I must admit that I was somewhat taken aback by the comments and the strength with which they were made and I may not have provided a clear response to you as relates to the screening of the rooftop units for Jaguar and Subaru. There appeared to be an insinuation that my client was trying to pull one over on the Plan Commission and I feel that I should provide you more information about this. In my presentation, I provided photographs of the HVAC units merely to help the Plan Commission identify the issue that Jon Dobosiewicz raised in his staff report and I tried to assure the Plan Commission that the work was in process. I hope the following information provided by the project' s architect will help the Plan Commission to fully understand the situation. First, the screening was on the construction drawings submitted for the building permit and was included in the bidding construction packets and is a part of the project. Second, the facility was only opened a few weeks ago for business and as is true in virtually every project at this stage, the construction is not complete. There are numerous items still in process; e.g., landscaping which will not be completed until early Spring and normal punch list items, as well as the screening of the HVAC units. Third, receiving a certificate of occupancy is not a statement that all work is completed. It is a certificate that the building complies with the building code and can be occupied. Fourth, the screening panels in question are custom panels which are designed and manufactured specifically for the units installed. In fact, the rooftop mechanical units must be measured after installation to make sure that the correct size panel is used. The panels are then attached to the installed units and they must be exactly sized so as not to interfere with the operation of the mechanical units. Mr. Leo Dierckman January 20, 2005 Page 2 Fifth, to avoid negation of warranties for the HVAC units, the architect must provide the information concerning the screening panels for approval to the specific manufacturer of the units selected by the contractor. I understand that one does not order the panels based upon the specifications alone, because sizing and other ductwork variations can occur during installation which may not affect the HVAC function, but can have a significant impact on fitting the panels to the units. Sixth, the screening panels have been ordered although I do not know the status of the measurements and the approval of the HVAC manufacturer. I hope to be able to provide a timetable by the Special Studies Committee Meeting. Again, there are numerous normal construction punch list items which are being completed as a part of the normal construction process. One item that Mr. Dobosiewicz mentioned Tuesday night concerned the issue of completion of the Subaru ground sign. Please note that I raised this with Mr. Dobosiewicz in a telephone conference a week ago and I brought it up merely to assure him it was in process. The sign requires a firm base and I understand that the weather has been such that the soil and temperature has not been suitable for completion of the base. They need a couple of days of good weather to prepare the base upon which the stone will be attached. It is my understanding that this is merely a weather/scheduling issue. Let me assure the Commission that Mr. Wood intends to construct his project as approved. Mr. Dobosiewicz is correct that there is material on site to complete the project. The other major issue raised last night concerned the design of the building. If I didn't express this well, it was my intention to merely mention in passing that the basis of the design was a national branding concept for Nissan, not that the design was cast in stone. I did go on to say that we had met with Staff and had suggested several modifications of our own. My client has already made numerous modifications to the design. For instance, the national concept provided for bronze metal panels along the west and front where we now show the textured wall facade. We have scored the wall panels to provide a design pattern. In addition, we have inserted 4 ft. x 6 ft. panels of glass blocks 8 in. x 8 in. in several places to provide architectural design changes to break up the building. My client is not adverse to changes and input in the design and I am confident that the Plan Commission, Special Studies Committee and my client can work together to arrive at a project which meets everyone's expectations. As I mentioned in my presentation, Mr. Wood has been a good corporate citizen and just one example of this is his donation of significant right-of-way property along 96th Street of this property to assist the community which donation was made at no cost to the County. This was done several years ago before any project was on the drawing board for the site. Mr. Wood lives in Carmel and his business is not a national business where the decision-making process is made out of state and the profits from his store go back into our community. It is my sincere belief that we can work together to achieve a successful project. We live in the Briar Lane Estates subdivision, in the area of ~98th street 'and Lakeshore. That puts us north of Penske Honda, HarleY Davidson of Indianapolis, Ed Martin GMC, etc.. The problem is in all the traffic generated by test drives from all the dealerships in the residential neighborhood. We have traffic 'consisting of new buyer, service testing,' and malfunction evaluation test drives in a residentially zoned area with a 25 mph speed limit. The perception I have is Shat if the dealerships wish to conduct test drives, a commercial activity that is part of a commercial endeavor, then they should .conduct that activity on commercially zoned streets-of which there are plenty available in the area, not a residentially zoned neighborhood.. It doesn't make~a lot of sense to mix s~range drive~s, in strange vehicles, on'~st~ange r6ads with th~ residential activities of children playing, mail. delivery, people backiH~ out of 'driveWays;. and pedestrian traffic, i.e. runners. This is one of the reasons we have zoning laws, to sepgrate · these contradict6ry.activities. ' In my particular instance, I chose to purchase a home on a cul-de-sac so that there would be less traffic. However', it is a regular destination for various mechanics, and I have come home t6 skid ma~ks in the street. I recently spoke to one of the employees of Harley Davidson about it, trying to explain that this was inappropriate. I was told' that 'it was a public street and he could use it any time'. That, it seems to me, is only partly true. It is a public.street, but not one zoned for commercial test drives. Now he, and his friends, makes it a point to drive down the court in a display of defiance and harassment. Understand though that I am not the only one affected by, or opposed to these exercises. In essence it is no different than if I wanted to Open a'business with signage · at my house. That would be a violation of the zoning laws and you. would not allow that, nor would you allow me to take up residence in a commercial building. I am asking for your assistance in ending this overlap and: separating the co.mmercial and residential conflict. We had discussed this previously and I provided notice consistent with the new legal and this added a number of homeowners to the north. , Tom Engle and I discussed the definition of side and rear yards with Mr. Griffin of your office and we came to the conclusion that the east property line is a rear yard and we approached the BZA application accordingly. We offer the following comments: GENERAL INFORMATION 1. The project site is located within current City of Carmel Corporate Limits. The following jurisdictions will apply. 2. Jurisdictions: · Street and Right of Way - City of Carmel (96th Street/Bauer East Drive) · Water-Indianapolis Water Company Service Area · Sanitary Sewer-City of Carmel Utilities · Storm Sewer- City of Carmel. 3. Board of Public Works and Safety Approval Requirements: · Commercial Curb Cut. When appropriate, Board approval for the curb cuts should be requested. Sanitary Sewer Availability (acreage) and Connection Fees Current Sanitary Sewer Availability (acreage) Fees are $1,365.00/Acre. If Sanitary Sewer Availability (acreage) Fees have not been paid on any portion of this development, payment of appropriate fees will be required with this development. Legal descriptions must be provided in order to calculate these fees. Current Sanitary Sewer Connection Fees are $795.00/EDU. There currently is not a classification for automobile dealerships in our Utility Ordinance. Please provide this office with projected water usage for this facility in order to calculate Sanitary Sewer Connection Fees. It is permissible to utilize existing water usage from another similar Tom Wood facility as a basis for calculation for this proposed facility. In order to do so, we would require a years worth of actual water bills for the existing facility, itemized by gallons of water used, month by month, square footage of the existing facility and square footage of the proposed facility. 5. TAC Review/Drawings submitted for approval: We request that all comments and comment letters generated by this office be answered in writing and be accompanied by a drawing reflecting requested revisions. Final drawings will not be approved for construction until all issues have been resolved. The design engineer must certify all draxvings submitted for final approval. This office will require a minimum of three-sets of approved drawings after all issues have been resolved and the construction drawings have been approved. The drawings will be stamped approved and signed by the City Engineer. The Developer/Owner will receive one-set which is to be maintained on the construction site at all times. Our Construction Manager will receive one-set and one-set will be maintained in the Department of Engineering. If more than the minimum three-sets are requested to be approved, the additional sets (maximum total of two additional) must be submitted with the three required sets. 6. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated right of way and/or dedicated easements will require a Consent to Encroach Agreement between the Owner/Developer and the City of Carmel. This Agreement requires Board of Public Works and Safety approval. 7. Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all sanitary sewer main locations. Please add a note to the drawings with the contact inforntation. 8. I am including copies of the following with this correspondence: · Commercial Project Approval Procedures. · Permit Data, Contacts, etc. · Commercial Permitting Procedures. I will send a copy of our Residential Subdivision and Commercial Irrigation System Requirements upon request. BONDING REQUIREMENTS 9. The following bonding requirements may apply to this project: Performance Guarantees We will require Certified Engineer's Estimates for 100% of the cost of labor and materials to construct a 5-foot concrete sidewalk in the dedicated right of xvay of the Bauer East Drive frontage and a 1 O-foot asphalt multi-use path in the dedicated right of way of the 96th Street frontage. A Performance Guarantee, in the amount of the Engineer's Estimate, will be required to be posted. Street Cut/Right of Way Permit and Bonding Requirements Any work in dedicated right of way of 96th Street or Bauer East Drive (including curb cuts but excluding sidewalks/asphalt paths) will require a Right of Way Permit and a License and Permit Bond. The bond amount will be determined by the number of instances of work in the right of way (commercial curb cuts, storm sewer work, etc.) ~ $2,000.00 per instance. The backfill shall be brought up evenly on both sides of the pipe for the full length of the pipe. Haunching shall extend to the springline of the pipe.
