OF COMMUNITY SERVICES REPRESENTATIVE Jon Dobisiewicz Laurence Lillig The Subdivision Committee will meet to consider the following items: 1. Docket No. 39-02 OA, 40-02 OA Amendments to the Carmel/Clay Zoning Ordinance – Use Table Adoption & Definitions Amendment (Text Amendments) The petitioner seeks to make amendments to the structure of the Ordinance relating to uses, add definitions and group all definitions into Chapter three of the Ordinance. Filed by the Department of Community Services. Open discussion of the Text Amendments to the Carmel/Clay Zoning Ordinance. The committee reviewed the document on a page-by-page basis and went over definitions in detail. Definitions discussed: ponds, living ponds, retention/detention ponds, and lakes, artificial lakes—all 1,0000 square feet or greater. There was further discussion regarding the size of the ponds or body of water; anything over 1,000 square feet would require BZA or Plan Commission approval. There is a need to clearly define a man-made body of water. Under “Ponds” in the definitions, it would say “see lake,” and define lake as a man-made body of water—period! An artificial lake or pond comes up in “Miscellaneous Uses,” in the Ordinance; however, it is a special use in all of the zones identified. As of now, the definition for artificial lake or pond is “A body of water created artificially that is either fed or not fed by a water course that is not part of a plat.” The size of the body of water would be determined by the DOCS; if a property owner disagrees, they have recourse through the BZA. “Church” is to be defined and John Molitor will have input. Also, there will be a re-vamp of the section on Towers and Antenna based on some current litigation. 1 S:\\PlanCommission\\Minutes\\SubdivisionCommitteeMinutes\\2003mar04 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 Recreational and Motorized Vehicles and parking/storage restrictions were discussed. The Sexually Oriented Businesses will be addressed by John Molitor in a separate section with a litany of conditions in the I-1 Zone. Window signage was touched on; Pat Rice felt this should be “tightened up.” Studio, Radio, public television………space used primarily for the creation of film, television, music video, multi-media, or other related activities…”Radio” is omitted as a part of the definition and should be included. Tavern/Nightclubs…..”A commercial establishment dispensing alcoholic beverages for consumption on the premises.” This definition was acceptable to all members. Towers, wireless, telecommunications, antenna—No definition at this time. John Molitor is working on this definition and use. Jon Dobosiewicz explained that anything to do with cell towers and telecommunications will be extracted and covered separately. An Ordinance regarding Cell Towers was adopted, but there were no definitions to match. The Use Table Adoption and Definitions Ordinance Amendments with changes as stipulated will be printed out and reviewed at the Subdivision Committee in April. Clarion North Hospital Campus PUD (Rezone & DP/ADLS– 2. ) Informational Item Only The Petitioner will be seeking DP/ADLS approval for a hospital and medical office building th and a PUD zoning designation. These applications will be on the March 18 Plan Commission agenda under public hearings. The site is located at the northwest corner of th US 31 and 116 Street. Filed by Joseph M.
