SPECIAL STUDIES COMMITTEE
OCTOBER 7, 2003
Minutes
The Special Study Committee met in the Caucus Rooms of City Hall, Carmel, Indiana on Tuesday,
October 7, 2003 at 7:00 PM.
Committee Members Present: Jerry Chomanczuk; Ron Houck; Nick Kestner; Dianna Knoll, chairperson;
and Wayne Wilson.
Department of Community Services Staff present: Angie Butler, Mike Hollibaugh, Director.
The Special Studies Committee met to consider the following items:
1.Docket No. 112-03 ADLS; (03070014);
Merchants' Square - Chipotle Mexican Grill
The applicant seeks approval to construct a restaurant. The site is located at 1422 Keystone
Way. The site is zoned B-8/Business and is within the SR 431 Overlay Zone.
Filed by Jason Stults of Glavan-Feher Architects.
Jason Stults, Glavan-Feher Architects, appeared before the Committee representing the applicant.
Mr. Stults submitted a revised elevation, photographs, and the design favored by the Committee.
The entry portal is in the center of the building. (The existing structure will be razed.) Sconce lights
have been added.
The proposed Chipotle is the first store in Indiana. The enclosed patio area is only on the eastern
elevation (the Keystone side.) The umbrellas will be blue in keeping with Merchants Square color
awnings.
Dianna Knoll was in favor of the “rustic feel/look.” The petitioner will utilize the same color brick
throughout, and there will be no color difference on doors and windows.
The Committee felt that the Chipotle was a good complement to Carrabba’s, also in the same
center/area.
Angie Butler referred to the Department Report and comments regarding the screening of rooftop
mechanical equipment. Jason Stults responded that per Jon Dobosiewicz, one exhaust fan would

be allowed; everything else would be screened. The screening material is an acoustic panel of
sandstone.

Townhomes of Range Line - 340 Building
The applicant seeks Development Plan and Architectural Design, Lighting, Landscaping &
Signage approval for an office building and Primary Plat approval for a two lot subdivision.
The site is located at 340 North Range Line Road.
Filed by James J. Nelson of Nelson and Frankenberger for L.E. Investments, LLC.
Jim Nelson, attorney with Nelson and Frankenberger, appeared before the Committee representing
the applicant. Steve Schutz was also present.
The petition involves one-half acre of real estate in Old Towne Carmel with a common address of
340 North Range Line Road. This particular parcel is subject to the Old Towne District Overlay
Zone and bears two zoning classifications: B-5 and R-4.
The application represents a continuation of a recent surge in interest in Old Towne, both in new
construction and revitalization. This particular parcel is today unplatted, it is 60 feet wide, 340 feet

in length, and has three road frontages: Range Line Road, 4 Street NW, and 1 Avenue NW. The
eastern portion of the parcel (to the front) is zoned B-5 Business District; the western half is zoned
R-4 and lies within two sub-areas of the Old Towne District Ordinance: The Historic Section along

Range Line, and character sub-area along 1 Avenue.
The existing home on the property will be renovated and converted to office use. The western
one-half will be the site of the proposed, two-story townhomes. In between the two areas will be
parking to serve the office buildings and residential in the event of overflow.
Jim Nelson circulated photographs of the subject property, showing the western half of the site
where the townehomes will be located, and the rear view and the view to the south. It is noteworthy
that the City has made a substantial commitment to this area as evidenced by the infra-structure
improvements such as sidewalks and curbs, brick insets at crosswalks, decorative or period style
street signs, and street lights. This proposal is consistent with Carmel’s commitment to the area.
The existing building will be renovated and converted to office use. Upon completion, the siding
will remain the same, with new windows, dormers, and a new roof. All necessary repairs will be
made. Each building will contain four townehomes, and each building will have its own, attached,
4-car garage. The first floor will be completely wrapped in Hardy-Plank Siding.
This particular proposal is a special use within the Old Town District, and the petitioner will be
appearing before the Board of Zoning Appeals for a Special Use.

3. Docket No. 130-03 ADLS Amend (#03080029),
Penn Mark II- Ryland Homes Wall Sign ( ADLS Amendment)
The applicant seeks to place a wall sign on the south elevation of the Penn Mark II building.
The site is located at 11555 N Meridian Street. The site is zoned B-6/Business and is within
the US 31 Overlay Zone.

4. Docket No. 136-03 ADLS Amend (#03090004), Dick's Sporting Goods
The applicant seeks an amendment to construct a retail building in Clay Terrace. The site is
located at 14350 Clay Terrace Blvd. The site is zoned PUD - Planned Unit Development.
Filed by Fred Simmons for Simmons & Associates, Inc.
Fred Simmons, Simmons & Associates, 305 East New York Street, Indianapolis appeared before
the Committee representing Clay Terrace, LLC and Dick’s Sporting Goods. Mr. Simmons
distributed supplemental informational material as requested by the Department.
The landscape plan has not been revised since the initial submission. The frontages of the building
were shown as well as the dimension from the restricted point to the property lines. The petitioner
is requesting approval for some modifications to previously approved elevations. The modifications
consist of the following: 1) the stone spheres shown will become sports icons, 4-foot diameter
fiberglass spheres scored as baseball, softball, or soccer ball, and the color of lime-stone. The sports
icons will be buff-colored limestone, the same color as the EFIS trim at the top of the building. The
other major change is the color of the painted steel—initially gray, now a “Hartford Green.” The
final change is the inclusion of scramble glass on the east façade to easily accommodate signage.
Wayne Wilson said the icons had been visited before, and the Committee was not in favor of them.
Fred Simmons responded that the stone spheres were talked about, but it was not determined that
they were not to be used.
Nick Kestner said the idea was presented at Sub-Committee, and the response was totally negative.
At the beginning, the Committee was not happy with the spheres. The icons are signage.
Dianna Knoll asked for actual pictures for presentation; Mr. Simmons said the pictures were not a
good representation and he was reluctant to show them.

Dianna Knoll said that initially, the vision for Clay Terrace was up-scale, tasteful, retreat, walking
paths, nice, inner-acting with space and visual. What is being presented is not the vision and the
Committee has been consistent.
Mr. Simmons requested approval from the Committee that “Spando-glass” would be acceptable.
Also, the height of the clear story beyond—in essence the center of the building—would go from
55 feet to 50 feet. There is also a change in the configuration of the mullion.
Nick Kestner and Ron Houck were not in favor of adjusting the height of the center of the building.
Since the center is the main entry, it should have more emphasis.
Docket No. 136-03 ADLS Amend (#03090004), Dick’s
Ron Houck moved for approval of
Sporting Goods, conditioned upon
the following changes: 1) The building entry façade will be 55
feet in height. 2) The mullion configuration will be as originally presented. 3) The glass will be clear
rather than color. 4) The exposed steel will be green and the ground windows will be green to
match. 5) The spheres will not represent any sport symbols or icons. The motion was seconded by
APPROVED
Jerry Chomanczuk and 5-0.
5. Docket No. 145-03 ADLS Amend (#03090023), Circuit City- ADLS Amendment
The applicant seeks an amendment to construct a retail building in Clay Terrace. The site is
located at the 14300 Block Clay Terrace Blvd. The site is zoned PUD - Planned Unit
Development.
Filed by David Chapin of Taylor Scott Architects.
Fred Simmons, Simmons & Associates, and Paul McKeon, Circuit City appeared before the
Committee representing the applicant.
Paul McKeon distributed additional information to the committee members and stated they have
worked with the DOCS staff for several months to address concerns, particularly the frontage on
US 31 that will not look less like commercial and more like an office building than retail.
The east, south, and north elevations have a consistent design theme. All brick is being used with
some window elements and variation. Circuit City is a large retailer without the ability to have
display windows; because of that, a large amount of “Spando-glass” is being utilized. The glass is
a major up-grade and cost for the petitioner, but it will meet requirements. The brick is “number 5”
and the stone will be the same color.
The accent bands on the cornices, the horizontal band, and the small caps at the base of the pilaster
are tan in color and cast-stone material; anything 8 feet and above is EFIS. The intent is to match
the EFIS on the cornices either by painting or matching materials.
The storefront mullions will be gray/silver tones. The west façade will have gable entry elements.
EFIS, cast-stone pattern will be used throughout. The awnings are fabric, gold color, initially
approved with this block. The windows are “Spando-glass” in gray tones and the signage shown
on the glass is directional.

Committee Comments:
Nick Kestner said the windows are “boarded-up” with signage on it. Retailers do not like glass, so
there are some problems with this proposal—glass takes up display space, walls are preferred.
Dianna Knoll: A lot of time has been spent on the look and feel of the building. This proposal is not
the vision that she would like to see. Nothing shown is creative, imaginative, with architectural
interest or park-like setting, nothing innovative or “outside the box.” “Circuit City” is a big box
with a big circle on it.
Jerry Chomanczuk echoed Dianna Knoll’s comments and had the same concerns. When the Clay
Terrace project was approved, one of the commitments requested and all agreed upon was that
first
every tenant would apply their sign package with Eaton Lauth for review before coming to
Committee for review.
Ron Houck’s understanding was that the etched glass was used more in unique types of retail and
that this proposal was to be more “period-looking.”
Wayne Wilson commented there is a major difference in the philosophy of the retailer willing to
locate at this site versus the philosophy of the developer selling this project. The focus of Circuit
City seems to be how much it is costing to locate in Carmel rather than fitting in with the philosophy
of the Clay Terrace Center. The same situation exists with “Dick’s Sporting Goods,” the
“Wal-Mart” of the sporting goods stores.
Nick Kestner commented the signage was not just “slapping the sign” on the building but that signs
should be presented in a higher class, perhaps wrought iron.

The petitioner will return to the November 6 Committee meeting with more detail for review.
6. Docket No. 146-03 ADLS Amend (#03090024), Lakeside Park- ADLS Amendment
The applicant seeks an approval of revised designs for parks and subdivision entries design.
The site is located southwest of 141st Street and Towne Rd. The site is zoned
S-1/Residence-Estate.

Dawn Barnett, Drees Homes appeared before the Committee requesting approval of a subdivision

entry re-design and eight (8) corner parks for a project located at the southwest corner of 141
Street and Towne Road.
The entry monument consists of two different walls, streetlights, benches, rounded sidewalk, stone
pillars and trellis.
Nick Kestner asked that the sidewalks be constructed wider than 5 feet at the bends and curves.
Dawn Barnett stated that the sidewalks are internal to the project and will connect to the sidewalks

in front of the lots. The petitioner is willing to construct 6-foot wide sidewalks at the bends or
curves.
The south entry from The Lakes at Hayden Run will be a corner park and include two benches,
landscaped with perennials. There will be at least two parks throughout the subdivision that will
have a combination of brick and stone pillars with two benches, shrubs, and flowers with the trees
behind; Twin Lakes Drive corner park will be the same.

The north entry at 141 Street will be only the wall and the trellis.
