If zoning is approved, I am ok with the rineharts applying for a building permit as
this will not be open to the public and has been stated it will be used for private

Angie, I’m not sure this letter eliminates any of the questions I had about the
use of the property. It says the property will be private use only…to
individuals and students paying for riding lessons. To me this is like
McDonald’s saying they’re not commercial because they only sell food
privately to their customers.
I’ll let you guys decide on this one. I just don’t want to have the state come
back to us and say it was my fault if it didn’t go through them.

explaining the use of that building.
We need to know that the horse stables are for a private use only
(private rental of stalls for horses), and not open to the general
public (such as a horse show or something like that).
If the owner is comfortable with that, to show that they are a
private facility, then he would not be required to get State
approval. But once it becomes a commercial facility, then that is
what triggers the State’s reviews of the building plans, if I
understand correctly.

here is what we need you or the property owner to do:

explaining the use of that building.
We need to know that the horse stables are for a private use only (private rental of stalls for horses), and not open to
the general public (such as a horse show or something like that).
If the owner is comfortable with that, to show that they are a private facility, then he would not be required to get State
approval. But once it becomes a commercial facility, then that is what triggers the State’s reviews of the building plans,
if I understand correctly.

Here are my review comments for this project. These comments are in addition to any comments issued
by Nick Redden and John Thomas of my office.
1. The proposed expansion is less than 0.25-acres. However, the expansion is located within
existing lawn area and the existing improvements on the property far exceed this
threshold without an apparent stormwater management facility. When considering the
storm water runoff from the existing improvements that leaves the site un-managed, the
Department expects that the proposed expansion will result in or represents the potential
to result in a Detriment (as defined in Carmel City Code Section 6-222) by resulting in
“an increase in the amount of discharge” and is prohibited per Carmel City Code Section
6-227(a) (1). Stormwater management facilities shall be provided for the building
expansion. The Department would be happy to meet and discuss options that would be
considered to satisfy this requirement.
2. Further, due to the existing and expanded use of this property as a stabling facility, the
City recognizes the increased potential for pollutants associated with animal waste to
enter the City’s MS4 system. Pursuant to Carmel City Code 6-196, the Department
requests an operation and maintenance manual be created for this project. This manual
shall detail procedures and measures taken by the facility to prevent, control and reduce
pollutants associated with the use of the property as a whole (not just the building
expansion). This manual shall be in the format specified by the City’s SWPPP

requirements and shall be submitted for review and approval by the City. It shall also
contain an Owner Acknowledgement Agreement signed by the property owner. The
Department has examples of documents developed for other, similar uses within the City.
3. A right-of-way permit is required for construction equipment access from the right-of-
way.
4. A construction phase erosion and sediment control plan shall be submitted to this office
and approved prior to the start of construction activity.
5. The Department of Engineering also understands that a variance from the requirement to
surface and curb the parking lot has been requested. Due to the fact that the parking lot is
existing and there are no planned expansions of this parking area, the Department finds
no engineering justification to deny the requested variance.
