The following revisions have been competed and directly correlate with your May 24, 2005 e-mail and are as follows:
1. The boundary of Section I has been revised to eliminate Lots 32 and 33 so that lots 1-31 inclusive remain the
same as approved in the PUD. The legal description was also revised.
2. The street names are based on several review letters and phone conversations with 911 Communications and
the Fire Department. Salemo Court has its own name so that units do not have to have a Guilford Road
address. Salerno Court may be extended in the future either to the North or South. The remainder of the
units will have a Brownstone Trace address. The area reserved for future private drive in the Southeast
corner of Section I come from the South and will be named at a later time.
3. Mr. Hollibaugh's name has been revised.
4. See the revised location of the 15' Utility Easement along the North side of the project to accommodate the
tree preservation, new plantings, and utilities we have done this in an effort to place the utilities outside of the
trees shown on the tree preservation plan approved with the PUD. The existing 15' sanitary sewer easement
along the South property line does not exclude other utilities or any landscaping on the easement per
Instrument No. 92-51479.
Please contact us if any additional information is needed or if you require any additional revisions to the plat before
signing. We are trying to get the plat signed and forward to the Clerk/Treasurer prior to the filing deadline on Tuesday
May 24, 2005.

Mr. Robert Barbato and Mr. David Klain are the managing partners and owners of Crawford
Development, LLC. Crawford Development, LLC is proposing to provide 10 structures containing
40 Brownstone units on individual lots on the subject real estate. This property has been rezoned
from B-6 to a Planned Unit Development. The Planned Unit Development Ordinance No. Z-448-
04 was approved by the Carmel Common Council on June 7, 2004, as Docket No. 04-01-0024Z.
Please place this project on the next Board of Public Works agenda for review and approval of
Section One of the above subdivision. The plat mylars will be fo~arded to your office from Matt
Griffin in Carmel DOCS, once signatures are obtained from that office. If you have any questions

RE: Brownstone Homes at Guilford Reserve-Secondary Plat Review #2
Dear Mr. DeHart:
The City has received your comment letter and draxvings dated February 24, 2005 based upon the City
review of January 11, 2005.
It is our understanding that the proposed development on the east side of the creek is not being pursued and
the project will come back to TAC. Our review was limited to the development on the west side of the
creek based on the current drawings in our office. We assume any items related to "Section One" will be
clarified at the next TAC submittal as there will now be only one section.
The comments from the City review have been satisfactorily addressed with the following exceptions:
Secondary Plat · Please remove the proposed curbing and paving from the plat.
· Please make the proposed monumentation at the property comers more clear.
· Is the tree preservation area shown to be protected by an easement? If so, the utility easement
cannot be shown to overlap this easement.
· The linetypes on the plat are confusing. Suggest the addition of a linetype legend.
· Suggest showing delineation of the differing easements on-site. Presently, there are gaps in the 40-
foot wide easement of Brownstone Trace.
· Please revise General Note B, Sheet 2 of 2 to include maintenance of pipes, mains, ducts and
cables.
Development Plan
· Comment on previous review: "Please shoxv pavement cuts and replacement to Department
Standard for the service connections.under Guilford Road (Water, Gas and Electric, if
underground)." It is apparent that there is also a telephone and gas cut on the north side of the
development. Please show a pavement cut or note for boring.
· Comment on previous review: "Hatching is indicated for Heavy Duty pavement but do not see
where on site this will be installed." There still appears to be no heavy duty pavement indicated
on the development plan.
Grading and Drainage Plan
· Comment on previous reeiew: "Are the pipe crowns matched? If not, does the HGL remain in the
pipes for the stormwater piping system?" Does the HGL remain in the pipes for the design storm?

· Comment on previous review: "Please revise pond label on all sheets from "Retention" to
"Detention". Retention ponds have no outlets, this pond appears to have an outlet. This is a
detention pond.
· Comment on previous review: "Please indicate a swale along the north and south property lines.
The swale on the north property line would have to be located outside of the tree preservation area.
The Department is of the opinion that a swale is needed along the eastern property line to drain the
area behind the easternmost housing units. These swales must be 1% minimum slope and cannot
be longer than 400-feet before discharging to the detention pond or an inlet." As it relates to the
south swale, the City requires this swale to ensure that water discharging fi.om this property does
not have to be accommodated by a future development. The swale on the north side is required to
ensure positive drainage of the area with no ponding.
· Comment on previous review: "Please indicate where on-site the curb and gutter system will
overtop if the inlet system is clogged or not functioning and designate as a flood route." Please
designate flood routes.
· Comment on previous review: "The proposed grading on the north end of Salerno Court is higher
than the existing grades. How will the proposed grade in this area be brought back down to
existing grade without having a negative impact on the trees in the tree preservation area?" Please
confirm this item with the Urban Forester.
Entrance
Plan
· Comment on previous review: "Due to new County requirements, the on-site detention pond must
be sized to accommodate detention of the full thoroughfare right-of-way across the property
frontage. A stub must be provided at the property line to allow for a future connection by the City
Guilford Road project. The road project inlets are likely to be located at the existing CMP under
Guilford Road. Please show swales to maintain the current roadside drainage system." Detention
of the right-of-way and pipe sizing such that road drainage can be routed on-site to the remotely
located pond must be provided.
· Comment on previous review: "Department standard curbing must be installed within the
proposed right-of-way of Guilford Road. Please delineate a different curbing type if the
Department standard detail differs from the curbing proposed on-site." The chair back curb detail
shown on Sheet is different that the City standard. Copies of City standards are enclosed.

These comments represent the Department of Engineering's second review of the construction plans for
this project. We request that all responses to our comments be provided in writing. Failure to provide
written responses may result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted,
particularly if any such changes are considered "new" or fall outside of our previous reviews. Please
provide revised plans indicating all revisions. Please notify us of any changes and specifically state any
changes, including changes resulting from Plan Commission, Special Studies or other committee meetings.
All bonds and performance guarantees (if required) must be posted prior to Engineering Department
approval. Also, Board of Public Works and Safety approval and any other governing agency approvals (if
required) must be obtained prior to Engineering Department approval.
The City has provided direction to the drainage review consultant to not review any current plans or
drainage calculations. This review will be conducted on the May TAC submittal. Please provide plans and
drainage calculations for the May TAC meeting to both the City and Crossroad Engineers as TAC
members.
O SnPreviously discussed, the City is waiving the requirement for right-of-way improvements in lieu of
remitments from the Developer to participate in a future roadway project to improve the Guilford
corridor from 116th Street to Carmel Drive. Based on the frontage of the property, the estimated design,
stmction, and inspection cost, the City is requesting a commitment equal to $66,305.00.

Dear Mr. DeHart:
The following are our comments regarding the plat submitted for review at the December 15, 2004
Technical Advisory Committee meeting:
Secondary Plat
Please remove the proposed curbing and paving from the plat.
Please make the proposed monumentation at the property comers more clear.
· Is the tree preservation area shown to be protected by an easement? If so, the utility easement
cannot be shown to overlap this easement.
· Lots on the east side of the legal drain are shown to encroach into the easement. Please revise so
that no portion of the lots are contained in this easement.
· We assume that all the streets and the storm sewer system are to remain privately owned. Please
be aware that these improvements xvill not be accepted by or maintained by the City because they
are not designed to City requirements. If future acceptance by the City is anticipated, the
Department recommends that the storm piping and Brownstone Trace be constructed t° City
Standards.
· Please provide a legal description and acreage of Section One on the Plat.
· The linetypes on the plat are confusing. Suggest the addition of a linetype legend.
· Suggest showing delineation of the differing easements on-site. Presently, there are gaps in the 40-
foot wide easement of Broxvnstone Trace.
· Please revise the text for Section One to be Lots 1-34, not 1-48 on Sheet 2 of 2.
· Please revise General Note B, Sheet 2 of 2 to include maintenance of pipes, mains, ducts and -
cables.
.Development Plan
· The Department recommends that Brownstone Trace be constructed to the Department's
standards. This would include providing a 30-foot back of curb to back of curb, normal crown
roadway section with Department standard curbing, underdrains and pavement section. This
would also require depressed curbs across each of the intersecting private streets. This would also
require a 50-foot right-of-v,'ay.
· Please confirm with the Utility Department that the length of the building sewers is acceptable.
Also, please confirm that the three indi~i, dual building sewers proposed east of the Legal Drain are
acceptable to the Utility Department or if they xvould prefer a sewer main extension.
· Please show pavement cuts and replacement to Department Standard for the service connections
under Guilford Road (Water, Gas and Electric, if underground).

Please indicate a fence on top of the proposed keystone ~valls where the walls are adjacent to
sidewalks and parking spaces.
Transformer pads are indicated in the existing sanitary sexver easement and in the tree preservation
easement. Please confirm with the Utility Department that these installations will be allowed.
Please confirm with the Urban Forester that the proposed installation will be allowed.
The parking spaces located just south of the housing units immediately east of the Legal Drain
will have a sight distance issue for vehicles backing out of the spots. They will not be able to see
vehicles traveling on Napoli Court.
· Recommend locating water valves outside of any pavement, curbing and sidewalks and adding a
note to the Drawings to this effect.
· Please show' the existing limit of the legal drain easement on the east side of the Legal Drain on all
sheets.
· Hatching is indicated for Heavy Duty pavement but do not see where on site this will be installed.
Grading
and Drainage Plan
· Please delete the "Future RCP by Others" note on all sheets.
· Are the pipe crowns matched? If not, does the HGL remain in the pipes for the stormwater piping
system?
· Please revise pond label on all sheets from "Retention" to "Detention".
· Please show any proposed roof drain connections on the Drawings.
· Please indicate any subsurface drains out of the on-site inlets (if these are being installed).
· The Department does not recommend the inverted crown on Napoli Court.
· Please indicate a swale along the north and south property lines. The swale on the north property
line would have to be located outside of the tree preservation area. The Department is of the
opinion that a swale is needed along the eastern property line to drain the area behind the
easternmost housing units. These swales must be 1% minimum slope and cannot be longer than
400-feet before discharging to the detention pond or an inlet.
· Please label the bottom elevation of the pond.
· Are the proposed trench drains (Structures 7 and 8) adequate to capture all of the flow from the
east and the flow coming down the relatively steep street grade from the west?
· The Department recommends the installation of an underdrain under the inverted crown on Napoli
Court if a normal crown cannot be provided.
· The entire east side of the development is not being detained. This area must be provided with a
stormwater detention system. Please also ensure that there are no direct discharge areas from the
west and that the entire property is directed into a stormwater detention facility.
· Is the spillway elevation to be set at 832.00?
· Please indicate where on-site the curb and gutter system will overtop if the inlet system is clogged
or not functioning and designate as a flood route.
· Are any basements or crawl spaces proposed? If so, please indicate a Minimum Flood Protection
grade for any structure opening to be 2-feet above the 100-year elevation of the Legal Drain and
the detention system.
· Please confirm with the County that the proposed filling in the flood fringe and floodway is
acceptable. The Department will not permit any filling of the floodway.
· The Department suggests that the following minimum cover requirements be applied to the design
of this project. A note must be added to the appropriate sheets and/or details for any utilities
installed within the City right-of-way and is recommended for any on-site utilities and building
services: "For installation of Storm Mains, Water Mains, Sanitary Mains, Water Service Laterals,
Sanitary Service Laterals under City streets, regardless of the jurisdiction of the utility, the
minimum cover from the top of the installed pavement to the top of the installed pipe shall be the
pavement section thickness (all bituminous and aggregate material above the subgrade) plus 1-0".
If the standard practice of the utility that has jurisdiction over the installation has a more stringent
cover requirement, the more stringent requirement shall govern."
The proposed grading on the north end of Salerno Court is higher than the existing grades. How
will the proposed grade in this area be brought back down to existing grade without having a
negative impact on the trees in the tree preservation area?
Entrance
Plan
· Please add a note for sawcutting the existing pavement where it will be adjacent to ne~v pavement.
· The proposed entrance needs to be reconfigured such that the curb radii terminate at the existing
edge of pavement.
· Due to new County requirements, the on-site detention pond must be sized to accommodate
detention of the full thoroughfare right-of-way across the property frontage. A stub must be
provided at the property line to allow for a future connection by the City Guilford Road project.
The road project inlets are likely to be located at the existing CMP under Guilford Road. Please
show swales to maintain the current roadside drainage system.
· Please indicate the proposed Guilford Road Right-of'Way paving area with hatching. This can be
in addition to the notes already included on the Drawings.
· Please do not list paving options for the paving within the Guilford Road right-of-way. The
pavement section must be no less than: 1.5" H.A.C. Surface #11 over 2" H.A.C. Binder #8 over 3"
H.A.C. Base #5D over 7" #53 Stone over 4" #2 Stone.
· Department standard curbing must be installed within the proposed right-of-way of Guilford Road.
Please delineate a different curbing type if the Department standard detail differs from the curbing
proposed on-site.
· The plan should indicate removal and replacement of 1-2-feet of mainline pavement on Guilford
Road to facilitate the installation of curbing out to the existing pavement edge. Pavement shall be
sawcut to a clean edge and shall be replaced ~vith pavement meeting the requirements noted two
comments above.
· Please add a note that all Maintenance of Traffic methods and procedures shall conform to the
requirements of the Indiana Department of Transportation Standard Specifications, latest edition.
· Please show curb tapers and depressed curbs at the future location of the ADA ramps of the multi-
use path in the proposed Guilford Road right-of-way.
Detail Sheets
· The Department recommends constructing the on-site pavement to meet the following section:
1.5" H.A.C. Surface #11 over 2" H.A.C. Binder #8 over 3" H.A.C. Base #5D over 7" #53 Stone.
· The Department recommends adding a note that all paving shall be completed in one season.
· The City recommends the use of Department Standard Details for all curbing, sidewalks, integral
curb and walk. The Department standard details must be added for work in the Guilford Road
right-of-way if these will differ from the on-site details.
· Please include the Department standard s.treet cut patch detail.
· If Brownstone Trace is to be constructed to Department Standards, a depressed curb detail must be
added.
The Department requires that any notes, specifications and details related to proposed utilities
within City right-of-way and recommends that any notes, specifications and details related to
proposed on-site utilities be modified to meet the following requirements: "Bedding, haunching
and initial backfill materials, placement and compaction for water mains, water service laterals,
sanitary mains and sanitary service laterals under and within 5-feet of pavement shall be in
accordance with the standard practice of the utility that has jurisdiction over the installation. Final
backfill for water mains, water service laterals, sanitary mains and sanitary service laterals under
and within 5-feet of pavement shall be B-Borrow for Structure Backfill meeting the material
requirements of the INDOT and shall be compacted in 6-inch maximum lifts to not less than 95%
Standard Proctor Density for the entire depth of the material placed. The backfill for the top 6-
inches of the excavation below the start of the aggregate subbase of the pavement shall be No. 53
Stone meeting the material requirements of the INDOT and shall be compacted to not less than
95% Standard Proctor Density. If the standard practice of the utility that has jurisdiction over the
installation has a more stringent final backfill requirement, the more stringent requirement shall
govern."
The Department recommends that any notes, specifications and details (Details 8 and 9 on Sheet
5) related to storm piping be modified to meet the following requirements: "Bedding, haunching,
and initial backfill for all RCP installations shall be B-Borrow for Structure Backfill meeting the
material requirements of the INDOT. Bedding shall be placed in the trench bottom such that after
the pipe is installed to grade and line, there remains a 4-indh minimum depth of material below the
pipe barrel and a minimum of 3-inches below the bell. For pipe sizes 66-inches and larger, the
minimum depth of material below the pipe barrel shall be 6-inches. Bedding, haunching and initial
backfill shall be compacted in 6-inch maximum lifts to not less than 95% Standard Proctor
Density for the entire depth of the material placed. The backfill shall be brought up evenly on both
sides of the pipe for the full length of the pipe. Haunching shall extend to the springline of the
pipe. The limit of initial backfill shall be 6-inches above the springline. Minimum trench width
shall be the outside diameter of the pipe plus 18-inches. Final backfill for all RCP installations
under and within 5-feet of pavement shall be B-Borrow for Structure Backfill meeting the material
requirements of the INDOT and shall be compacted in 6-inch maximum lifts to not less than 95%
Standard Proctor Density for the entire depth of the material placed. The backfill for the top 6-
inches of the excavation below the start of the aggregate subbase of the pavement shall be No. 53
Stone meeting the material requirements of the INDOT and shall be compacted to not less than
95% Standard Proctor Density. Final Backfill for all RCP installations greater than 5-feet of
pavement shall be clean fill material free of rocks larger than 6-inches in diameter, frozen lumps
of soil, wood or other extraneous material, compacted in 12-inch maximum lifts to not less than
90% Standard Proctor Density for the entire depth of the excavation.
Please provide a detail for the proposed trench drains (Structures 7 and 8).
Could not find the detail noted for the concrete spillway for the pipe discharging from Structure 8.
If the existing driveway is to be utilized as the construction entrance, is Detail 11 on Sheet 5 still
applicable?

dashed. Inversely, line weight within the Guilford Road right of way should not be heavy (we do
not want to inadvertently indicate that property within the right of way is within the final project
boundary).
3. Please remove dashes within the docket numbers.

AGREEMENT TO INSTALL FENCE AND WATER LINE
THIS AGREEMENT (the "Agreement") is made and entered into by and between
Crawford Development, LLC, an Indiana limited liability company ("Crawford") and William tL
$ohnson ("$ohnson"), and is signed on the dates indicated below,
WITNESSE~:
WHEREAS, Crawford is the contract purchaser of the real estate described in what is
attached hereto and incorporated herein by reference as Exhibit "A" ("Pared 1");
WHEREAS, Crawford has filed an application, with the Carmel-Clay Plan Commission,
to change the zoning of Parcel l, which application is pending under Docket Number 04-01-
0024Z;
WHEREAS, Johnson and his wife are the owners of the real estate described in what is
attached hereto and incorporated herein by reference as Exhibit "B" ("Parcel 2");
WHEREAS, Johnson's residence (the "Residence") is located on Parcel 2, and the water
to the Residence is serviced by a well (the "Well") located upon Pared 2;
WHEREAS, on the terms and conditions which follow, Crawford has agreed (i) to install
a fence at or near the boundary line separating Parcel 1 and Parcel 2 and (ii) install a water line
fi'om Parcel 1 and connecting to the Residence.
NOW, THEREFORE, in consideration of the foregoing preambles and recitations, it is
acknowledged and agreed as follows:
1. Upon the cleating and grubbing of Parcel 1, Crawford shall came to be installed a
three board split rail fence without mesh, an illustration of which is attached hereto and
incorporated herein by reference as Exhibit "C" (the "Fence"), in the location specified on the
drawing attached hereto and incorporated herein by reference as Exhibit "D". The highest of the
three (3) horizontal rails of the Fence shall be approximately four (4) feet above grade;
2. Installation of Water Line. When on-site water mains and laterals are installed
upon Parcel 1, Crawford shall cause to be extended a water line, north from Parcel 1 to' Parcel 2,
and connecting to the Residence at a point adjacent to the Well. Regarding the installation of
such water line, the parties further agree as follows:
.(a) Crawford shall pay the availability and connection fees assessed in order
to make water available to the Residence on;
(b) Within seven (7) days after payment of such water availabiti~_and ..... "'
connection fees, Johnson shall pay to Crawford the sum of One Thousand Dollars
(c) Crawford, at its expense, shall (i) mn thc water line north from Parcel 1
and across Parcel 2 to the Residence and (ii) actually connect the water line to the
Residence turnkey, at a place adjacent to the Well, at a time prior to the obtaining of the
first certificate of occupancy for the first townhom¢ residence located on Parcel 1; and
(d) Any subsequent abandoning and capping of the
Johnsons' obligation and expense.

No backup data was provided for the floodplain that is represented in the construction
plans. Thc data is not certified by a registered professional engineer in the State of
Indiana as required by the ordillance.
The ICPR report in thc drainage calculation is r~ot the appropriate program to analyze
the floodplain of an open ditch, because is it not taking the backwater effect into
consideration. This office would STRONGLY recommend a complete HEC-~S
study of the open ditch lo determine a conclusive floodplain re'ea.
It would appear that Indiana Code 14-28-1-20 would be applicable in this case, which
prohibits a person from erecting a permanent structure in the floodway of a stream.
From the presented plans, 7 different units are proposed to be constructed in the
floodway according to study GM. 19278, as listed on the development plan.
Sevcral other issues exist with this project but before they can be addressed au accurate
floodplain MUST be determined. The Hamilton County Drainage Board, Hamilton
County Surveyor's Office, Indiana Department of Natural Resources, and the City of
Carmel Brigineering Office must bc confident in the accuracy of the study before any
work will be allowed on this project,
The analyzes of thc floodplain is required to prevent loss of property or life of all other
property owners on Carmel Creek ("Regulated Drain W.R. Fertig) which would be
greatly affected by the changes to the floodplain area.

with respect to providing School bus transportation for any school age children who
may reside in the referenced development.
School bus service for this proposed development will be limited to bus stop service
being placed at the corner of Brownstone Trace and Guilford Road. Students riding
school buses will be required to walk to this location. School buses other than our small
special needs buses will not be allowed to enter the complex due to lack of appropriate
turn-around provisions.
