I must admit that I was somewhat taken aback by the comments and the strength with which they were made and I may not have provided a clear response to you as relates to the screening of the rooftop units for Jaguar and Subaru. There appeared to be an insinuation that my client was trying to pull one over on the Plan Commission and I feel that I should provide you more information about this. In my presentation, I provided photographs of the HVAC units merely to help the Plan Commission identify the issue that Jon Dobosiewicz raised in his staff report and I tried to assure the Plan Commission that the work was in process. I hope the following information provided by the project's architect will help the Plan Commission to fully understand the situation. First, the screening was on the construction drawings submitted for the building permit and was included in the bidding construction packets and is a part of the project. Second, the facility was only opened a few weeks ago for business and as is true in virtually every project at this stage, the construction is not complete. There are numerous items still in process; e.g., landscaping which will not be completed until early Spring and normal punch list items, as well as the screening of the HVAC units. Third, receiving a certificate of occupancy is not a statement that all work is completed. It is a certificate that the building complies with the building code and can be occupied. Fourth, the screening panels in question are custom panels which are designed and manufactured specifically for the units installed. In fact, the rooftop mechanical units must be measured after installation to make sure that the correct size panel is used. The panels are then attached to the installed units and they must be exactly sized so as not to interfere with the operation of the mechanical units. Mr. Leo Dierckman January 20, 2005 Page 2 Fifth, to avoid negation of warranties for the HVAC units, the architect must provide the information concerning the screening panels for approval to the specific manufacturer of the units selected by the contractor. I understand that one does not order the panels based upon the specifications alone, because sizing and other ductwork variations can occur during installation which may not affect the HVAC function, but can have a significant impact on fitting the panels to the units. Sixth, the screening panels have been ordered although I do not know the status of the measurements and the approval of the HVAC manufacturer. I hope to be able to provide a timetable by the Special Studies Committee Meeting. Again, there are numerous normal construction punch list items which are being completed as a part of the normal construction process. One item that Mr. Dobosiewicz mentioned Tuesday night concerned the issue of completion of the Subaru ground sign. Please note that I raised this with Mr. Dobosiewicz in a telephone conference a week ago and I brought it up merely to assure him it was in process. The sign requires a firm base and I understand that the weather has been such that the soil and temperature has not been suitable for completion of the base. They need a couple of days of good weather to prepare the base upon which the stone will be attached. It is my understanding that this is merely a weather/scheduling issue. Let me assure the Commission that Mr. Wood intends to construct his project as approved. Mr. Dobosiewicz is correct that there is material on site to complete the project. The other major issue raised last night concerned the design of the building. If I didn't express this well, it was my intention to merely mention in passing that the basis of the design was a national branding concept for Nissan, not that the design was cast in stone. I did go on to say that we had met with Staff and had suggested several modifications of our own. My client has already made numerous modifications to the design. For instance, the national concept provided for bronze metal panels along the west and front where we now show the textured wall facade. We have scored the wall panels to provide a design pattern. In addition, we have inserted 4 ft. x 6 ft. panels of glass blocks 8 in. x 8 in. in several places to provide architectural design changes to break up the building. My client is not adverse to changes and input in the design and I am confident that the Plan Commission, Special Studies Committee and my client can work together to arrive at a project which meets everyone's expectations. As I mentioned in my presentation, Mr. Wood has been a good corporate citizen and just one example of this is his donation of significant right-of-way property along 96th Street of this property to assist the community which donation was made at no cost to the County. This was done several years ago before any project was on the drawing board for the site. Mr. Wood lives in Cannel and his business is not a national business where the decision-making process is made out of state and the profits from his store go back into our community. It is my sincere belief that we can work together to achieve a successful project. She and her husband, Rob, are the proud parents of a baby boy, Evan Baker Blackman. Evan, who was born January 11 at 4:33 p.m., weighed in at 7 lbs. 6 oz. with a tape measurement of 20 ½ in. We live in the Briar Lane Estates subdivision, in the area of 98th street and Lakeshore. That puts us north of Penske Honda, Harley Davidson of Indianapolis, Ed Martin GMC, etc.. The problem is in all the traffic generated by test drives from all the dealerships in the residential neighborhood. We have traffic consisting of new buyer, service testing, and malfunction evaluation test drives in a residentially zoned area with a 25 mph speed limit. The perception I have is that if the dealerships wish to conduct test drives, a commercial activity that is part of a commercial endeavor, then they should .conduct that activity on commercially zoned streets-of which there are plenty available in the area~ not a residentially zoned neighborhood. It doesn't make a lot of sense to mix strange drivers, in strange vehicles, on strange roads with the residential activities o~ children playing, mail delivery, people backing out of driveways~ and pedestrian traffic, i.e. runners. This is one of the reasons we have zoning laws, to separate these contradictory activities. In my particular instance, I chose to purchase a home on a cul-de-sac so that there would be less traffic. However, it is a regular destination for various mechanics, and I have come home to skid marks in the street. I recently spoke to one of the employees of Harley Davidson about it, trying to explain that this was inappropriate. I was told that 'it was a public street and he could use it any time'. That, it seems to me, is only partly true. It is a public street, but not one zoned for commercial test drives. Now he, and his friends, makes it a point to drive down the court in a display of defiance and harassment. Understand though that I am not the only one affected by, or opposed to these exercises. In essence it is no different than if I wanted to open a~business with signage at my ~house. That would be a violation of the zoning laws and you would not allow that, nor would you allow me to take up residence in a commercial building. I am asking for your assistance in ending this overlap and separating the commercial and residential conflict. I thank you for your time and am open to, and invite any further discussion you wish. Docket No. 04110034 DP/ADLS: Tom Wood Nissan The petitioner proposes a new commercial structure, parking, and signage. The site is located at 4150 East 96th Street. The site is zoned B3/Business. Filed by Lawrence Lawhead for Tom Wood Nissan. The applicant is requesting approval of a Development Plan and ADLS for the construction of an automobile dealership at 4150 East 96th Street. The property is surrounded by other commercial uses in the area. Please see the informational packet prepared by the applicant for an overview of the site. The proposed building is quite distinct and is very similar to the prototypical Nissan dealerships around the country. The Department has asked the applicant to explore alternate building materials than the proposed wide expanses of precast concrete. We have also advised them that the Plan Commission may not respond positively to the proposed signage area on the east faCade of the building. Variances are proposed to allow additional signage on the building. The site is permitted two signs one facing 96th and the other Bauer Drive East. The applicant is proposing a total of four wall signs. A six-foot tall ground sign is also identified on the site plan. The information booklet lacks Tab 11 that illustrates signage. This will be distributed at the meeting along with lighting information. The applicant will need to illustrate a practical difficulty resulting in the need for the level of signage requested with a building of such distinctly branded character. In addition, DOCS has been adamant about the screening of rooftop-mounted equipment for some time now and it was an issue discussed with the last two Tom Wood dealerships. Their appears to be a disconnect between the drawings supplied to the Plan Commission and DOCS and those constructing the buildings. Both the new Subaru and Land Rover/Jaguar/Volvo location have equipment that is clearly visible from 96th Street. DOCS requests that applicant provide the Commission with the Following: o 2. 3. 4.
