First, I would like to extend my appreciation for the time you and Mr. Griffin took out of
your busy schedules to meet with Brian Robinson and myself. We appreciate you
working with us to help us resolve this unfortunate incident.
I have included in this package; the original Tree Preservation Plan and an updated Plan
for Section 1. As for Section 2, I will be submitting the updated Plan for Section 2 upon
completion by Brian Robinson who is reworking the proposed mounding to save the
maximum amount of existing trees along Towne Road. Per our conversation, the damage
for Section 1 has already been done but we have added a block of trees for preservation
on the SW comer of the property just to the south of Lake 3. Stoeppelwerth performed a
survey on this area over the weekend and we have added 422 caliper inches of Preserved
Trees to our Preservation Plan. The total caliper inches removed from Section 1 totaled
272".
Once again, I apologize for this incident and hope that we can be in contact with one
another very soon as to your overall feeling on this plan and we can move forward from
here to ensure that this problem never arises again. Please feel free to contact me with

COMMENTS - PRIMARY PLAT
Thank you for making the revisions. Please understand that the typical cross section still does not represent the
subsurface drain at a location that conforms to the City standard. The Department does not approve the cross section
represented on the primary plat and will review the construction drawings to assure that the subsurface drains are in
conformance to the Department's standards.
You do not need to submit anything further to this office related to the primary plat.

The City has received your comment letter and drawings dated December 22, 2004 based upon the
City review of November 18, 2004.
The comments from the City review have been satisfactorily addressed with the folloxving exceptions:
COMMENTS - SECONDARY PLAT
14. Comment on previous review: "We have not received responses to our Primary Plat review
conunents of July 20, 2004." We need to be assured that our primary plat contrnents have
been incorporated into the drawings, or if not, reasoning why. We will not approve the
drawings until this letter is received.
15. Conunent on previous reviexv: "Please show the Tree Preservation Easement on the Plat. The
15-foot Drainage Easement across Lots 1-8 measures 30-feet on the plat and the Development
Plan." On the Development Plan, the drainage easement measures 30 feet, but is still labeled
15 feet.
COMMENTS-CONSTRUCTION PLANS
17. Sheet C200-C201 - Site Development Plan
Comment on previous review: "Hoxv much right-of-way area was accommodated in
the drainage design? Is it possible to accommodate future connections from road
projects?" Thank you for acconm~odating the west half of the right-of-way. Is this
runoff being detained?
· Comment on previous review: "Please indicate the flood route from the proposed
pond." Thank you for indicating flood'route. Is the area on the opposite side of
Towne Road able to receive this runoff2.
Conunent on previous review: "Please label the swale slopes. S~vales shall be 1%
minimum slope." A backyard sxvale for lots 10- 22 isn't labeled.
18. Sheet C402-C403 - Entrance Detail
· Comrnent on previous reviexv: "Please show the limits of the Towne Road right-of-
~vay pavement section and the milling and resurfacing with two types of hatching and
a legend. The Toxvne Road right-of-way pavement section xvould be installed for all
xvidening, auxiliary lanes and at the entrance to the right-of-xvay limit." Thank you
for adding these items. Is the "existing and proposed pavement combined" hatch
correct?
· Cormnent on previous review: "Please revise the Towne Road right-of-way
pavement section to be: 1.5" H.A.C. #11 Surface over 2" H.A.C. #8 Binder over 3"

19. Sheet C405 - Maintenance of Traffic Plan
· Comment on previous review: "Please show the barrels adjacent to the existing
pavement edge on the Maintenance of Traffic Plan. Please show a specific plan for
the resurfacing operations also." Thank you for revising the plans. As it relates to a
plan for resurfacing operations, I would suggest referring to the IMUTCD, INDOT
standard specifications and dra~vings, and the Work Zone Traffic Control Manual to
develop this plan.
21. Sheet C407- Striping Plan
· The line between the southbound through lane and the northbound left turn lane is
shown as a 4" white line. This should be double yellow.
· Please remove the arrows and "only's" from the entrance.
· Upon further review of the presented mainline configuration, please make the
transitions from the shifted Towne Road through lanes back to the existing alignment
south of the entrance to IMUTCD standards. The taper length is too short for the
design speed.
· Please remove straight arrows from Towne Road through lanes.
· Please provide "only" messages with each Towne Road auxiliary turn lane.
· Please replace the cross-hatching north and south of the entrance with double, double
yellow lines.
24. Sheet C800-C804 - Construction Details
· Comment on previous review: "Backfill Detail. Please add note that final backfill for
all trenches under and within 5-feet of pavement shall be B-Borrow for Structure
Backfill meeting the material requirements of INDOT and shall be compacted in 6-
inch maximum lifts. Please cross check this note with any notes on other sheets in the
set. If Clay Township Regional Waste District or IWC backfill requirements are
more restrictive, use those requirements for the sanitary sewer and the water main
pavement crossings." Thank you for making these edits. Since we reviewed these
plans last, we have again changed our standards relating to backfill. Please edit all
notes, details, and specifications as appropriate on all sheets to conform xvith the
requirements of the attached specification.
· Comment on previous review: "Please replace the Underdrain Detail with the City
Standard Detail." This still needs to be changed.
· Comment on previous review: "Please revise the local street pavement section to be:
1" H.A.C. #11 Surface over 5" H.A.C. #5D Base over 7" #53 Compacted Stone."
Need a correction from "50 Base" to "5D Base."
These comments represent the Department of Engineering's second reviexv of this project. The
Department of Engineering reserves the right to provide additional comments related to subsequent

We received the revised plat and things look close to being completed. The following issues remain
unresolved'
1. The source of title must be listed on the plat (you have indicated that you are aware of such).
2. We require a copy of the restrictions and covenants.
:3. Please remove the signature block for the Hamilton County Commissioners and replace with the
City of Carmel Board of Public Works signature block. This project is within the City of Carmel
corporate bounds.
After the above issues are addressed this plat will be ready for signatures.
Please note:
Two paper copies of the plat must be filed with the Mylar prior to recording.
After recording, we require three paper copies, a digital copy (forwarded to Theresa Krueskamp)
and a Mylar of the recorded plat.

We have reviewed the construction plans and secondary plat submitted for this project for the
November 17, 2004 Technical Advisory Committee meeting and offer the following comments:
GENERAL INFORMATION 1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:
· Streets and Right of Way, Curbs, Street Signs, Sidewalks- City of Cannel.
· Water- City of Carmel Utilities
· Sanitary Sewers- Clay Township Regional Waste District
· Storm Sewers/Drainage - Hamilton County Surveyor's Office (City of Carmel Review).
· Regulated/Legal Drains- Hamilton County Surveyor's Office.
3. Board of Public Works and Safety Requirements' ':
· Temporary Construction Entrance (if applicable and if located at a location other than
planned permanent entrances)
· Please be advised that any open cuts of dedicated streets will require separate Board of
Public [}'orks and Safety approval.
· Any permanent improvement (including irrigation systems) to be installed within
dedicated fight of way or dedicated easements. This approval would require a Consent to
Encroach Agreement bet~veen the Owner and the City of Carmel.

A schedule for Board of Public Works and Safety meeting dates and agenda deadlines was
previously sent for your use. Please use the Engineering Department deadlines for

attd/or the Board of Zoning At,peals (if at~plicable) and completion of review by the
Technical Advisory Comntittee. All written requests to beplaced on the Board's agenda

4. T.A.C. Review/Drawings submitted for approval'
We request that all comments and comment letters generated by this office be answered in
writing and be accompanied by a drawing reflecting requested revisions. -Final drawings xvill
not be approved for construction until all Engineering Department, Carmel Utilities and
Hamilton County Surveyor's Office issues have been resolved. The design engineer must
certify all drawings submitted for final approval. Because of the dual jurisdiction between the
City of Cannel and the Hamilton County Surveyor, we will require a minimum of eight-sets

of drawings for approval after all issues have been resolved. The drawings will be stamped as
approved and will be signed by the City Engineer and by Carmel Utilities. The eight-sets will
then be sent to the Hamilton County Surveyor's Office for approval and signatures. Three
approved sets are to be retumed to the City of Carmel. The Hamilton County Surveyor's
Office will retain t~vo-sets. The Developer, the Engineer and the Contractor will each receive
one-set.
Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
right of way or dedicated easements will require a Consent to Encroach Agreement with the
City of Carmel's Board of Public Works and Safety..
Carmel Utilities/Water Distribution should be provided copies of all drawings and revisions
for review of water issues. They will provide a separate review regarding these issues.
Carmel Utilities does not subscribe to "Holey Moley" and should be contacted directly for all
water main locations.
I have sent copies of the following previously and will not send additional copies unless
requested to do so:

BONDING REQUIREMENTS
9. Individual Performance Guarantees will be required for the following subdivision
improvements:
· Streets (base, binder and surface). You may bond perimeter street improvements
separately.
· Curbs
· Water Mains
· Street Signs
· Monuments & Markers*
· Sidewalks (builders lot sidewalks, perimeter fight of way sidewalks and perimeter asphalt
paths may be bonded separately).
Storm sewer bonding will be under the jurisdiction of the Hamilton County Surveyor's
Office. They may also require bonding for *Monuments & Markers. If that is the case, we
will not require duplicate bonding. Sanitary sewers are under the jurisdiction of the Clay
Township Regional Waste District. -
The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% of the cost of labor and materials to construct the individual improvements, to be
provided by the design engineer. Please provide detailed Engineers Estimates for each
improvement including unit costs, quantities, materials and types of materials, etc. Upon
completion and release of individual Performance Guarantees, a three-year Maintenance
Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the
Performance amount for Streets and Curbs and 10% of the Performance amount for all other
improvements. Performance Guarantees may be Performance or Subdivision Bonds,
Irrevocable Letters of Credit or Cashier's Checks, Certified Checks or Official Checks.
Please reference the enclosures for more detailed explanation of our procedures.

AVAILABILITY AND CONNECTION FEES
10. Availability (acreage) Fees must be paid after all other Engineering Department
requirements have been satisfied and prior to the start of construction activities. Availability
Fees are based upon total platted acreage for the development at the current rate of $1,010.00
per acre (Water
Availability Fee). Based upon the secondary plat indicated acreage, the following Water
Availability Fees would apply:
19.651 Acres ~ $1,010.00/Acre = $19,848.00
Connection Fees are currently $1,310.00 for water per single-family residence. Connection
Fees are paid when the infrastructure has been complete, satisfactory test results obtained and
the subdivision has been released for permits. Water Connection Fees are paid on a per-lot
basis.
· If att irrigation system, switnming pool or clubhouse is planned for these, or any
fitture section of the development, additional Water Connection Fees will be
assessed based upon the recommendation of the Director of Carmel Utilities.
11. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted for review to this office. We will share Crossroad's comments as they
are received.
COMMENTS - SECONDARY PLAT
12. Can another street name be chosen to replace "Squaw Pass"? The Department of Engineering
has become aware that there is pending legislation in other states banning the use of "Squaw"
as this is a derogatory term to Native Americans.
13. On the secondary plat and construction plans, the new street west of Towne Road that is
labeled 136th Street should be renamed. Because this street dips south of the original 136th
Street alignment, to be consistent with the existing street block numbering system, it should
not be considered 136th Street. Was this the result of discussions with DOCS or the Plan
Commission?
14. We have not received responses to our Primary Plat review comments of July 20, 2004.
15. Please show the Tree Preservation Easement on the Plat. The 15-foot Drainage Easement
across Lots 1-8 measures 30-feet on the plat and the Development Plan.
16. Monuments are noted in the legend on the plat but are not indicated on the plat itself.

17. Sheet C200-C201 - Site Development Plan
· How much right-of-way area was accommodated in the drainage design? Is it
possible to accommodate future connections from ro~d projects?
· Please provide adequate right-of-way at the comer cut to accommodate a future 120-
foot radius right-of-way (need to dedicate a few more feet). The center of the
roundabout would be at the apparent existing Towne and 136th Street intersection.
· Please indicate the flood route from the proposed pond
· Please label right-of-way on Towne road as existing or proposed.
· Please indicate pond spillway.
· Please ensure that Structures 444 and 448 do not conflict with future driveways.
· Structure 438 appears to be at a high point. Is this an inlet?
· There is no fall to the street or to the rear yard swale between Lots 12 and 13.
· Please label the swale slopes. Swales shall be 1% minimum slope.
18. Sheet C402-C403 - Entrance Detail
· The entrance is too wide. A 36-foot wide entrance was shown on the Primary Plat.

the island and move the left turn bay in front of the island. Please ensure that the left
turn does not conflict with a left turn movement from westbound 136th Street. Please
show back of curb to back of curb pavement widths on both sides of the median on
136th Street.

milling and resurfacing with two types of hatching and a legend. The Towne Road
right-of-way pavement section would be installed for all widening, auxiliary lanes
and at the entrance to the right-of-way limit.

· The cover between the top of the RCP and the bottom of the compacted stone course
of the pavement section is less than one-foot between curb inlet structures 444 and
443. Please revise to provide minimum cover or indicate flowable fill between the
structures and change the pipe class to Class V.
· Please demonstrate on plans or in the Drainage Report that unmatched pipe crowns
does not have a negative effect on the HGL and that the HGL remains below the top
of castings for the design storm.
· The Storm Sewer Plan and Profile Sheets are not plotted at the scale indicated.
· Please indicate complete elevations on the Storm Sewer Plan and Profile Sheets.
· Thank you for showing the water mains on the Storm Sewer Plan and Profile Sheets.
Please label the water mains on these sheets.
23. Sheet C700-C701- Water Plan
· Please add "sidewalks and curbing" to the note excluding placement of valves in
pavement.

them. The current laterals are shown 2 feet from the property line, which will
make it hard to get around utility pedestals placed on the property line.

Petitioner is the owner of all lots in the land affected by the proposed new regulated drain. The
drainage will affect various lots in The Lakes at Towne Road, Section 1~, a subdivision in Hamilton
County, lndiana, Ihe general route of such drainage shall be in existing easements and along public
~'oads as shown in the plans on file in the Sm'veyor's Office.
Petitioner' believes that the cost, damages and expenses of' tile proposed improvement will be less
than the benefits which will result to the owners of the land likely to be benefited thereby. Petitioner
believes the proposed improvements will:

Petitioner' agrees to pay the cost of constl'uction of the drainage system and requests periodic
maintenance assessments by the Bored thereafter.
The Petitioner' also agrees to the following:
To pIovide the Drainage Board a Pexformance Bond or Non-Revocable Letter of'Credit
for the portion of the dI-ainage system which will be made a regulated drain. The bond
will be in the amount of 120% of the Engineer's estimate.. The bond will be in effect
until construction of' I00% of the system is completed and so certified by the Engineer'..
The Petitioner shall retain an Engineer throughout the construction phase.
At completion of the project the Petitioner's Engineer shall cer'tify that the dr'ainage
system which is to be maintained as a regulated drain has been constructed as per'
construction plans.
The Petitioner agrees to request in writing to the County Surveyor any
changes fi'om the approved plan and nmst ~'eceive written authorization fi'om the County
Surveyor prior to implementation of'the change.. All changes shall be documented and
given to the Su~¥eyor' to be placed in the Drain file.
The Petitioner shall instruct his Engineer to provide a r'eproducible print
on a 24" x 36" Mylar of the final design of the Drainage System, This shall be
submitted to the County Smveyor prior to the release of' the Performance Bond..
Tile Petitioner shall comply with the Erosion ContmI Plan as specified on
the construction plans. Failm'e to comply with the Erosion Control Plan shall be
determined by the Bom'd as being an obstruction to the drainage system. The County
Surveyor shall immediately install or repair the needed measmes at Petitioners cost as
per' IC 36-9-27-46.
The Petitioner fimher requests that t'~'Drain be classified as an Urban Drain as I~C 36-9-27-
69(d).

INSTRUCTIONS OF OUTLET PERMIT REQUEST
Request shall be made to the Hamilton County Surveyor's Office.
2. Request shah be made on standard form onlY, completely fried out with:
a. Name of Drain.
b. Parcel number of property involved.
c. Project name(if none then put individuals name).
d. Name & Address of owner / contractor
e. Specifications of the outlet shall include calculations; if required, size of drain,
length of drain and gradient of drain. This Office may require more details
depending on the characteristics of the outlet.
f. Plot plan showing regulated drain, private drain location, size and type of
material, point of connection, lot lines, buildings, physical features and platted
easements / right-of-ways and any other information required by the Surveyor's
Office.
g. Copy of warranty deed
The. form must be signed by the applicant or an agent of the applicant.
If outlet is required to cross an adjoining property owner, list name, address and
parcel number for each such instance and submit letter granting permission to cross
property from each owner.
Checks or money orders are to be made out to the Hamilton County Treasurer.

as required by ordinance. Construction of the Project shall not commence until all
conditions of this Permit have been met. Final Permits or Connection Permits may
still need to be obtained from the District.
