FINDINGS OF FACT - SPECIAL USE
1. The Special Use in Flood Plain District, Ordinance Z -160, Section 21.6 as amended s) (does not) apply and
allpprerequisites have been met by Petitioner as verified by:

2. The Special Use will be consistent with the Character and Permitted Land Use of the zoning district and
Carmel/Clay Comprehensive Plan because:
The church building falls within a permitted special use as provided by Ordinance
5.2 and is in keeping with the purpose and intent of the S -1 residential, district.
3. The Special Use is physically suitable for the land in question because,:
The church building will lie on 25 acres providing more than adequate green space
in keeping with the rural character of this district.
4. The Special Use will not injuriously or adversely affect the adjacent land or property values because:
The proposed church building, parking and lighting are adequately set back from
adjacent land owners and buffered by appropriate landscaping.
5. The Special Use will not adversely affect vehicular or pedestrian traffic flow, nor the adequate availability of water,
sewage, or storm drainage facilities, or police or fire protection because: The curb cuts along with the
expansion of Hazel Dell Parkway and 146th Street will provide adequate andrapprop-
iate;:access:.tolthe property, water availability, sewage, and storm drainage
facilities are adequately provided.
6. The Board has reviewed the requirements of Ordinance Z -160, Section 21.3 (1 -25) as they relate to this Special
Use, and does not find that those criteria prevent the granting of the Special Use:

Woodland Springs Christian Church seeks to build a. new church facility which will
exceed in height the provisions of Ordinance Nos. 5.4.1 and 26.1.1 which states the
maximum height may be 35 feet. The variance is sought because the maximum height
of the proposed structure will be 60 feet.
8) State reasons supporting the Developmental Standards Variance: (Additionally, complete the attached question

The variance will not be injurous to the public health, safety, morals and general
welfare of the community, will not substantially affect the use and value of
adjacent property in an adverse manner and is necessary for the size, design and
purpose of the building proposed.

FINDINGS OF FACT - DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the .
community because:
The church building is intended to be used to advance the morals and general
welfare of the community. The building is appropriately designed so that the
height will not pose a risk of injury to public health and safety.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially
adverse manner because:
The design of the church building is in keeping with the asthetic values of the
community, is sufficiently set back from adjacent landowners and will in part be
screened and /or buffered by appropriate landscaping.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
The height restrictions provided by the Ordinance would not be practical for a
building the size of that proposed by the applicant. Further, the variance allows
for a design which is recognizable as a church and is fitting for its intended
purpose in the community.
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Developmental Standards Variance
Docket No. is granted, subject to any conditions stated in the minutes of this
