. The site is allowed two signs by virtue of two frontages.
