This is why utilities acquire an easement v. a permit to construct: so that there is a permanent ability to maintain pipeline and right of way identity, accessibility, integrity. We moved the pipeline (yes,we were reimbursed)to accommodate street and property development with the intent of minimizing or eliminating conflicts such as this vegetation issue. Moreover,what is the probability that Buckeye may have to trim or remove this vegetation that has grown substantially over time to the degree of becoming an impediment for exercise of easement rights? Are there any other landscape plans(options)for consideration? One prospect exists on Buckeye's side and that is 'encroachment agreement' with the current landowner but I hesitate to execute such an agreement when I have an agreement that describes terms and conditions for permitted and non-permitted uses of the right of way. Illinois Street Streetscape.Along Illinois Street, due to the 50 foot gas line easement,planting and landscaping with a shallow root system is to be installed within the easement area adjacent to the right-of-way of Illinois Street. Excepting for the Preservation/Conservation Area and subject to approval of the pipeline company,as to species and planting details, for each one hundred (100) linear foot increment: four (4)trees and ten (10) shrubs will be required.These landscaped areas along Illinois Street will vary in width to accommodate appropriate planting space and to facilitate and promote creative planting and site plans, but will be at least five (5) feet in width. So,depending on what the amended landscape plan looks like and how much it changes,it may or may not need Carmel Plan Commission re-review and re-approval. Hopefully,this can all be worked out administratively. The easement modification we granted Frank Regan clearly states no trees. Inconsistency in easement enforcement is often pointed out to Buckeye by opposing counsel when we challenge land owners and their various encroachment items on the right of way including trees. This is a high-pressure petroleum products pipeline right of way—is there any exception/exemption Carmel can grant given the circumstances of this land development—pipeline utility conflict? In order to allow appropriate access to the pipeline for reasons of, but not limited to,Watch and Protect Program, access for pipeline maintenance, and access for emergency response in the best interest of public health and safety, 10 feet must be provided on either side of the centerline for a total width of 20 feet. It is understood these will be shallow rooted varieties however, a 6 foot wide corridor centered on the pipeline will certainly fill in overtime and not allow for appropriate access immediately let alone into the future.
