Ordinance amending and consolidating Commercial Landscape Requirements WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in IC 36-7-4), each unit of local government that wishes to adopt land use and zoning ordinances must first approve by resolution a comprehensive plan for the geographic area over which it has jurisdiction; and WHEREAS, the Carmel Clay Comprehensive Plan "C3 Plan 2009" Docket No. 08070020 CP was given a favorable recommendation by the Carmel Advisory Plan Commission on November 18, 2008, and duly approved by Resolution No. CC-05-04-09-02 of the Common Council on May 4, 2009, and is therefore the official Comprehensive Plan of the City of Carmel and Clay Township; and WHEREAS, the City wishes to maintain an orderly, consistent and streamlined Zoning Ordinance; and WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to amend the text of the zoning ordinance; and WHEREAS, pursuant to Indiana Code 36-7-4-701 the Common Council is authorized to amend the text of the Subdivision Control Ordinance; and WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. D-1600-02, the Carmel Zoning and Subdivision Control Ordinances are incorporated by reference into the Carmel City Code; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, that, pursuant to IC 36-7-4-600 and IC 36-7-4-700 et seq. and after Docket No. 13030009 OA having received a favorable recommendation from the Carmel Advisory Plan Commission on Tuesday, July 16, 2013, it hereby adopts this Ordinance to amend the Carmel Zoning Ordinance (Ordinance No. Z-289, as amended) and the Carmel Subdivision Control Ordinance (Ordinance No. Z-160), as amended, to read as follows: Section I: ZO Chapter 33: Commercial Development Landscape Ordinance: a. Establish Chapter 33: Commercial Development Landscape Ordinance in the Zoning Ordinance to read: SEE EXHIBIT A (Chapter 33: Commercial Development Landscape Ordinance), As Amended SCO Chapter 7: Open Space Standards for Major Subdivisions: b. Amend Section 7.07.03(3): Modifications as follows: 7.07.03 Afforestation and Reforestation. The replacement of trees in the Natural Open Space or tree preservation areas shall be determined on the Open Space Conservation Plan pursuant to the following: 3. A landscape buffer of native trees and shrubs is required adjacent to Woodland open space areas that have been opened up due to land clearing activity. Planting shall occur per Zoning Ordinance Section 26.04: Perimeter Buffering Requirements. Ordinance Z-577-13,Version B l 10/07/2013 ZO Chapter 3: Definitions: c. Amend the following definitions in Section. 3.07.• Definitions to read: GREENBELT. That portion of the Front Yard of the Lot which is immediately adjacent and parallel to the Right-of-way of State Highway 431, U.S. Highway 31 or U.S. Highway 421, located within an Overlay Zone District Boundary and having a minimum depth of thirty (30)feet. PERIMETER BUFFERYARD. A landscaped area with setback widths extending along all perimeter property lines. Both the amount of land and the type and amount of plant material specified for each lettered bufferyard determination is specified and is designed to ameliorate nuisances between adjacent zoning districts and to ensure a desired character along public streets and roads. TREE PRESERVATION PLAN. A graphic illustration labeling existing trees or stands of trees while detailing how they will are protected and incorporated into the overall Landscape Plan design. Existing vegetation proposed to be removed and preserved shall be shown on the Tree Preservation Plan. Tree preservation details showing how existing trees to be preserved will be protected are required. Amend Section 20E.06: Landscaping Requirements as follows: 20E.06 Landscaping Requirements. 20E.06.01 Style and Species. Landscaping shall be designed in accordance with the adopted landscaping style and species palette established for the City Center by the City of Carmel Redevelopment Commission. 20E.06.02 Street Trees. Shade trees shall be planted along all streets within the rights-of-way, parallel to the street. Species, size, and installation shall be per the standards of the City of Carmel. 20E.06.03 Landscaping Installation and Maintenance. 1. Installation. All required landscaping shall be installed prior to the issuance of a Certificate of Occupancy by the Department Administrator. If it is not possible to install the required landscaping because of weather conditions, the property owner shall post a bond for an amount equal to the total cost of the required landscaping prior to the issuance of the Final Certificate of Occupancy. 2. Maintenance. It shall be the responsibility of the owners and their agencies to insure proper maintenance of the landscaping, in accordance with the standards set by this Ordinance. This is to Ordinance Z-577-13.Version B 4 10/07/2013 include, but is not limited to, replacing dead plantings with identical varieties or a suitable substitute, and keeping the area free of refuse and debris. ZO Chapter 20F: C-2/City Center District: n. Amend Section 20F.05: Streetscape and Landscaping Requirements as follows: 20F.05 Streetscape and Landscaping Requirements. 20F.05.01 Landscaping shall be designed in accordance with the adopted landscaping style and species palette established for the City Center by the City of Carmel Redevelopment Commission. 20F.05.02 Street Trees. Shade trees shall be planted along all streets within the rights-of-ways, parallel to the street. Species, size, and installation shall be per the standards of the City of Carmel. 20F.05.03 Landscaping Installation and Maintenance. 1. Installation. All required landscaping pursuant to the ADLS approval shall be installed prior to the issuance of a Certificate of Occupancy by the Department Administrator. ZO Chapter 20G: OM/Old Meridian District: o. Amend Section 20G.04.04 through 20G.04.06: (General Development Standards) as follows: 20G.04.04 Lighting. A. Street lighting shall be provided as part of all projects, on both sides of the street when possible, and spaced no less than one hundred (100)feet apart,and of a design per the adopted City style. B. All exterior architectural, display, decorative and sign lighting shall be generated from concealed, low level fixtures. C. The maximum height of light standards in parking areas shall not exceed the building height, or twenty- five (25) feet, whichever is less. When light standards abut or fall within ninety (90) feet of single family residential, their height shall not exceed fifteen(15)feet. D. Parking area lighting and street lighting shall be of uniform design and materials. E. Exterior lighting shall be architecturally integrated with the building style, material and color. Rooftop lighting shall be prohibited. F. Exterior lighting of the building or site shall be designed so that light is not directed off the site and the light source is shielded from direct offsite viewing. For any use, illumination levels shall not exceed 0.5 footcandle at the property line. G. The design of fencing, sound walls,carports,trash enclosures and similar site elements shall replicate the architecture of the Principal building(s)in construction material and detailing. 20G.04.05 Parking. A. All off-street parking shall be paved with asphalt or concrete, and curbed using poured-in-place concrete curbing. Alternatives to poured-in-place curbing and paving surface may be approved by the Commission when conflicts arise with tree preservation issues. B. Parking areas shall be located at the rear or side of buildings, and screened from the sidewalk by low walls,low fences,or hedges. C. Off-street parking areas for Principal Buildings in the Mixed Use, Office, Special Use and Village Zones are to be located to the sides and rear of Principal Buildings; however, if necessary to meet minimum requirements, parking areas may extend into an adjacent zone and shall be a permitted use in the adjacent zone, accordingly. Ordinance Z-577-I3.Version 13 5 10/07/2013 D. Parking space dimensions shall be 9'x 20', or 10'x 18',including two (2)feet for bumper overhang. E. No curb cuts are allowed on Old Meridian Street, except as shown on the Plan, (Exhibit C). F. Adjacent/adjoining parking lots shall be interconnected either by alley or internal driveway. G. Bicycle parking shall be provided in non-residential zones, one space per one hundred (100) feet of building frontage. H. In the Mixed Medical Zone up to fifteen percent (15%) of parking may be located in front of the Buildings; provided such parking areas are partially screened from the street right-of-way pursuant to Chapter 33: Commercial Development Landscape Ordinance, Old Meridian/Mixed Medical Section. Curb cuts in the Mixed Medical Zone shall be as set forth on Exhibit D. Bicycle parking in the Mixed Medical Zone shall be provided in the ratio of one(1) space per two hundred fifty (250) feet of building frontage. 20G.04.06 Landscaping. See Chapter 33: Commercial Development Landscape Ordinance. P. Amend Section 20G.05.01(H),(I) and (K): (Single-Family Attached Zone) as follows: 20G.05.01 Single-Family Attached Zone(SFA). H. Architectural Design. (1) Design Intention. The design intention for the Single Family Attached Zone(SFA)is to create a zone of detailed,durable and high quality construction. Each house is to be constructed as an individual unit and the façade of the house is to be composed and interpreted as a single unit rather than a part of a larger complex. (Figure 8) (2) Materials: (a) Any side of the building facing a public street must be clad in brick or stone and trimmed in wood, stone, tile, precast.concrete (no vinyl, aluminum or plywood siding shall be permitted) (b) Windows must be framed in wood or aluminum-clad/vinyl-clad wood. Aluminum storm windows or doors are not allowed. (c) Exterior walks, steps, stoops and paving must be masonry or stone pavers, or poured or precast concrete. Exterior stair handrails and other stair details may be stone, precast concrete or wrought iron. (Figures 9 and 10) Wood decking and handrails are allowed only in the rear of a building. (d) Cornice. An articulated cornice must be provided where the roof meets the top of the building wall. (Figure 11) (e) Entrances. The front door must face the street and be recessed from three (3) to five (5) feet from the front wall of the building facade (Fig. 12). A paved walkway from the stoop to the front sidewalk is required. (f) Finished Floor Level. The finished floor level of the first floor shall be two (2) to six (6) feet above sidewalk level in the front, but may be on grade in the rear. (Figure 13) This is to create visual privacy for windows on the street, and to create a rhythm of stoops. (g) Foundation. The foundation should be articulated in a different material than the main façade. There may be windows in the foundation wall which respond to a partially below-grade lower level. Lighting and Fencing. (1) Exterior lighting is restricted to lamps mounted on the building and low-wattage landscape lighting. (2) Low, wrought iron fences and stone or brick walls no taller than thirty (30) inches are allowed in the front yard setback. (3) Wrought iron, shadow box wood fences, or other approved fence, or brick or stone walls up to six(6)feet tall are allowed in side and rear yards. Ordinance Z-577-13,Version B 6 10/07/2013 (4) Fences must be placed at least four feet from the rear property line. (5) Chain link fencing is not allowed in this zone. J. Signs. .See Section 25.07: Sign Ordinance. K. Parking. (1) All units must have a minimum of two(2)parking spaces per unit included on the lot. (2) Parking may be paved or in an attached or detached enclosed garage. (3) All parking must be accessed from the rear of the lot. • (4) No garage openings are allowed to face the public street. (5) No parking of any vehicles will be allowed in the front yard. q. Amend Section 20G.05.04(F) and(G): (Mixed Use Zone) as follows: 20G.05.04 Mixed Use Zone(MU). F. Parking Requirements. (1) Parking must be provided at the ratio of one (1) space for every six hundred (600) square feet of leasable area. (2) Some parking may be provided in shared or remote lots. (3) Parking must be located in the rear or side of buildings. No parking is allowed in the front yard setback. r. Amend Section 20G.05.05(E): (Office Zone) as follows: 20G.05.05 Office Zone(0). E. Fencing:Fences are not allowed in the front setback. s. Amend Section 20G:05.08(F): (Mixed Medical Zone) as follows: 20G.05.08 Mixed Medical Zone(MM). ZO Chapter 21: Special Uses & Special Exceptions: t. Amend Section 21.03: Basis of Board Review as follows: 21.03 Basis of Board Review. The Board, in reviewing the Special Use or Special Exception application, shall give consideration to the particular needs and circumstances of each application and shall examine the following items as they relate to the proposed Special Use or Special Exception: 1. Topography; 2. Zoning on site; 3. Surrounding zoning and land Use; 4. Streets,curbs and gutters and sidewalks; 5. Access to public streets; 6. Driveway and curb cut locations in relation to other sites; 7. General vehicular and pedestrian traffic; 8. Parking location and arrangement; 9. Number of parking spaces needed for the particular Special Use; 10. Internal site circulation; Building height,bulk and setback; Ordinance Z-577-13,Version B 7 1 0/07/2013 12. Front, side and rear yards; 13. Site coverage by building(s), parking area(s) and other structures; 14. Trash and material storage; 15. Alleys, service areas and loading bays; 16. Special and general easements for public or private Use; 17. Landscaping and Perimeter Bufferyards; 18. Necessary fencing; 19. Necessary exterior lighting; 20. On-site and off-site, surface and subsurface storm and water drainage; 21. On-site and off-site utilities; 22. Dedication of streets and rights-of-way; 23. Proposed signage(subject to regulations established by the Sign Ordinance); and 24. Protective restrictions and/or covenants. 25. Need for lifeguards and other supervisory personnel, in respect to a private recreational development or facility. ZO Chapter 23A: Keystone Parkway Overlay Zone: u. Amend Section 23A.03: Landscaping to read: 23A.03 Landscaping Requirements. See Chapter 33: Commercial Development Landscape Ordinance. ZO Chapter 23B: US Highway 31 Corridor Overlay Zone v. Amend Section 23B.10: Landscaping Requirements to read: 23B.1.0 Landscaping Requirements. See Chapter 33: Commercial Development Landscape Ordinance. ZO Chapter 23C: US Highway 421 —Michigan Road Corridor Overlay Zone w. Amend Section 23C.10: Landscaping Requirements to read: 23C.10 Landscaping Requirements. See Chapter 33: Commercial Development Landscape Ordinance. 23C.11 Parking Requirements. A. Spaces required: see Chapter 27:Additional Parking &Loading Regulations of the Zoning Ordinance. B. Space dimensions: 9'0" x 20'0" or 10'0" x l8'0", including 2'0" for bumper overhang where appropriate. C. Parking lots shall be designed to provide coordinated access to parking areas on adjoining tracts or parcels within the Overlay Zone, preferably via a frontage road network. Sites utilizing front-loaded parking areas shall provide for continuous access across the rear of the site to adjoining tracts or parcels. As part of the ADLS submittal, the petitioner shall provide a Site Circulation Plan that illustrates to the Commission how coordinated access will occur relative to the overall U.S. Highway 421 Corridor. D. All parking lots and drives shall be paved with asphalt or concrete. Brick pavers or other decorative pavements may be used as accents in parking lot design. Poured-in-place concrete curbs shall be used. E. Parking within front yard setbacks shall be discouraged and limited to a maximum of two (2) rows of parking, subject to maximum building setback standards and Chapter 33: Commercial Development Landscape Ordinance. F. Stacking for drive-thru lanes shall be confined to the rear of the tract or parcel with outlet from such lines also being to the rear of the building. Lines for drive-thru facilities shall not be permitted along Ordinance Z-577-I3.Version B 8 10/07/2013 the front and sides of structures within the Overlay Zone, nor permitted to spill onto adjoining properties. The minimum number of vehicles required for drive-thru lanes shall be as follows: USE TYPE MIN NO. Amend Section 23D.03.A. Landscape and Lighting (Historic Range Line Rd Sub-Area) to read: 23D.03 Guidelines. A. Historic Ranee Line Road Sub-Area. The Historic Range Line Road Sub-Area encompasses the houses and businesses north of Main Street along Range Line Road. These buildings are generally larger than the others in the Old Town area and are more architecturally distinctive. In addition, their high visibility contributes greatly to the sense of Old Town as an historic area. 1. Renovations and Additions to All Existing Buildings. The following guidelines shall be applicable to all exterior renovations and additions to existing buildings in the Historic Range Line Road Sub-Area, regardless of whether the building is Contributing or Non-contributing. f. Lighting and Fencing. See also Chapter 33: Commercial Development Landscape Ordinance, Old Town Section. i. A paved walkway from the porch or front door to the front sidewalk is required. ii. Exterior lighting is restricted to lamps mounted on the building, seven-foot (7') maximum-height pole-mounted decorative lights, and low-wattage landscape lighting. iii. Fences greater than thirty-six inches (36") tall are not allowed in the Front Yard of the property. iv. Chain link material is prohibited forward of the Front Line of the Principal Building. v. Dumpsters and trash receptacles must be screened from view. Y. Amend Section 23D.03.A.3.j: Landscape and Lighting (Historic Range Line Rd Sub-Area) to read: 23D.03 Guidelines. A. Historic Range Line Road Sub-Area. The Historic Range Line Road Sub-Area encompasses the houses and businesses north of Main Street along Range Line Road. These buildings are generally larger than the others in the Old Town area and are more architecturally distinctive. In addition, their high visibility contributes greatly to the sense of Old Town as an historic area. 3. New Construction. Dumpsters and trash receptacles must be screened from view. z. Amend Section 23D.03.C.1.j: Landscape and Lighting (Character Sub-Area) to read: 23D.03 Guidelines. C. Character Sub-Area. Character Sub-Areas consist of the bulk of the residential areas in the Old Town district both east and west of Range Line Road, and both residential and commercial properties facing Range Line Road in the north end of the District. There are many different styles of architecture in this area; however, the consistency and character of the neighborhood is worth protecting. The intent of these guidelines is to preserve the character of the neighborhood by preserving certain building and siting characteristics, without requiring that specific buildings or building elements be preserved. Renovations and Additions to Existing Buildings. The following guidelines shall be applicable to all exterior renovations and additions to existing buildings in the Character Sub-Area, regardless of whether the building is Contributing or Non-contributing. f. Lighting and Fencing. See also Chapter 33: Commercial Development Landscape Ordinance, Old Town.Section. i. A paved walkway from the porch or front door to the front sidewalk is required. ii. Exterior lighting is restricted to lamps mounted on the building, seven-foot (7') maximum-height pole-mounted decorative lights, and low-wattage landscape lighting. iii. Fences greater than thirty-six (36) inches tall are not allowed forward of the Front Line of the Principal Building. iv. Vinyl covered chain-link material is allowed in the Front Yard except on those properties which front on Range Line Road. For properties fronting on Range Line Road,chain-link material is prohibited forward of the Front Line of the Principal Building. v. Dumpsters and trash receptacle must be screened from view. Character Sub-Areas consist of the bulk of the residential areas in the Old Town district both east and west of Range Line Road, and both residential and commercial properties facing Range Line Road in the north end of the District. There are many different styles of architecture in this area; however, the consistency and character of the neighborhood is worth protecting. The intent of these guidelines is to preserve the character of the neighborhood by preserving certain building and siting characteristics, without requiring that specific buildings or building elements be preserved. 3. New Construction. The following guidelines apply to all new buildings built within the boundaries of the Character Sub-Area. e. Lighting and Fencing. See also Chapter 33: Commercial Development Landscape Ordinance, Old Town.Section. i. A paved walkway from the porch or front door to the front sidewalk is required. ii. Exterior lighting is restricted to lamps mounted on the building, seven-foot (7') maximum-height pole-mounted decorative lights, and low-wattage landscape lighting. iii. Vinyl covered chain-link material is allowed in the Front Yard except on those properties which front on Range Line Road. Creating innovative and environmentally-friendly landscape designs that enhance and define the public and private spaces. Definitions. Terms used in this ordinance are defined in Chapter3:Definitions. II. Landscape Plan. A. A Landscape Plan shall be submitted to the Commission per Chapter 24: Development Plan and Architectural Design, Exterior Lighting, Landscaping& Signage Regulations and the Board per Chapter 21: Special Uses&Special Exceptions. B. The Landscape Plan [as defined herein] shall provide, but may not be limited to, Perimeter Bufferyards, Greenbelts, street trees, foundation plantings, parking lot plantings, and other exterior improvements such as courtyards, plazas, and tree preservation areas. C. The Landscape Plan shall be submitted electronically (portable document format (PDF) or equivalent) and also on paper sheets not smaller than eleven (11) by seventeen (17) inches, and not larger than twenty- four(24) by thirty-six(36) inches. G. The Landscape Plan shall include graphic planting details for trees, shrubbery, and ground cover/ornamental grass. The Landscape Plan shall include a schedule of plants: including a symbol key, botanical name, common name and shall delineate the size,container type, description and quantity of all plant material. I. The Landscape Plan shall identify locations of new plant material with keyed symbols. J. The Landscape Plan shall identify existing vegetation to remain by botanical name and size. III. General Provisions. A. Unless otherwise specified in this ordinance, the dimensions and design of any planting area shall be sufficient to contain the landscaping material planted therein and to provide for proper growth. The planting areas shall contain topsoil which is free of non-soil material, brick and other building and construction material.The following minimum interior dimensions for all planting areas shall be used: (1) Shade and Conifer Trees: Fifteen (15)feet long by eight(8)feet wide by three(3)feet in depth (2) Ornamental Trees: Ten (10)feet long by five(5)feet wide by three(3)feet in depth (3) Shrubs (only): Five(5)feet long by five(5)feet wide by three(3)feet in depth B. When trees are isolated from other lawn and green areas by sidewalks, drives or other impervious surfaces, the Plan Commission, Director or his/her designee may require Soil Volume Replacement Technologies be applied to sustain the life of the plant material when the dimensions of the planting area does not meet the requirements of section III.A. C. When trees are planted within hardscaped areas, they shall be planted in tree wells with approved drainage systems and Soil Volume Replacement Technologies. When a tree grate is used it must be capable of expansion and be expanded to accommodate tree growth.The dimensions of the tree well and grate shall be at least six(6)feet by six(6)feet by three (3)feet in depth. Access to these areas for maintenance purposes shall be designed into the plan. F. Screening of outdoor storage, refuse and loading areas: All outdoor storage, trash and refuse containers and loading areas shall be screened from all Streets and adjacent residential properties. An opaque screen at least six(6)feet in height comprised of plants,trees, walls or other opaque materials must be provided. G. No plant material or berm shall obstruct the sight distance of motorists entering or leaving the site. H. Irrigation System: Any irrigation system shall be selected and installed with the following requirements: (1) Design and Installation:All new irrigation systems shall be designed by a Certified Irrigation Contactor (CIC),Certified Irrigation Designer(CID), Certified Landscape Irrigation Manager(CLIM), Certified Landscape Irrigation Auditor(CLIA)or a Licensed Landscape Architect(PLA). All installations must be consistent with specifications established in City of Carmel Ordinance A-69 and City Code§9-52. (2) System Controllers and Components: All system controllers for newly installed Irrigation systems must be an EPA WaterSense labeled controller. As additional components of irrigation systems are reviewed and labeled by the EPA WaterSense program,those components must be used in new irrigation installations. This includes but is not limited to: Sprinkler heads of all types including sprays and rotors; micro-drip systems; automatic shutoff devices; and any other irrigation component as it is added to the WaterSense labeled list. (3) Maintenance: It shall be the responsibility of the owners and their agents to insure proper maintenance of the irrigation system. This should consist of proper directional spray of water so not to water sidewalks,streets or drives. All broken heads should be promptly replaced and the system checked periodically for leaks. Sprinkler head heights should be adjusted or relocated to adapt to plant growth or changes in landscape design. I. Plant material shall be selected and installed to comply with the following requirements: A. Landscape materials selected shall be appropriate to local growing and climate conditions and follow the guidelines set by the American Standard for Nursery Stock. F. Diversity: Tree genus and species selections for a site shall coincide with the following chart. To achieve certain design effects, a greater number of the same tree genus and/or species may be approved by the Director or his/her designee.The following chart represents tree genus and species variation for any given site. An appropriate and diverse mix of plant sizes and materials shall be provided for all other plant material. Parking Lot Planting: Parking lot perimeter plantings and parking lot interior plantings [as defined herein] shall be landscaped on all sides. (1) Parking Lot Perimeter Planting: (a) The Parking Lot Perimeter Planting unit will only take affect when there is a Perimeter Bufferyard Type'A' planting requirement for front,side and rear minimum yard widths. (b) The minimum planting unit for this area shall include:four(4)shade trees and twenty(20)shrubs per 100 linear feet. (2) Parking Lot Interior Planting: (a) Parking Lot Interior Plantings shall be located within parking lots as landscaped islands, medians, traffic delineators, at the end of parking bays, and between rows or parking spaces in a manner such that no parking space is located more than sixty-six(66)feet from a shade tree. (b) A minimum of one (1) shade tree and five (5) shrubs shall be planted for every ten (10) parking spaces provided. (See General Provisions Section III.A, for minimum planting area dimension requirements.) (c) When an existing parking lot is expanded or improved which increases either the total area of impervious surface or the number of parking spaces by thirty-five percent (35%) or more, the expansion shall be required to comply with this Section 33.V.E:Parking Lot Planting. (b) Sidewalks up to eight (8) feet in width and approach Driveways may be permitted in these areas, but shall not occupy the entire planting area on any side of the building(s). D. U.S. Highway 421—Michigan Road Corridor Overlay Zone Landscape Requirements: (1) Greenbelt: (a) A landscaped Greenbelt area shall extend along the Right-of-Way of U.S. Highway 421 with a minimum width of thirty(30)feet. (b) A minimum base-planting unit for each one hundred (100) linear foot increment of the Greenbelt has been designated,as follows: (i) Three(3)shade trees (ii) One(1)ornamental tree (2) Parking Lot Perimeter Planting.Where parking areas are located in the Front Yard directly adjacent to U.S.421, a perimeter planting area shall be provided along the front and sides of those areas. (a) The required minimum base-planting unit for this area shall include:three(3)shade trees, one (1)ornamental tree, and thirty(30)shrubs per 100 linear feet. (b) The perimeter planting area shall be provided within the Greenbelt area. E. Old Town District Overlay Zone Landscape Requirements: This Overlay Zone is exempt from any landscaping requirements within Section V, and requires only landscaping which is stated herein. (1) Historic Range Line Road Sub-Area. Ordinance Z-577-13.Exhibit A.Version B 9 10/07/2013 Z-577-13,EXHIBIT A,As Amended (a) The Front Yard will be maintained with a groomed landscape of trees,shrubs,ground cover, flowers and grass for the following guideline headings: (i) Renovations and Additions to All Existing Buildings. (ii) New Construction. (b) Main Street District Sub-Area. No requirements. (3) Character Sub-Area. (a) The Front Yard will be maintained with a groomed landscape of trees,shrubs,ground cover, flowers and grass for the following guideline headings: (i) Renovations and Additions to All Existing Buildings. (ii) New Construction. F. Home Place Overlay Zone Landscape Requirements: No additional requirements. G. Carmel Dr-Range Line Rd Overlay Zone Landscape Requirements: No additional requirements. H. West 116th Overlay Zone Landscape Requirements: No additional requirements. I. Monon Greenway Overlay Zone Landscape Requirements: This Overlay Zone is exempt from any landscaping requirements within Section V, and only requires landscaping which is stated herein. (1) Urban Section: (a) Planting Requirements: (i) When a Development Plan or other Commission approval includes or requires reconstruction of the Monon Greenway,the Landscape Plan shall comply with the Monon Greenway Cross Section requirements and must meet the approval of the Director of Carmel/Clay Parks and the Director of Community Services or his/her designee. (ii) The Monon Greenway Setback shall be landscaped with a combination of shade trees, shrubs, planting beds and ground cover,with exceptions for appropriate pedestrian access to building entrances. (iii) Alternatively,the Monon Greenway Setback may be covered with decorative hard surfaces and/or pavers to allow seating areas or outdoor tables,such areas shall be surrounded by low shrubs or planting beds. (iv) Remaining facades shall have foundation plantings in beds no less than five (5)feet in width, with exceptions for appropriate pedestrian access to building entrances. Initially, plantings shall cover at least 75%of the base of the building(horizontally). (b) Tree Preservation Requirements: Existing vegetation within the Monon Greenway Easement or Right-of-Way shall be preserved in accordance with the Monon Greenway covenants. Proposed preservation plans or alterations to the existing vegetation in the Monon Greenway may be sought through a DP/ADLS proposal and require the approval of the Director of Carmel/Clay Ordinance Z-577-13,Exhibit A.Version 13 10 10/07/2013 Z-577-13,EXHIBIT A,As Amended Parks. Otherwise no changes to the Monon Greenway vegetation may be made. Any proposed preservation or alteration outside of the Monon Greenway shall be reviewed by the Director of Community Services or his/her designee and Plan Commission and must be in accordance with section V1.1.3 General Landscape Requirements. When deemed appropriate, and upon the approval of the Director of Community Services or his/her designee, mitigation may occur within the Monon Greenway. (2) Natural Section: (a) Planting Requirements:When a Perimeter Bufferyard is required per Section V, plantings along the Monon Greenway shall be provided as said type'C' Bufferyard. (b) Tree Preservation Requirements: Existing vegetation within the Monon Greenway Easement or Right-of-Way shall be preserved in accordance with the Monon Greenway covenants. Proposed preservation plans or alterations to the existing vegetation in the Monon Greenway may be sought through a DP/ADLS proposal and require the approval of the Director of Carmel/Clay Parks. Otherwise no changes to the Monon Greenway vegetation may be made. Any proposed preservation or alteration outside of the Monon Greenway shall be reviewed by the Director of Community Services or his/her designee and Plan Commission and shall be in accordance with Section V.1.3 General Landscape Requirements. When deemed appropriate, and upon the approval of the Director of Community Services or his/her designee, mitigation may occur within the Monon Greenway. (3) General Landscaping Requirements.The requirements of this section shall apply to projects which require Plan Commission approval, including DP,ADLS and Primary Plat review. (a) Sites with existing trees or stands of trees shall protect and incorporate them into the overall site design.The landscape plan must preserve not less than 75%of all trees that are 6" DBH or larger and located within the required yard/setback areas. (b) A five(5)foot wide planting area shall be provided along all sides of parking areas.The minimum planting shall include two(2)shade trees and thirty(30)shrubs per 100 linear feet. (c) Parking areas shall be located at the rear or side of buildings, and screened from the Monon Greenway by low walls, low fences,or hedges,or a combination thereof. (d) There shall be planted,at minimum,one(1)shade tree and five(5)shrubs per every ten (10) parking spaces. (e) The design of fencing,sound walls,trash enclosures and similar site elements shall replicate the architecture of the Principal building(s) in construction material and detailing. No openings or access gates for trash enclosures shall face the Monon Greenway. VII. Protection of Existing Trees and Vegetation. A. Sites within the OM/Old Meridian District, U.S. Highway 31 Corridor Overlay, Home Place Overlay, Carmel Dr-Range Line Rd Overlay and Monon Greenway Overlay zones with existing trees or stands of trees shall protect and incorporate them into the overall site design. The Landscape Plan must preserve not less than fifty percent(50%)of all trees that are: (1) Six-inches(6") (dbh)or larger, and Ordinance Z-577-13,Exhibit A.Version B 11 10/07/2013 Z-577-13,EXHIBIT A,As Amended (2) Located within the Perimeter Bufferyard and Greenbelt. B. Protection of Existing Trees: Sites with existing trees or stands of trees should make reasonable efforts to protect and incorporate them into the overall site design. Existing vegetation proposed to be removed and tree preservation areas shall be graphically illustrated on a separate plan, to be called the Tree Preservation Plan. (See City of Carmel's Tree Preservation Detail — Available from the Department of Community Services) . C. Tree Preservation Plans should be prepared by an International Society of Arboriculture Certified Arborist or Board Certified Master Arborist, American Society of Consulting Arborists Registered Consulting Arborist, state licensed Landscape Architect or similar professional. D. When tree preservation is not possible due to other site constraints,the Director or his/her designee may require a reforestation or afforestation plan. VIII. Innovative Landscape Design Applications. At least two (2) innovative and environmentally-friendly applications are required and shall be described and shown on the landscape plan. When within Carmel City limits, examples A(1) —A(4) may also count toward stormwater quality BMPs, as defined in Chapter 700 of the Stormwater Technical Standards Manual established by Carmel City Code §6-186. A. Examples of applications: (1) Rain gardens consistent with water quality calculations contained in Chapter 700 of the Stormwater Technical Standards Manual. (2) Bioswales consistent with water quality calculations contained in Chapter 700 of the Stormwater Technical Standards Manual. (3) Pervious surfaces, such as pavers, concrete and asphalt consistent with water quality calculations contained in Chapter 700 of the Stormwater Technical Standards Manual. (4) Green roof system covering at least 25%of the roof area (5) Native trees making up a significant percentage(generally 75%)of the total tree count as determined by the Urban Forester. For purposes of this section, a native tree may be considered a tree species with some form of a cultivar or variety of an Indiana native tree. (See Indiana Native Tree List Available from the Department of Community Services) (6) Existing tree protection - Proper tree preservation of at least 10% of the Perimeter Bufferyard or 25 inches of trunk diameter(DBH)within the property. (7) Foundation planting areas that are asymmetrical or curvilinear provided that the required amount of space is landscaped. (8) Parking Lot Interior Planting areas that are asymmetrical or curvilinear, provided that the required amount of space is landscaped. (9) Soil Volume Replacement Technologies to provide connectivity of planting beds or to provide each tree with at least 200 square feet of root volume as determined by Urban Forester. (10)Rubber sidewalks or similar technology within 10 feet of any tree or as determined by Urban Forester. B. Modification by zoning waiver:The Commission may modify the requirement for landscape setbacks and open space areas. The modification may only be approved when the Commission finds that the project provides: Ordinance Z-577-13,Exhibit A,Version B 12 10/07/2013 Z-577-13,EXHIBIT A,As Amended (1) For outdoor dining activities, special paving, or other examples of exceptional architectural quality in the project's design; (2) A higher overall quality of landscape design than would normally be expected for a similar development project;and, (3) A superior landscape maintenance plan. IX. Landscape Installation and Maintenance. B. Installation: All required landscaping approved as part of a DP/ADLS plan shall be installed prior to the issuance of a full Certificate of Occupancy. When it is not possible to install the required landscaping because of weather conditions, the property owner may be issued a temporary Certificate of Occupancy for a period up to six (6) months or until the installation can be completed and the final landscape inspection passed,whichever is less. C. Maintenance: It shall be the responsibility of the owners and their agents to insure proper maintenance of all trees, shrubbery and other landscaping approved as part of the DP/ADLS Plans in accordance with the standards set by this sub-section. This should consist of watering, fertilizing, proper mulching, clearing of debris and weeds, monitoring for pests and disease, mowing, pruning, the removal and timely replacement of dead, hazardous or dying plants, treating for disease or injury, or any other similar act(s) which promotes growth, health, beauty and the life of trees,shrubs,turf and other plants. (1) Maintenance practices should follow the guidelines set by the American National Standard for Tree Care Operations,ANSI A300(current edition).American National Standards Institute, Inc. (2) Injury of Trees: Unless specifically authorized in writing by the Director or his/her designee, no Person shall intentionally damage,cut,carve,transplant, remove,or attach any rope,wire, nails,staples, advertising posters,or other contrivance;allow any substance which is harmful to such trees to come in contact with them;or set fire or permit any heat to burn and injure any portion of any such tree. (3) Topping of Trees: Topping [as defined herein] shall not be considered a reasonable maintenance practice. Topping is defined as the severe cutting back of limbs internodally to stubs larger than two inches in diameter within the tree's crown to such a degree as to remove the natural canopy and disfigure the tree. Trees damaged by storms or other natural events, or trees under utility wires or other obstructions where proper pruning practices are impractical, may be exempted from this ordinance at the determination of the Director or his/her designee. (4) Shrubbery will be allowed to grow to a natural height of at least three (3) feet without hedging or significant pruning. Minor pruning of dead, dying, crossing or individual elongated limbs for shaping will be allowed. (5) Irrigation systems shall not be installed in the city owned Right-of-Way without approval by the Board of Public Works. The City does not assume responsibility for any damage incurred to an unpermitted irrigation system that is caused by work being performed in these areas. D. Changes after Approval: No landscaping which has been approved by the Commission may later be substantially altered, eliminated or sacrificed without first obtaining further Commission approval pursuant to Section 24.99(B) and in accordance with the Plan Commission's Rules of Procedure. However, Minor and Material Alterations in landscaping may be approved by the Director or his/her designee in order to conform to specific site conditions, only when the alteration results in an improvement to the previously approved plan.A letter requesting approval of changes shall state the following: Ordinance Z-577-13,Exhibit A.Version B 13 10/07/2013 Z-577-13,EXHIBIT A,As Amended (1) Letter shall be on company letterhead—preferably owner's (2) Name of the project, Plan Commission or Board of Zoning Appeals docket number and building permit number (3) Count of plant material that will be substituted and the count of plant material that will be installed (4) Species of plant material that will be substituted and the species of plant material that will be installed (5) Location of substitutions or an attached revised Landscape Plan (6) Quantity of plant material shall be equal or greater (7) Quality of plant material shall be equal or better E. Inspection: The Director or his/her designee shall have the authority to visit any development to inspect the landscaping and check it against the approved plan on file.
